Monday, September 30,1935
Pursuant to the adjournment taken from the adjourned regular meet-
ing of September 23, 1935, the City Council of the City of Lodi met at
8:00 o'clock P.M. of Monday, September 30, 1935. Mayor G.M.Steele
called the meeting to order and the Clerk called the roll:
Present: Councilmen, Clark, Graffigna, Spooner, Weihe and Steele.
Absent: Councilmen, None.
The Clerk presented an affidavit of publication executed by the
printer and publisher of "The Lodi News -Sentinel" in proof of the pub-
lication of "Notice of Sale of Bonds" on September 24, 1935. The affidavit
was ordered filed.
Resolution No. 806 "Resolution Confirming Notice of Sale of City of
Lodi's 1935 Electric Bonds" was introduced on motion of Councilman
Graffigna, seconded by Councilman Weihe and read at length by the Clerk.
RESOLUTION NO. 806.
RESCLUTION CONFIRMING NOTICE OF SALE OF CITY
OF LODI'S 1935 ELECTRIC BONDS
BE IT RESOLVED by the City Council of the City of Lodi, as follows:
The action of the City Clerk, performed on September 24,1935, in
publishing and mailing notice of sale of City of Lodi's 1935 Electric
Bonds, all dated October 1st, 1935, aggregating in principal amount
Four Hundred Sixty-six Thousand ($466,000.00) Dollars, and the form of
such notice, performed, mailed and given on September 24, 1935 as afore-
said, as presented to this City Council, be and the same are hereby
approved and confirmed.
The foregoing Resolution No.806 was then passed and adopted by the
following vote: -
AYES: Councilmen, Gra_'figaa,. Weihe, Clark, Spooner and Steels.
NOES: Councilmen, None.
ABSENT: Councilmen, None.
The Mayor then announced that, inasmuch as the City Council had been
served with temporary restraining orders from the Superior Court of San .
Joaquin County and from the U.S.District Court, Northern Division, wherein
the Council was enjoined from selling the 1935 Electric Bonds, the sale
of these bonds, scheduled to be made at this meeting would be postponed
to and until Wednesday, October 2, 1935 at the hour of 8:00 o'clock P.M.
Prospective bidders on the bonds present at the hour of 8:00 o'clock
P.M. were, Mr Lloyd Mazzera and Mr H.F.Osbourne of Bank of America, Mr
d.C.Tyler of R.H.Moulton and Company, Mr Philip T.Daube of Anglo -Calif-
ornia National Bank. The Clerk reported that he had notified several
prospective bidders of the restraining order and pending suit, notably
Donnellan & Company and that they had decided to withold submitting
proposals.
Mr E.L.Weaver addressed the Council in regard to bids on concrete
pipe for the newly annexed portion of Hutchins Homestead Addition,
stating that he represented J.W.Mumbert Concrete Pipe Company, who
desired an opportunity to submit a proposal. Be was informed that
this project was some months away and that ample opportunity would be
given Mr Mumbert to make a quotation.
No further business appearing, the City Council adjourned to and
until 8:CO o'clock P.M. of Wednesday, October 2, 1935 on motion of
Councilman Spooner, seconded by Councilmen Graffigaa and carried.
