This regular meeting of the City Council of the City of Lodi
_ was called to order by the L:ayor at 8:00 o'clock FX. of L'.onday, Lay 17,
1937. Councilmen Clark, Graffigna, Spooner, Weihe and Steele present,
none absent.
The minutes of the last regular meeting held May 3, 1937 were
read, approved as read and so indorsed by the Uayor.
The Central California Traction Company applied by petition for
a revocable permit to cross Slain and Tokay Streets with a single line of
track leading into the eastern side of the Foster and ood Cannery Grounds.
On motion of Councilmen T'Teihe, seconded by Councilman Spooner, Resolution
No. 911 was intrcduced, read by the Clerk and considered by the Council.

BE; IT RESOLVED, By the City Council of the City of Lodi, County
of San Joaquin, State of California, at a regular meeting, duly and regularly
held as follows:
SECTICN 1: The City of Lodi hereby grants to the Central California
Traction Company, a corporation, its successors and assigns, so far as it
lies within the power of the City of Lodi to grant V.e some, for such term,
period and length of time as shall meet with the pleasure of the City
Council of the said City of Lodi, the right, privilege and permission to
construct, lay down, operate and maintain upon and across those portions
of streets in the City of Lodi, hereinafter described, a railroad track
of standard guage with the right, privilege and permission of running and
operating thereon cars and rolling stock propelled by engines, motors
electrically driven, or driven by other lawful motive power.
The route over and along which said right, privilege and permission
is given is as follows, to -wit:
Beginning at a point in the center line of the existing track of
the Central California Traction Company, located along the Westerly side
of South Lain Street in the City of Lodi, California, said point being
approximately 118.0 feet northerly from the northerly line of Tokay Street,
and approximately 5 feet easterly from the westerly line of South lain
Street; thence southerly thru a No. 5 turnout to the left a distance of
70 feet to the beginning of a curve concave to the left having a radius
of 125 feet; thence along said curve a distance of 163•.5 feet to the end of
said curve, said curve crossing the northerly line of Tokay Street ap-
proximately 26.2 feet westerly from the easterly line of South !Wain Street,
and the said curve crossing the southerly line of Tokey Street approximately
292.2 feet westerly from the westerly line of South Stockton Street; thence
southeasterly on a tangent to said curve a distance of 46.6 feet to the
beginning of a curve ccncave to the right, having a radius of 125 feet;
thence along said curve a distance of 182.74 feet to a point of tangency
approximately 100 feet westerly from the westerly, prop erty line of South
Stockton Street and approximately 159.3 feet southerly from the southerly
line of Tokay Street; thence southerly tangent to said curve, parallel
with and 100 feet westerly from the western line of said South Stockton
Street, a distance of approximately 400 feet to end of track.
SECTION II: This Resolution shall take effect immediately.

The foreaping Resolution ::o. 911 was then passed and adopted by
the following vote:

In the matter of the purchase of voltage regulators under
proposals received and opened on May 3, 1937 and referred to the Super-
intendent of Public Ltilities, :.s. 1. A. Henning orally reca.manded
that all bids be rejected and that purchase of this a_rparatus be made
in the open market. After bir. Henning's report, the Clerk read a letter
from the 'ttestinghouse Electric Yanufacturing Company stating that as low
bidder they felt that award should be made to that company. On motion of
Councilman Graffigna, seconded by Councilman y+eihe, Resolution No. 912 was
introduced, rTad by the Clerk and considered by the Council.

RESOLVED, by the City Council of the City of Lodi that all bids
for the re-
furnishingof voltage ulators, received and opened on the 3rd
day of May, 1937 be and the seine are hereby ordered rejected.
BE IT ALSO FESCLITED1 , that this City Council hereby finds and
determines that it is to the best interest of the City of Lodi to
purchase said voltage regulators in the open market.

Applications for business licenses No. 8453 to and including
No. 8466 were allowed on motion of Councilman Neihe, seconded by Councilr-an

In the furtherance of the project for the opening of Tokay Street,
Councilman Spooner, seconded by Councilman Ieihs introduced Resolution
No. 913 which was read by the Clerk and considered by the Council.

That Resolution No. 826 passed and adopted by this City Council
Tanuary 6, 1936 be, and the sa=e is hereby amended by adding to the list
of streets of major importance therein enume-ated, Tokay Street, from the
west line of Cherokee Lane (State Route 4) to the gest line of Sacramento
Street and from the west line of Sacrwm nto Street over a proposed extension
of said Tokay Street to the county road known as @uinby Avenue.
The City Clerk will transmit a certified copy of this Resolution
through the office of the District Zngineer for District 10 of the Division
of Highways to the Department of Public corks, Division of Highways with a
request that the said Tokay Street and its westerly extension be included in
the list of streets of major importance qualified to receive allocations of
gasoline tax monies.

