M. of Monday, November 18,1935. Councilmen Clerk, Graffigna, Spooner, Weihe and Steele present. None absent. The minutes of the regular meeting of November 4, 1935 were read, approved as reed and so indorsed by the Mayor. Mrs. S. S. Murphy and Mrs. May Putman appeared before the Council in rezard to a large sign board erected on West Elm Street near School Street. Mrs. iurphy stated that the sign was large and unsightly and obscured their vision. She was assured by the City Council that the sign would be removed to a reasonable distance from the street. The Clerk reported that he had received the executed agreement recinding the former Loan and Grant Agreement with the United States of America. On motion of Councilman Weihe, seconded by Councilman Spooner It was ordered that this Agreement be recorded in the minutes of this meeting and filed in the offices of the City Clerk. Motion carried. AGREEYSNT dated as of November 5, 1935 terminating the LOAN AND GRANT AGREEMENT dated as of July 17, 1935, between the CITY OF LODI, SAN JJAOUIN COUNTY, CALIFORNIA (herein called the aCity") and the UNITED STATES OF AMERICA (herein called the "Government"). WHEFFAS, a Loan and Grant Agreement was entered into.by and between the City and the Government dated as of July 17, 1935; and WHEREAS, it is to the mutual advantage of the City and the Government to terminate said Loan and Grant Agreement: NOW, THEREFORE, IT IS HEREBY AGREED by and between the City and the Government that the said Loan and Grant Agreement, dated as of July 17, 1935, be and the same hereby is terminated. A letter was received from the local section of the United States Naval Reserves,statiag that they were about to abandon quarters furnished them by the City in the Old City Hall and thanking the Council for Its kindness in furnishing these accommodations. A letter was received from Jack Labes, Chairman of the Holiday Decorating Co=Ittee of the Lodi Business Vents Association, asking that the City cooperate In decorating the downtown streets for the holiday season. On motion of Councilman Spooner, seconded by Councilman Weihe the Electrical and Street Departments were directed to cooperate with the Business lien's Association in arranging the lighting for the decorating. A letter was received from A. 3. Martin, Sacramento, tendering his services in rid&ng the town of stray does. As the matter was well handled by the present poundmaster, the Clerk was directed to tell Mr. Martin that this City was not interested In his proposition_ 272 sa Co y 0 0 COUNCIL CHAMBERS --CITY COUNCIL CITY HALL - -CITY Of LODI It appearing that the contract for the purchase of 11ould chlorine would expire on December 31, 1935: the Clerk was directed to renew this contract with the Great Western Chemical Company for the period of one year. This was done on motion of Councilman Wethe, seconded by Councilman Graffl%na. Eleven Building Permits, being Nos. 1358 to 1369 inclusive, excepting application No. 1363 for structures to cost $15,550.00 were allowed and ordered granted on Motion of Councilman Treihe seconded by Councilman Graffigna. Permit Application No. 1363 was ordered not granted being for a sheet iron structure with wood supporting members located within the fire limits. The Clerk reported that Mr. F. J. De Andrtes of the State Department of Immigration and Housing could not be present as previously arranged and at the order of the Board the Clerk was directed to ask Mr. De Andrels to appear at a meeting to be held Monday, November 25 when discussions could be had relative to the necessity and form of a competent Building Ordinance for this City. On Notion of Councilman Weihe, seconded by Councilman Clark a Resolution No. 815, whereby the City asked the Colorado Power Company to extend the periods in which certain conditions subsequent as contained In the deed dated January 9, 1929 could be performed. RESOLUTION NO. 815 WFEREAS, under the terms of a deed dated January 9, 1929, delivered to and accepted by the City of Lodi in accordance with Resolution Nos. 566 and 557, by which Colorado Power Company conveyed to the City of Lodi certain riparien lands and water rights situate on and along the Mokelumne River in Calaveras and A.mador Counties, California, more particularly described in said deed, the City of Lodi was required to perform certain conditions subsecuent, as a prerequisite to retaining title thereunder; and WHEREAS, by five certain supplementary deeds, the times for the oerformance of said conditions subsecuent have been extended by Colorado Power Company, all as appears by the recorded deeds; and WHAREAS, the City of Lodi, grantee therein, has met and dis- charged the requirements of conditions subsecuent numbered "one" and "'tyro" as is acknowledged In the "Fifth Supplement to Deed" and has fully performed the requirements of condition "Three" of said