Monday, December 20, 1937
The City Uouncil of the City of Lodi met in regular
session at 8:00 o'clock P.M. of Monday, December 20, 1737.
Councilmen Clarti, Graffigna, +eine and Steele present,
Councilman Spooner absent being out of the City.
The minutes of the last meeting held December
7th was read, approved as read and so indorsed by the b-ayor.
The Clerk read a letter from the Secretary of the
State Chamber of Commerce in regard to the California Standard
Building Code.
Resolution No. 939 was introduced on motion of
Councilman Graffigna, seconded by Councilman ++eche, read by
the Clerk and considered by the ,ouncil.
RESOLUTION NO. 939
WHER1:AS, the term of office of Dr. James E. Nelson
as trustee of San Joaquin Local Health District will expire
on the 2nd day of January, 1938, and;
V,H REAS, this City Council in appreciation of the
services rendered by Dr. Nelson, desires that he continue in
said office;
BE IT RESOLVED, that Dr. James E. Nelson be and he
is hereby reappointed trustee of San Joaquin Local Health
District from the City of Lodi for the statutory period of
two 7 --ars ending °anuary 2, 1940.
The foregoing Resolution No. 939 was then passed
and adopted by the following vote:
AYES: Councilmen, Graffigna, �veihe, Clark and
Steele.
NO -CS: Councilmen, None.
ASSENT: Councilman, Spooner.
On motion of Councils -an Graffigna, seconded by
Councilman V'ieihe the —ayor was authorized to sign a price
stablLization agreement with the Standard Oil Company for
road oils.
The Clerk was authorized to purchase a strip of
land near De Force Avenue by the adoption of Resolution No.
940-
IUSOLUTION NO. 940
RESCL'iED, by the City Council of the City of Jodi
that the City Clerk is hereby authorized, empo-vered and directed
to obtain a deed from Annie G. O'Donnell, Mary G. Dalton and
Arabella G. Cromrell, for the curpose of opening the alley
between north Sacramento Street and North School Street and
to pay said grantors the surra of Two Hundred and No one
hundreths ($200.00) Dollars, therefore.

and adopted by the fallowing vote:

The Clerk presented a supplimental petition for
street lighting on Flora and Eden Streets and the same was
ordered referred to the City ngineer for inclusion in a
Works Progress Administration project.
In the matter of the abandonment of Mission Street
Resolution No. 938 was introduced on motion of Councilman
Clark, seconded by Councilman �ieihe, read by the Clerk and
considered by the Council.

RESOLUTION ORDERING THE A:A11,.:Ci+Y P!T OF
:.ASSIGN STREET Ls "'+:ELLS'OOD PARR"
1REEREAS, this City Council of the City of Lodi did
on the fifteenth day of "ovember, 1937, pass and adopt its
resolution numbered 936 wherein it declared its intention to
abandon Lission Street as said street is delineated and so
desiinated on that certain map or plat entitled "''A LLS;00D
PARK on file and of record in the office of the Recorder
of San Joaquin County, State of California;
AND, liaEREAS, it appears that notice of such intention
was regularly posted and published in time, form and manner
as required by law as is evidenced by the affidavit of
CLIFFORD GATZERT who personally posted copies of said notice
along the line of said street, now on file in the office of
the City Clerk of this City, and by the affidavit of RUTH SNYDE
DURFEY, principal clerk of the publisher of the Lodi Times,
a newsparer of general circulation in v+hich this City Council
directed publication of said notice, also filed with said
City Clerk;
AND, WEER,AS, more than ten days have elapsed
since the last publication of said notice and since the posting
of copies of said notice and no objections to the abandonment
of said street have been filed or presented to this City
Council or to the Clerk thereof, and this City Council has
now acquired jurisdiction to order the abandonment of
said street as a public street or highway;
NOY,, THEREFORE, this City Council in view .of the
foregoing finds, determines and declares as a fact that said
notice of abandonment was duly and regularly posted and
published in time, form and manner as prescribed by law and
the direction of this City Uouncil; that no objections or alleged
objections were filed or presented; that the time for filing
of such objections has expired; and that this City Council
has now acquired jurisdiction to order the abandonment of
said street; and that said street is not required to sdrve
any public use;
THEREFORE, 3E IT RESOLVED, D, that it is to the public
interest and benefit that said street be abandoned and it is
hereby ordered .that said street be abandoned. The street
herein abandoned is particularly described as follows:

1,,izsion Street as said street is delineated and so
designated on the official kap of '"'WELLS,,OOD PARK" it
being a subdivision of,a part of Lot 19 and of Lots
20 and 21 of the Lodi Darnhart Tract," which map was
filed with the recorder of San Joaquin County, California
on the 20th day of August, 1924, and recorded in Vol.
10 Maps and slats at Page 94 thereof, San Joaquin
County Records.
The foregoing Resolution No. 938 was then passed
and adopted by the follor:ing vote:
AYES: Councilmen, Clark, Weine, Gra_nfigna and
Steele
INCUS: Councilmen, None
ABSEBT: Councilman, Spooner.
The semi-monthly payroll in the total amount of
x854.79 --'ere allowed and ordered paid on motion of Councilman
eiie, seconded by Councilran Graffigna.
15 building permits, applications Pao. 1863 to and
including i+o. 1879 with the exception of %o. 1867 and 1874
for structures to cost ';10,95.00 were allowed and ordered
granted. Application Pyo. 1�7L1 was denied as the building
proposed to be moved was held not to be fit for human habitation.
Resolution Pio. 0.41 was introduced on motion of
CouncilLan Clark, secon"Jed by Councilman Graffiona, read by
the Clerk and considered by the Council.

AEFREAS, there is deposited in the City Treasury
of this City in "Special Deposit Account" surplus funds in
the amount of X6,000 over and above moneys necessary to make
refunds in the usual course of business; and,
'iEE,REAS, these funds bear little or no interest and
a reasonable return can be had thereon by purchasingUnited
States Savings Bonds, therefore,
BE IT RESOLVED, that the payor, the City Treasurer
and the City Clerk, all or any of them as may be required, are
hereby empo::ered, authorized and directed to purchase United
States Savings Bonds in the amount of `x6,000. in the name of
and for the City of Lodi and deposit the same, when received,
with the City Treasurer who shall be the custodian of said
bonds and liable for the safe -keeping thereof.
The foregoing Remlution No. 9!rl was then passed

On motion of Councilman Clark, seconded by Coancil-
mar. +eihe, the Ooancil then adjourned, such adjournment
beinb taken in memory of John Silas .+:ontgoner7 who died
December 20, 1937 and aho had served the City as Council-
man and 14yor from 1918 to 1922.