This resolution is adopted in view of the fact that Tokay Street
has become a major street by reason of the location of industries on or
near sail street and for the reason that a cross-town connection must be
made available to additional school facilities now being constructed in
the south-western portion of the City. This street is the only east and
west street extending across the Southern Pacific Railway from Lodi %venue
on the north to the southern City Limits, a distance of one mile.
The foregoing Resolution No. 913 was then passed and adopted
by the following vote:

Resolution No. 914 was introduced on motion of Councilman Spooner,
seconded by Councilmer Neihe, read by the clerk and considered by the
Council.

IN THE !'.TnTIFR OF THE OPENING
AND WIDENING OF TOKA`r STR..F'cT
'YFTEREAS, the City Clerk did on the 13th day of May, 1937 find that
it was necessary to immediately consummate the purchase of certain lots needed
in the opening of Tokay Street between Sacramento Street and School Street
and did enter into a contract for the purchase of said lots at a price of
Fifteen Hundred Fifty ($1550.00) Dollars on which he made a down payment of
the sun of One Hundred (9100.00) Dollars;
BE IT RESOLM, that this City Council of the City of Lodi does
hereby approve the act of said City Clerk and does hereby comit the City
to the purchase of said lots for the amount first above mentioned, it
being understood that the purchase price of lots 8 and 19 of the Beckman
Tract is to be ultimately defrayed from gasoline taxes accruing to the
City of Lodi and that the purchase authorized herein is merely an advance of
general fund moneys to secure these lots at a reasonable purchase price.
BE IT ALSO RESOLVED, that the City Clerk and the.City Engineer
are hereby authorized and directed to make such negotiations as may be
necessary for recommendations to this City Council in regard to the purchase
of other lands necessary to be secured for the opening and widening of said
Tokay Street.
The foregoing Resolution No. 914 was then passed and adopted by
the following vote:

After the reading of a bulletin from the legislative bureau
of the Leegue of California Municipalities, Resolution No. 915 was introduced
on motion of Councilman Weihe, seconded by Council -Lan Spooner, read by the
Clerk and considered by the Council.

VEE—TEAS, there is now pending before the legislature of the State
of California certain bills which this City Council believes are inimical
to the best interests of local home rule;

BE IT RL'SCLV D, that this City Council hereby records its opposition
to Senate Bill No. 125 which bill would enact a per anent 5% .limitation
upon the increase of local government expenditures, and also that this City
opposes the adoption of Assembly Bill No. 2365 which would create a
mandatory civil service system in the Fire Department. :his City Council
believes that civil service should be a matter for the determination of
local governing bodies and should apply, if enacted, to all departments
of the city government;
BE IT FiTrTF. i RFSOL?ED, that a copy of this resolution be fbn:arded
to the Senator and Essemblyman representing this district with the
request that they actively oppose the adoption of either of these bills.

A routine authorization of an agreement for the expenditure of
gasoline tax monies for the maintenance of Statef Highways: within the
City was authorized by the adoption of Resolution No. 916, introduced
on motion of Councilman 'Veihe, seconded by Councilman Clark.

RESCL`M , by the City Council of the City of Lodi that the
Vayor of this City and the City Clerk thereof be, and they are
hereby authorized and directed to execute for and on behalf of
this City, an agreement with the Department of Public Works of
the State of California, Division of Highways, for the expenditure
of accrued and accruing gasoline tax monesy on State Highways
in and adjacent to this City, a copy of which agreement is annexed
hereto and made part hereof for all purposes as is set forth in
full herein.
The foregoing Resolution No. 916 was then passed and adopted by
the following vote:

Ten building permits for structures to cost $31,350 being Nos.
1700 to and including 1709 were allowed and ordered granted.
On motion of Layor Steele, seconded by Councilmen Spooner, it
was directed that the fence at Lake Park be moved South to the
Northern boundary of the present State Highway No. 53. ,.lotion carried.
On motion of Councilman Clark, seconded by Councilman Graffigna,
the Cors:ittee on Parks was authorized to purchase two new tennis
nets at $26.75 each.
Mr. W. G. Furrle appeared before the Council at this time in
regard to the shortage of boats at the Lake Park . On motion of
Councilmen :raffigna, seconded by Councilman Spooner it was authorized
to :rake or buy ten additional boats.
Claims No. 29071 to and including No. 29100 in the total amount
of $1,C05.75 were allowed and ordered paid on motion of Councilman
Graffigna, seconded by Council^an ',reihe.

On notion of the Layor, seconded by Councilman Clark, the sus
of $100.00 was allowed to the Lodi Union High School Band for part of their
expenses in attending the opening of the Golden Gate Bridge, the funds to
come from any source available.
No further business appearing, the City Council adjourned on
motion of Zayor Steele, seconded by Councilman Graffigna.
