Monday, December 3, 1934
Pursuant to oral instruction from the. Mayor and City Council,
I appeared at the Council Chambers of the City Council at the
hour of 8:00 o'clock P.M. on the date above written and finding
no one in attendance, I adjourned and set over the regular meet-
ing of said City Council due to be held at that place and time,
to and until 8:00 o'clock F.M. of Tuesday, December 4, 1934 by
oral proclamation and the entry of this item in the minutes of

Tuesday, December 4th., 1934
Pursuant to the adjournment had as above set forth, the City
Council of the City of Lodi met at 8:00 o'clock P.M. on -the above
written date, Councilmen Clark, Keagle, Weihe and Steele present,
Councilman Spooner absent.
The minutes of the last regular meeting held November 19th
were read, approved as read and so endorsed by the Mayor.
No persons appearing at this time, the order of. Public Hearings
was passed and the Council proceeded to hear Reports and Communic-
ations:
C.S:.Jackson, Chief of Police filed his report for the month
of November, and the same was accepted and ordered filed, likewise
the report of Forrest E. Cooper, City Poundmaster for November
was read and ordered filed.
A letter from Jens C. Pederson, Architect of Sacramento, in
regard to an armory building was ordered filed without comment.
Mr Robert M. Searle of counsel for the City in the East Bay
Municipal Utility District suits advised the Council by letter that
the reading of water depths in a series of wells should be con-
tinued. The Clerk reported that Mr Clinton 0. Henning has estim-
ated that the readings could be made at an annual cost of not to
exceed $350.00 plus about $150.00 for tabulation of results.
On motion of Councilmen Kengle, Weihe second, Mr C.O.Henning
was directed to make the desired readings, provided it could be
done within the estimated cost.
The Clerk read a letter from Mr.Glenn West, City Attorney,
who was unavoidably absent on account of a previous engagement,
transmitting a form of agreement presented by Activeted Sludge,Inc.
for the settlement of the pending suit of that company against
the City for infringement of patent rights. Mr West strongly
recommended the acceptance of the offer and execution of the
contract for license to use the process and apparatus.
On motion of Councilman Clark, Weihe second, the following
resolution was introduced:
RESOLUTION NO. 736
WHEREAS, ACTIVATED SLUDGE,INC., has filed suit against the
City of Lodi, California, for the infringement of Letters Patent
owned by said compeny, relating to process and apparatus for the
disposal of sewage; and
7'HEREAS, ACTIVATED SLUDGE, INC., has offered to settle said
suit and grant a license to the City of Lodi, California, relating
to both past and future use of the process and apparatus claimed
in said patents, upon payment to ACTIVATED SLUDGE, INC. of $2036.40,
upon the execution of said license; and

WHEREAS, the City Council of the City of Lodi, California,
is of the opinion that the proposition offered by ACTIVATED
SLUDGE,INC. is fair and reasonable, and should be accepted
rather than incur the expense of defending the present suit;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Lodi,Californis, that the City enter into said agreement
with ACTIVATED SLUDGE,INC. to obtain said license upon payment
of the said sum of $2036.40, and that the proper officers of
said City are hereby authorized to execute said agreement.
The foregoing Resolution No. 736 was then passed and adopted
by the following vote: -
AYES: Councilmen,Weihe,Keagle,Clark and Steele(Mayor)
NOES: Councilmen,None.
ABSENT: Councilmen, Spooner.
At this time L.H.Rina appeared before the Council and asked
to be heard in the matter of a notice of lien filed by the City
Clerk against any moneys received from the sale of Lot 18, Block
6 of the Lodi Barnhart Tract for water and electric bills Incur-
red by Wilhelmina Seibel, owner of record. Mr Rinn stated that
the transection was in lieu of foreclosure and that the holder
of the deed of trust was taking e. heavy loss in the matter.
The Council agreed that the City woald take a loss on the bills
porportionate to that incurred by the trustor.
The Clerk presented the surety bond of C.S.Jackson as Chief`
of Police in the penal sum of $2,000 with Royal Indemnity Company
as guarantor. On motion of Councilman Clark, 'Reihe second, the
bond was ordered approved and the Mayor so endorsed the same.
Four building permits for structures to cost $2,175.00
were ordered granted.
ORDINANCE NO. 208 " AN ORDINANCE PROHIBITING ELECTRICAL
INTERFERENCE frITH RADIO RECEPTION, AND PROVIDING FOR PUNISHMENT
FOR THE VIOLATION THEREOF " was introduced on motion of Council-
man Clark, Kengle second, read at length and ordered laid over
for not less than five days.
The Clerk read a communication from Vincent S. Brown,.Chief;
of the State Division of Immigration and Housing recommending
the appointment of a building inspector and the adoption of
standard codes for building, plumbing and electrical inspection.
This was referred to the Committee on Public Health and Safety
at the direction of the Mayor.
The Clerk stated that Mrs W.P.Boden wanted $150.00 for the
land necessary to open the alley between Church and School Sts.
as asked for by Sherwood Acker and J.L.Pickering. It appear-
ing that six property owners would benefit and that the alley
could not be opened south of the Brier Subdivision, it was
thought to be a local matter that should be cared for by the
parties interested.
Also, in the matter of opening Maple Street easterly from
Garfield Street, the Clerk was directed to obtain definite
statements as to the attitude of parties owning the lands nec-
essary to be taken.
C.H.Brown, an accountant of Oakland, submitted a proposal
for the audit of the City accounts; referred to Committee of
the Whole.
On motion of Councilman W eche, Feagle second, the Special
Lake Park Committee was authorized to have a levee thrown up and
concrete water passes installen at the Northeast end of the Lake.
On the recommendation of Superintendent of Public Utilities,
John A. Henning, the Clerk was directed to advertise for bids
for the furnishing of a pump and motor to replace that now
used in the Lodi Barnhart Tract. Specifications prepared by
Mr Henning were ordered approved.

Claims in the amount of #11,:227.54 as approved by the
Finance Committee were allowed and ordered paid on motion of
Councilman Weihe, Clark second.
The Clerk asked for information as to the proper defin-
ation of a "three-room dwelling° contained in an order of
the Council that additional dwellings of three rooms or less
be charged 509� for water. He was directed to charge this
rate on dwellings of two rooms and bath, i.e, the bath room
to be counted as a room.
No further business appearing, the Council adjourned at
the direction of the Mayor, none dissenting.
