HomeMy WebLinkAboutMinutes - December 2, 193527: COUNCIL CHAMBERS -- CITY COUNCIL CITY HALL -- CITY OF LODI Monday, December 2, 1935 The City Council of the City of Lodi met in regular meeting at 8:00 o'clock P. M. on the date first above written. Councilmen Clark, _ Graffiana, Snooner and Nethe, present. Mayor Steele, absent. On motion of Councilman Weihe, seconded by Councilman Graffigna, Councilman Claris was chosen Mayor Protem and opened the meeting. The minutes of the meeting of November 18, 1935 were reed, and approved as read and so indorsed by the Mayor. A petition signed by several residents in the vicinity of the 500 blx•.c of Flora and Hilborn Streets asking for the abatement of a nuslence to -wit:- the keening of a cow under unsanitary conditions, was ordered referred to the health and police departments by the Mayor. The Clerk presented a letter written by the Bureau of Sanitary Engineering of the State -of California to Dr. John J. Sippy of the San Joaquin Local Health District, in regard to the condition of the effluent from the Plant. Mr. F. T. Boyd of Los Angeles applied by letter for appointment as consulting engineer in the construction of the Proposed Hydro -electric Plant. Application ordered filed. In the matter of tax liens against the lends received in the settlement of the Lawrence Estate, generally known as the Pioneer Part, the Mayor was directed to file,a petition with the Board of Supertisors asking that the said taxes be cancelled. This was done by the adoption of Resolution No. 81'6 by the following vote: AYES: COUNCILM1K, Spooner, Graffigna, Weihe and Clark. NOES: COUNCILMEN, NONE ABSENIT: COUNCIUAN, Steele. RESCY-.17TON 817 RESOLUTION 07!ORIZING ?ETTTION TO THE EOARD OF SUP6RVISORS FOR THE CANCELLATION OF TAXES WHEREAS, this City acquired certain lands in the Lawrence Homestead Addition to Lodi by virtue of a certain annexed decree of distribution, recorded November 7, 1934 in the office of the County Recorder of San Joaculn County, California, said lands being particularly described as foliows:- A tract of L nd situated in the County of San Joaquin, State of California, and being a portion of"Map No. 2, Lawrence Homestead Addition," filed August 10, 1922, In Book of Maps, Vol_ 10, page 59, San Joaquin County Records, and more particularly described as follows, to - wit: Commencinz at an iron DlDe at the intersection of the East line of Stockton Street with the North line of Lawrence Avenue as shown on said flap No. 2 of Lawrence Homestead Addition; thence S 890061 H along the North line of Lawrence Ave., 946.43 ft; thence N 0037' 3 711.82 ft; thence N 890061 B 895.63 ft. to a point In the East line of Stockton Street; thence along the East line of Stockton Street, S 40421 W 713.4 ft. to the point of beginning, and containing 15.05 acres. and, WFE'SAS, the lien for county taxes attached to the same on the first MondRy of March, 1935 in accordance with law said lands were assessed by the County Assessor and the State Board of Equalization under the following description, to -wit: - Lawrence Homestead Addition, Map No. 2. Portion of Lots 21 and 22 and all of Lots 29 and 30. ��UP COUNCIL CHAMBERS. -CITY COUNCIL CITY HALL - - CITY OF LODI at an assessed valuation of 12,440.00 and subsequently to said assessment a tax of 103_13 was levied unon said land by the County Boarc of Supervisors all in time, form and manner as required by statute and the Constitution of this State, and; WF3HEAS, said lands now being oropert_v of this City and not subject to sale for delinquent taxes, and said lands having been incorporated within the City Limits of the City of Lodi on the 29th day of March, 1935 are not now subject to taxes for county purposes; BE IT RESOLVED, that the Mayor of this City be, and he is hereby authorized and directed, to petition the Board of Supervisors (by and with the consent of the District Attorney) to cancel said tax in the amount of 863.19 in -accordance with Section 3804-a of the Political Code of this State. The report of the Poundr.aster for the Month of November and that of the Chief of Police for the same period were received, read and ordered filed. Ordinance No. 215, entitled "AFN ORDIVnNCE RS?i? LING CERTAIV ORDINANCES ;ND ?ARTS OF •1RDINANCES AND ?STSBLISHPTG PATES FOR THE SALE OF ELECTRIC 8111SROY BY THE CITY G? LODI" having been regularly introduced at the regular meeting of November 18, 1935 and thereat laid over for the statutory period of not less than five days was Introduced for passage on motion of Councilman Weihe, seconded by Councilman Graffigna, the said Ordinance was then finally passed, ado?ted and ordered to print by the followin;r vote: - AYES: COtNCILMRN, Welhe, Graffigna, Spooner and Clark NORS. Five building permits for str'.;ctures to cost $3,100.00 were allowed and ordered granted on motion of Councilman Weihe, seconded by Counciln-ten Graffigna. Councilman iieihe of the Street Committee reported that he had met with the committee from the Lodl Business Ments Association- and that they had reached the conclusion that all trucks and loads exceeding 17 ft. In length would be requested to park parallel to the curb in all places in the City were parallel parking is permitted_ On motion of Councilman Weihe, seconded by Councilman Graffigna, the Clerk was authorized to connect rater and light services -at the Community Toy File to be opened at 120 West Fine Street during the Holiday Season. All charges to be cancelled. Mr. C. O. ?Penning, acting City Engineer, addressed the Council In regard to a proposal received from Stuart S. Smith in regard to the rental of the C?tr's Elgin Sweeper. On Motion of Councilman Spooner seconded by Councilman Graffigna, Mr. Henning and the City Clerk were authorized to enter into a rental contract fbr the use of the sweeper and also ascertain If the same could be sold at a reasonable price. Bills in the anount of $5,511.23 as ap?roved by the Finance Co—ittee were ordered paid on motion of Councilman Spooner, 4eihe second. Said bills include claims No. 25103 to 25200 inclusive.