deed and supplementary deeds by calling and holding an election to vote bonds for the construction of the project works therein, which election was held and conducted on the 12th day of September, 1935 and the said Colorado Power Company was given notice of said election and of the result thereof; and, WHEREAS, the City of Lodi is the recipient of a certain offer of a grant and loan of money from the United States of America that will assist said City in the construction of said project works; and Y9?i_RREAS, the City of Lodi is restrained and enjoined from the selling of the bonds authorized to be issued at the said election of September 12, 1935 and/or from the expenditure of any moneys received from the sale of said bonds or received from any loan and grant from the United States of A=erica by reason of certain law -suits filed by the Pacific Gas & Electric Company against said City and now pending in the Federal and State Courts, so that said City is prevented by force from performing and all of conditions subsequent Nos. "Four", "Five", end "Six" of said deed and deeds supplementary thereto; Trim F"R9 BE IT RESOLVED, that this City Council of the City of Lodi do hereby reouest the said Colorado Power Company to extend the time allowed by said deed of January 9, 1929, as already extended by said five supplementary deeds (particularly by said "Fifth" Supplement to Deed) for an additional period of one year, within which the conditions enumerated In said deed dated January 9, 1929, as conditions numbered "Fourth", "Fifth" and "Sixth" may be performed and complied with by the City of Lodi, grantee thereunder, upon the same understanding by the City of Lodi as set forth In said Resolution Nos. 566 and 567. COUNCIL CHAMBERS - - CITY COUNCIL CITY HALL - - CITY OF LODI BE IT RESILVBD FURTHER, that a certified copy of this Resolution be transmitted by the City Clerk to Colorado Porer Company for its consideration, together with a request that said Company shall, if agreeable thereto, caused to be transmitted to the said City Clerk, a duly executed suoplementary deed on or before December 2, 1935. The foregoing Resolution was then passed and adopted by the following vote. AYES: COUNCILL[EN, Weihe, Clark, Graffigna, Spooner, and Steele NOBS: COUNC IL.NEN, NONE ABSENT: CJUNCILMEN, NONE It appearing that government money could be obtained to assist in maintaining certain necessary works on City Property, and thereby help the unemployment situation, Resolution 816 was introduced on Motion of Councilman Graffigna seconded by Councilman Neihe. RESOLUTION NO. 816 RESOLVED, by the City Council of the City of Lodi, County of San Joaquin, State of California; That the Mayor be and he is hereby authorized and directed to make application to the Works Progress Administration for the following enumerated ?rojects, and thet J. F. BLAXELY, City Clerk of this City be and he is hereby authorized and directed to certify to such papers as may be necessary to put these projects into operation, said Mayor and said City Clerk to act as Sponsor's Agent and Fiscal Officer, respectively. The projects for which application is to be made are as follows: 1. Extension water mains in Lots 70 and 71 Lodi Barnhart Tract, Westerly from Stockton St. 2. Lay concrete sidewalks along curb lines of Meple Square Park. 3. Extensions of Municipal Facilities in newly annexed portion of City west of Avena Ave. (a) Water blains (b) Sewer Lines (c) Storm Drains (d) Electric Service 4. Move Fire Plugs from streets to within curb lines 5. Comolete storm sewer on S. Stockton and connecting streets. 6. Lake Park. (a) Replace and repair damaged rip - rap work to prevent bank erosion. (b) Topographical Survey and mapping of all Lake Park Lands. (e) Life savers at Lake Park during bathing season. (d) Boat painting and repair Lake Park. 7. Remove and care for trees and palms various locations on streets in City. 8. Reaair pavement on two (2) blocks on West Pine St. 9. Continuation of present preliminary surveys and building roads and trails at Power Plant Site The foregoing Resolution No. 816 was thereupon passed and adopted by the following vote: AYES: COUNCILMRN, Graffigna, Welhe, Clark, Spooner and Steele NOES: COUNCILMEN, NONE ABSTPIT: COUNCILMEN, NONE. 274 COUNCIL CHAMBERS -- CITY COUNCIL CITY HALL - - CITY Of LODI Claims No. 25033 to No. 25102 inclusive, in the amount of $3,593.95 were allowed and ordered paid on notion of Councilman Spooner seconded by Councilman Weihe. Ordinance No. 215, an ordinance entitled n3N ORDIKkNCE REPEALING CERTaIN ORDINIPNCES AND ?ARTS OF ORDINIIICES AND 3STA5LISHING FATES FOR THE SALE OF ELECTRIC ENERGY BY THE CITY OF LODI, was introduced on Motion L of Councilman Neihe, seconded by Councilman Graffigna and read by the Clerk and by the same motion this Ordinance was laid over for the statutory period of not less than five days.
