HomeMy WebLinkAboutMinutes - April 15, 1935185; COUNCIL CHAMBERS --CITY COUNCIL CITY HALL - - CITY Of LODI Monday -April 15, 1935 City Council of the City of Lodi met at 8:00 o'clock P.M. on the date first above written, Clam, Spooner, Weihe and Mayor Steele present, Council=an Beagle absent. The minutes of the last regular meeting held April 1st and of the I Intervening special meeting held April Sth.,1935 were read, approved as read and so endorsed by the Mayor. City Engineer Clinton 0. Henning asked that the Council fix some standard of policy in regard to the removal of earth from private property, stating that some of the trucking companies were objecting to the City hauling this material as interfering with their business. After some discussion, this matter was left in the hands of the Street Superintendentto make such arrangements as each case might warrant. The City Clerk reported that the proceedings initiated under Resol- ution No. 755 passed and adopted February 18, 1935 a^ -d recordec at Page 175, Vol. 5 of these minutes, had been completed and that the fifteen acre tract, generally known as "Pioneer Park" in Lawrence aomestead Addition was now part of the City. On motion of Councilman Clark, 'elhe second, the City Clerk was directed to spread a copy of the Resolution of the Board of Supervisors of San Joaquin County approving this arsexatlon together with the certificate of the Sec- retary of State of the State of California showing its recordation in his office, in full in the minutes. ( See page 189 at sec of these minutes) A.n, easement for a sewer line crossing under the Southern Pacific main line right -of easy at or near the crossing of the rfesterly extension of the center line of Poplar Street with said right-of-way, was receiv- ed and ordered accepted. Comm nications from Store f Youngberger and from the New York City Chamber of Co=erce, the one relating to assessment bond problems and the other to Federal encroachment of private ownership were ordered filed without action. A claim for tax refund in the amount of $99.67 filed by "Tax Research Inc" for and on behalf of T l D Enterprises,Ine. was received. On representation of the City Clerk that the purported statements of fact therein were untrue, the claim was rejected and ordered referred to the City Attorney. A letter complimenting the City on its accident prevention record In tae year 1933-34 and transmitting a refund of $526.58 was received from the State Compensation Insurance Fund; also a letter from the same, denying responsibility in the case of Leonard A. Kolb, a volun- teer Firemen, Iniwed while responding to a fire alarm. Reports of the City Clerk and of the City Treasurer for the Quarter ended March 31, 1935 were received, read and ordered filed. On arplication of the Chief of the Fire Department, and on motion of Councilman Spooner, Clark second, the Fire Chief was authorized to have the chemical tanks removed from both Seagrave engines and replace them with water tanks to be installed by P.E.Vaq Pelt of Oakdale, Calif. at a cost of $349.00. Legislative bulletins from the League of California Municipalities and from California Municipal Utilities .association were read and discussed. Bills in the =oust of $5,100.16 as a:proved by the Finance Com- mittee were allowed and ordered paid on motion of Councilman Spooner, Clark second. (Addenda to 4(lautes of April 15,1935) 18� (Recital, of Res,)l+ltion .nnex1r3 Territory) COUNCIL CHAMBERS -- CITY COUNCIL CITY HALL -- CITY OF LODI At the order of the Ci*y Co+;nail, e City Clerk was directed to spread a copy of the followlnS Resolution- and tts annexed certificates in full u^.on the min- utes of the -egular of one City Council held April 15, 1935. - RESOLUTION - .IHEREAS, pursuant to resolution. duly and regularly passed and adopted by the City Council of the City of Lodi, San Joaquin County, California, the said City Council, for and on behalf of said City, heretofore filed with tae Board of Supervlsors of the County of San Joaquin, State of California, a ''Petition to Altar Boundaries of the City of Lodi by Annexing to said City New Contiguous Territory Owned by said City", reference to ,ar_ich is hereby made for further particulars; and WHE'EAS, the said 3cerc of Supervisors, u -)on receipt of said petition and notif- ication thereof, caused notice to be published in a ne:,soaper of general circ- ulation, to -wit, in THE LODI NEWS, a net,spaper of general circulation printed and published in the City of Lodi, -cunty of San Joaquin, State of California, for a period of more than five consecutive days, said newspaper