Monday,March 13,1935
:his regular meeting of the City Council of the City of Lodi was called to
order by the Mayor at 8:00 o'clock P.Y. on the date first above written, Council-
men Clark, Spooner, *Nelhe and Mayor Steele present, Councilman %eagle absent.
=he minutes of the meeting of March 4, 1935 were read, approved as read and
so endorsed by the Mayor.
Mr John A. !Cramer protested against the City's trucks removing earth which
he claimed to be under contract to himself; It appearing that the matter laid
between Yr Kramer and the building contractor; he was informed that the City
could do nothing In the matter.
City Attorney Glenn West filed a letter received by him from Seth E. Howard,
the adjutsnj: General of the California National Guard stating that the State
would enter into a lease for not to exceed five years on the proposed State
Armory Building to be erected with S.S.R.A. assistance under certain restrict-
ions stated in the letter.
The Clerk submitted a letter from the Board of Fire Underwriters of the
Pacific transmitting a copy of "Suggested Fire Prevention Ordinance" amd also
stating that the Board had no copies of ordinances regulating the storage of
gasoline tank trucks in garages. He was directed to submit the copy of the
"Suggested Fire Prevebtion Ordinance" to the Chief of the Fire Department for
consideration.
It aipearing from a letter from C:_:lifornia Municipal Utilities Association
that S.B. No. 78 Introduced by Senators Garrison and Jesperson merited favorable
consideration by cities owning their public utilities, the following Resolution
Was introduced, passed and adopted: -
Resolution No. 760
HERBAS, according to our information and belief, a number of bills, author-
izing the issuance and sale of revenue bonds for certain kinds of public Improve-
ments, have been sent out from Washington and introduced in the California Legis-
lature in response to susgestlons from President Roosevelt;
AND, WHEREAS, it is our opinion that the enactment of such measures are
deslreable, for the financing of revenue-producing improvements under the National
Industrial Recovery Act, and for the speeding up of the return of prosperity;
NOW, THEREFORE, BE IT RESOLVED, that Governor Frank F. Merriam and Senator
Bradford S. Crittenden and Assemblyman James 3. Thorp be, and they are hereby
requested to do everything in theffr power to secure the enactment of such bills
Into law, particularly Senate Bill No. 78, introduced by Senators Garrison and
Jesperson, and its compantion measure now before the Assembly;.
RESOLVED, FURTHER, that the City Clerk be, and he is hereby directed to
forward certified copies of this resolution to the Governor and to the Senator
and Assemblyman from this district.
The foregoing resolution adopted by the assenting votes of all Councilmen
present.
A letter from R.F.Pierce, District Engineer of this Division of the Depart-
ment of State Highways was read; this letter sets forth the proceedure necessary
in submipting projects for the expenditure of the City's portion of gasoline
tax moneys. Letter and accompanying memoranda ordered filed with the Clerk.
A copy of a digest of to bills now pending 1n the State Legislature
affecting municipalities was received from Louis Burks, Legal Counsel of the
League of California Municipalities.
The Mayor presented a letter from Mr Joseph Losekann agreeing to proceed
as architect on the proposed armory building under the following conditions:
(1) That he would furnish all preliminary plans and specifications and
estimates to the Emergency Relief Administration without cost to the City.
(2) In the event of the actual conttruction of the building by the City
that his fee be a% of the cost of labor and materials but not to exceed $1,200
for all working drawings, specifications and blueprints required, such fee to
be due and payable on completion of said plans,speelfications and blueprints;
(3� Providing work is abandoned after ordering same, the fee shall be in
porportlon to the amount of work completed and sets forth a charge of $15.00

for each eight hour day required by the architect to superintend construct-
ion of the building if such superintendence be required.
On motion of Councilman Spooner, '''fieihe second and carried unanimously,
Ur Losekann's proposal was ordered accepted, providing that the project was
approved by the Emergency Relief Administration and that the City proceeded
to actually construct the building.
The following resolution was then adopted: -
RESOLUTION NO. 761
RESOLUTION COMITTING THE CITY OF LODI TO THE PURCHASE OF
MATERIALS NECESSARY FOR THE EP.RCTION OF A PUBLIC BUILDING.
WMEAS, this City Council of the City or Lodi, County of San Joaquln,State
of California has heretofore authorized application to be made to the State
Emergency Relief Administration for the construction of a permanent public
building to be located on lands of this City facing Lawrence Park, by the
adoption of its Resolution No. 759 on March 4th.,1935, reference to welch
resolution is here made for further particulars,
AND, WHEREAS, since the adoption of said Resolution No. 759 this City Council
has employed LTR JOSEPH IZSRKANN of Stockton, California as architect of the
:cork;
AND, R?n REAS, the said kr Joseph Losekann has prepared and has this evening
submitted tentative and preliminary plans and specifications for the const-
ruction of said building, which this City Council deems to be appropriate
and sufficient for the construction of said building, ar, at least sufficient
for the submission of a complete application to the emergency Relief Admin-
istration;
NOW, THEREFORE, BE IT RESOLVED, that this City Council determines that said
building shall be erected and that sufficient funds are available for the
purchase of the materials therefore and that said materials shall and will
be purchased and proper supervision furnished at the times that the same may
oe required before and during the construction of said building, it being the
firm Intention of this City Council that this building shall be erected,
providing the application first mentioned herein is approved by the Emergency
Relief Administration.
The foregoing resolution was passed and adopted by the following vote.

NOES: None. ABSENT: Councilman, Keagle.
No action was taken on Ordinance No. 209 introduced March 4, 1935 as It
was desired that its sponsors fully understand its import.
Seventeen Building Permits for structures to cost $49,760.00 were order-
ed granted.
The sale of an anvil and vise stored at the Lancha Plana dam -site was
-approved, the price to be $25.00, purchaseor, H.G.Kreth. -
Councilman Weihe reported that the fence surrounding the baseball diamond
at Lawrence Park had been completed, lumber and nails costing $207.13 and
labor $60.00. Labor had been paid as an advance on 10% gate receipts by the
Roma winery Club. Lumber bill is due Lodi Lumber CompwW who are to be paid
from the 10% collections on gross admissions, providing, that if any belane e
remains unpaid at the end of this season, the City of Lodi shall be obligated
to pay the same.
If signs are to be painted on this fence, the charge will be at 50te per
running foot for priviledge to use the space only.
On motion of Councilmen: Spooner, Weihe second, bills in the amount of
$5,375.76 as approved by the Finance Committee were allowed and ordered paid.
