Monday, December 7, 1936
The Citr Council of the City of Lodi met in regular session at
8:00 o'clock P.L. on L:onday, December 7, 1936; Councilmen Clark, Graffigna,
Spooner and Steele present, CounciL;an !leihe absent being confined to a local
hospital.
Mayor Steele called the meeting to order are the Clerk read the
minutes of the `reseeding meeting held November 16, 1936. The minutes
were approved as read and so indorsed by the L:ayor.
Mr. Tohn Umdenstock addressed the City Council in regards to
the accumulation of water In the gutters at Walnut Street and Lee avenue.
This matter was referred to the City Engineer with instructions to estimate
the cost of repair and to formulate an application to the Works Progress
Administration for the repairing of this gutter and also other gutters
in the City where the same difficulty was being encountered.
The Clerk read a letter from Mr. Fred W. Lange, 139 South
Oali'ornia Street, Stockton, California asking for an allotment of time at
the City baseball grounds at Lawrence 'ark on alternate Sundays beginning
February 13, 1937. L's. Lange being present then addressed the Board
regardin1v his proposal but owing to the absence of Councilman Weihe it was
decided to hold the matter in abeyance until such time as he could be
informed.
The monthly re_ort of the Chief of Police for November and that
of the Citv Poundaaster for the same period were received, read and ordered
filed.
Dance Permit No. 12 was granted to L':ichel Berardengo on
application, the seine having been recomvrended by the Chief of Police.
Business License Applications No. 7892 to 7917 inclusive were
allowed end licenses ordered issued.
The Clerk read a verified petition from the Veteran's Welfare
Board praying for the abandonment of 1936-37 taxes against a Portion of
Lots 16 and 17 in Bloc's 1 of Hutchins Homestead Addition standing of record
in the name of Albert J. and Bernice A. Randolph. On representation of
the Clerk that these taxes should be paid by the veteran owning an equity
in the property, the petition was ordered laid over until the next meeting.
The contract with the Great Western Electro -Chemical Company
for the supplying of liquid chlorine for use at the Sewage Disposal Plant
being, about to expire, a renewal of the contract for a period of one year
beginning January 1, 1937 was authorized on motion of Councilman Clark,
seconded by Councilman Spooner.
Twenty-tvm (22) building permits applications Nos. 1577 to and
including 1598 for structures to cost .+`x18,300 were allowed and ordered
granted on motion of C-uncilman Graffigna, seconded by Councilman Spooner.
Acting City Engineer, C.O. Henning stated that br. Fred W.
Post, Superintendent of the Sewage Disposal Plant, had asked him to procure
new window. shades for the dwelling house occupied by L's. Post and owned
by the City. On motion of Councilman Spoone r, seconded by Councilman
Graffigna, Mr. Henning was instructed to purchase the necessary shades.
In the matter of Richard Dell LeClure, an employee of the Electric
Plant, injured October 12th, 1936, the Clerk read correspondence between
himself'and the industrial Accident Commission seeking to obtain some award
from the Cor -mission to pay Lr. UcOlure's hospital bills, but it appearing
that nothing could be done in the matter on account of the rules of the
Commission the mattdr was ordered dropped.

The Ccuncil entered into some discussion of the matter of opening
To'saq Street westerly to Sacr^ento Street but owing to the many curves
and the amount of land necessary to be taken, it was determined that no
action could be taken at this time.
The Clerk read a letter fro= the Federal Emergency Administration
of Public .to.orks addressed to 1:.. Glenn ''lest in regard to the Citys
abandonment of the Loan and Grant Agreement with the Federal Government
dated February 29, 1936. On motion of Councilman ='poorer, seconded by
Councilman Graffigna, Resolution No. 872 was introduced and read at length
by the Clerk and considered by the Ccu ncil. On motion of Ocu ncilrsin
Spooner, seconded by Councilman Graffi3na Resolution No. 972 was then
adopted by the folloc-in_ vote:

Offer" from the united States of :+rerica, (under PIA Docket No. 5731)
the purpose of =which is to aid said City in the ccnst;uction of a Diesel
hydro -electric generating plant on the Lokelumne Hiver, and;
ff7::F?aS, this City Ccuncil of said city has formally det=r_lned
that, owing to the unavoidable and prolonged litigation concerning this
project and the bond issue, from A•hich said electric generating plant as
to be constructed with the assistance of the proposed P'+1G. Grant, and the
attendant rises in costs of labor and materials, the said plant cannot be -
constructed for a sum. :%lithin the limits of the funds available from such
bond issue, to -wit, cannot be const_,cted for the sum of $466,000.00 in
a'dition to the proposed United States sunt, in that the said costs of
labor and materials have increased enorn^usly durin.3 the pendency of such
liti r.tion; and,

said bona issue has been cancelled, the proposed power gereratin�; project
abandoned, as impossible to construct under present conditions, and the
pre+ect site has been sold b+r said city; now therefore,

its right and interest in and to the said Loan and Grant offer and requests
that the sae be terminated for the reams herein stated; and does hereby
request the Federal Public ;,oras Administtation to rescind any and all
allotments, rade by it, for seid project, and s^ecif ically requests the
United States of Arerics to cancel the offer made by it to the Citv of Lodi
under date of February 29th, 1936, and accepted by said City on April 9th, 1936.
RESC.LVED, ALS -0, that this City Council hereby expresses its
app—.eciation., and the a^r^eciaticn of the citizens of this City, to the
United States Government, and 'mrticul-^.rly to the officers and personnel
of the Federal Emergency Administration of Public works, for their efforts
on behalf of this City ?zth the sincere regrets that the object of the
said Loan and !want offer c-uld not be accomplished.

Yr. John A. Hernia -7, Superintendent of Public Utilities, then
adiressed the City Council in retard to necessary a,'ditions to the
:nater distributicn system, statin- that about $8,500 shoul41 be expended
_ at once in the installation of water :sins on Porta Sacramento Street
and on Vine Street as part of the program set up by the Board of Fire
Underwriters. Mr. Henning also suggested that considen—tion should be
given to the purchase of a gasoline or diesel unit connected to a
generator of sufficient size to drive the City's pumps, and on motion of
Co,=ilmn Spooner, seconded by Ccuncili en Graffi�ne, the acting city
engineer :nes directed to coocerate with +'+r. T. A. Henning in preparation
of plans and srecifications for necessary additions in improvements to
the nater sy=tem.
At 9:30 o'clock t.f.:, the Council retired into executive
session at the order of the 11;_ or retuaaing to o -pen meeting at 10:18
