The City Council of the City of Lodi met in regular session at 8:00 o'clock P. M. of Monday, June 1, 1938, Councilmen Clark, Graffigna, Spooner, Weihe and Steele present, None absent. The minutes of the last meeting held May 189 1936 were read approved as read and so indorsed by the Mayor. No persons appearing at this time the order of public hearings was passed and the Council proceeded to hear communications and reports. The report of the Chief of Police for the month of May and that of the Poundmaster for the same period were received, read and ordered filed. The Clerk presented the report of the special auditor, A. F. Harrison covering the financial transactions of the City for the period ending .lune 30, 1934. At the order of the Mayor the report was taken under submission for later disposition. Mr. Glenn Nest presented a Deed of Gift from Lewis T. Mason and Clara B. Mason, his wife, to certain lands lying on the Easterly and Northerly boundaries of the lake property, and on motion of Council- man Clark, seconded by Councilman Graffigm, the Clerk was directed to accept the deed in the name of the City and file the same with the County Recorder. At this time Councilman H. -S. Clark presented an offer from Mr. Mason to dispose of the balance of his interests on the South and Next sides of the lake for the sum of $2,000.00. At the direction of the Mayor this offer was laid over to be considered in executive session later In the evening. The Clerk read a petition signed by all the owners of real property facing on South Orange Avenue, asking that the City apply to the Works Progress Administration for a project to install curbs, gutters and street lights along this Avenue, each of the signators agreeing to pay for the materials involved at the rate of forty-six cents per front foot. On motion of Councilman Spooner, seconded -by Councilmea Graffigna, Resolution No. 847 was then.lntroduced. RESOLUTION NO. 847 RESOLVED by the City Council of the City of Lodi, County of San Joaquin, State of California: That G. M. STEELE, Mayor of said City of Lodi,'be, and he is hereby authorized and directed to make application to the Works Progress Administration for approval of the project hereinafter mentioned, and that J. F. BLSKELT, City Clerk of this City be, and he is herein authorized and directed to certify to such papers as may be necessary to.put such project Into operation, said Mayor and said City Clerk to act -as Sponsor's Agent and Fiscal Officer respectively: - The project for which application is herein authorized is -as follows: Installation of concrete curbs and gutters along both sides of South Orange Avenue and the instal lation of a complete street lighting system in- cluding lighting standards, conduit, wires, cables, transformers, etc., along said avenue and inter- section streets. SPOONER Councilman. 337 COUNCIL CHAMBERS - - CITY COUNCIL CIN HALL - - CITY OF LOBI The foregoing Resolution No. 847 was thereupon passed and adopted by the following vote: AYES: Councilmen, Spooner, Graffigna, Clark, Weihe and Steele. NOBS:. Councilmen, None ABSENT: Councilmen, None The Clerk read two applications submitted by Harry 8. Bonne.11 and Associates and the L. S. Timpson & Company for permission to submit an estimate of the costs of auditing the City!s accounts for the fiscal years ending June 30, 1935 and June.30, 1936. No action taken. The Caminol Petroleum Company applied by letter for permission .to install three six hundred and eighty gallon gasoline tanks on the premises at the Northeast corner of Eden Street and Central Avenue; and It appearing that the.taaks could be Installed in accordance with Ordinance the permission was granted on motion of Councilman Spooner, seconded by Councilman Weihe. The Clerk filed a report of the San Joaquin Local Health District giving a bacteriological analysis of the effluent from the Sewage Disposal Plant. A letter was read from the District Engineer of District X advising the City of its apportionment of gasoline tax funds for the fiscal year ending June 30, 1936, and on motion of Councilman Weihe, seconded by Councilman Graffigna, the accumulation of these funds was authorized by the adoption of Resolution No. 848. RESOLUTION NO. 848 RESOLVED by this City Council of the City of Lodi, that the -- annexed project statement for accumulation of gasoline tax funds, be, and the same is hereby approved and that the Mayor and the City Clerk be and they are hereby authorized to execute the same. The foregoing Resolution No. 848 was then passed and adopted by the assenting votes of Councilmen Weihe, Graffigna, Spooner, Clark and Steele. The Clerk reported that Matthew Sherman, one of the truck drivers on the fire truck had stated to him that on account of his (Sherman(s) illness he had employed relief dtiver M. R. Channel since Way 28, 1936 and that -Mr. Sherman expected the City to pay Mr. Channel for this time. After some discussion it .was decided that there being no rule to the contrary, Mr. Sherman should pay Mr. Channel out of his own salary. Ordinance No. 224 entitled "AN ORDINANCE AMENDING ORDINANCE NO. 216 OF THE CITY OF LODI BY ADDING THERETO A SECTION TO BE THEREIN NUMBERED *SECTION 8-e,8 having been regularly introduced at the meeting of May 18th and laid over for the period of not less than five days, was brought up for final passage and on motion of Councilman Welhe, seconded by Councilman Graffigne. second reading of the Ordinance was omitted and the same finally passed and adopted and ordered to print by the following vote: AYES: Councilmen, Weihe, Graffigna, Clark, Spooner and Steele NOES: Councilmen, None ABSENT: Councilmen, None The Mayor thereupon signed the Ordinance in approval thereof. 33i� COUNCIL CHAWERS--CITY COUNCIL CITY HALL - - CITY OF LODI Ordinance No. 225 entitled "AN ORDINANCE REGULATING THE OPENING, CONDUCTING, AND CARRYING ON OF DANCES IN PUBLIC DANCE HALLS AND PUBLIC PLACES IN THE CITY OF LODI, AND PROVIDING FOR TH3 ISSUANCE OF PERMITS FOR THE SA:1E, AND PROVIDING A PENALTY FCR VIOLATION OF ANY OF THE PROVISIONS HEREIN," having been regularly introduced on May 18, 1936 was brought up for final passage and approval and on motion of Councilman Clark, seconded by Council- man Weihe, second reading was dispensed with and the Ordinance was finally passed and adopted and ordered to print by the following vote: AYES: Councilmen, Clark, Welhe, Graffigna, Spooner and Steele NOES: Councilmen, None ABSENT; Councilmen, None The Mayor thereupon signed the Ordinance in approval thereof. City Attorney, Glenn West, addressed the Council in regard to the test of Ordinance No. 220 in the Superior Court at Stockton and suggested that the Ordinance be amended to exempt hospitals. Agreeably to Mr. West's suggestions Ordinance No. 226 entitled "AN ORDINANCE AMENDING ORDINANCE NO. 220 OF THE CITY OF LODI BY MUPTING UNDERTAKING ESTABLISH- MENTS, HOSPITALS, SANITARIUMS AND THE TREATMENT OF SICK PERSONS OR ANIMALS THRREFROM," was introduced, read at lenght by Mr. West and on motion of Councilman Graffigna, seconded by Councilman Weihe and carried, the above Ordinance was laid over for the statutory period of not less than five days. Six building permits Nos. 1480 to 1485 inclusive for structures to cost $19,900.00 were allowed and ordered granted on motion of council- man teihe, seconded by Councilman Graffigna. At 9z45 o'clock P.M. the Council was called into executive session at the order of the Mayor returning to open session at 11:00 o'clock P.M. On motion of Councilman Welhe, seconded by Councilman Clark, Claims Nos. 26397 to 26516 Inclusive in the amount of $12,936.39 were allowed and ordered paid. On motion of Councilman Weihe and carried, the City Council adjourned to the day and hour of its next regular meeting.