being a daily newspaper, settin-g forth by general description the land sought to be annexed to said municipality, to -wit, the land hereinafter described, and announcing the time and place where objections to said annexation would be heard, such time and place being Mondajr, the 25th day of March,1935 at ten o1clock in the forenoon of s�:Ad day, and the chambers of the said Board of Supervisors in the Court douse at Stockton, California; and rMSnS, said notice has been published and given in the manner prescribed by law,proof of the giving and publication of said notice being duly and regularly made to the Board of Supervisors, which hereby finds that said notice has been duly and regularly given and published; and 7MMEAS, no objection or protestation to or against said petition or to or against the annexation of said territory to said City has been made, given or filed tefore, with or to the said Board of Supervisors; Tin. said Board of Supervisors thereupon, at the time and plaae specified in said notice of the filing of said petition, voted upon the question of the annexation of said territory to said municipality, to -wit, to :aid City of Lodi, and thereupon the said Board of Supervisors and each and every member of said Board of Supervisors voted in favor of said petition and of the annexation of said territory to said City of Lodi and this resolution was thereupon duly and regularly passed and adopted by the unanimous vote of said Board of Supervisors; AND, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of the County of San Joaquin, State of California, pursuant to said petition and pursuant to said notice and proceedings aforesaid, and in accordance with the Act of the Legis- lature of the State of California approved by the Governor on June 13tb,1933 Statutes and Amendments to the Codes of California for the year 1933, com- mencing at page 2395 thereof, that the hereinafter described real property, which Is owned by said City of Lodi, which is uninhabited, be and the same is hereby annexed to and made a part of said City of Lodi, and that the boundaries of said City be changed accordingly and that the territory which is so annexed to said City is owned by said City, and is bounded and described as follows, to -wit: I tract of land situated in the County of San Joaquin, State of California and being a portion of gap No. 2 of Lawrence Homestead Addition, filed rust 10,1922, commencing at an Iron pipe at the intersection of the Bast line of Stockton Street with the North line of Lawrence Avenue as said street and Avenue are delineated and so designated on said Map No. 2 of Lawrence Homestead Addition, thence south 89 degrees, 06 minutes east along the north lire of Lawrence Avenue 946.43 feet; thence North 0 degrees 37 minutes east 711.82 feet; thence North 39 degrees 06 minutes Nest 895.63 feet to the East line of Stockton Street; thence along the said East line of Stockton Street, South 4 degrees, 42 minutes west 713.4 feet to the point of beginning of the tract of land herein described, containing 15.05 acres, more or less. BE IT FURTHER RESOLVED, by said Board of Supervisors, that the Clerk of said Board of Supervisors, or other officer performing the duties of Clerk of said Board of Supervisors, shall make and certify and transmit to the Secretary of State or the State of California and to the legislative body of said City of Lodi and to each th=reof, a certified copy of this resolution approving the said annexation, together with the date of this resolutlon and that this resolution ba entered :.ton the minutes of the said Board of Supervisors and filed 71th Clem of said ?oa*d; 190 COUNCIL CHAMBERS - - CITY COUNCIL CITY HALL -- CITY Of LODI 3 IT FLR^?aR REESOLVED, that said Board of Supervisors hereby finds that no part of said territory so annexed to said City of Lodi now forms or ever `formed any part of any Incorporated city or town, except that, by this resolution the said annexed territory shall form a part of said City of Lodi. - - - - - - - 0 - - - - - - - The foregoing Resolution was regularly and duly passed by the Board of Supervisors of the County of San Joaquin, State of California at a regular meeting of said Board of Supervisors duly and regularly held at and in the chacbers of said Board of Supervisors in the Court House at Stockton, San Joaquin County, California, on 'Monday the 25th day of larch 1935 at *-e ho,.:r of ten o'clock in the forenoon of said day by the following vote: AYES: Supervisors, French, Rlmin-ton, Stuckenbruck, RuGgles and Steiaegul. +TORS: Supervisors, None, ABSENT: Supervisors, :tone.
