Councilmen Clark, i:earle, Weihe and Steele (Mayor) present. Councilman Spooner absent, being reported as out of the City. On motion of. Councilman !(eine, Clark. second, Ordinance Iio. 202 was introduced and read at length:- • ORDI1:VIX3 NO. 202. n ordinance calling a special election in the City of Lodi for the purpose of submitting to the electors of said City the proposition of incurring a bonded indebt- edness of said City in the principal emount of y520,000 for the acquisition, construction and completion of the following municipal improvement, to wit: A hydro- electric generation system, including lands, rights of way, easements, dam, penstock, power plant and building, transmission lines, conduits, wires, poles, sub -stations, transformers, dynamos, motors, switches, machinery, apparatus, fixtures, equipment and Other structures, works, rights and properties, necessary or convenient to generate electricity to supply said city and its inhabitants with electricity for light, heat and power, provided that said bonded in- debtedness shall not 1.)e incurred or created unless a grant of moneys in aid of such improvement, satisfactory to the City Council, is made by the United States of America or any agency of the United States ,oernment; declaring the estimated cost of said municipal improvement, the amount of principal of said indebtedness to be incurred therefor, and the maximum rate of interest to be paid thereon; fixing the date of said election, the manner of holding the same, establishing election precincts and polling places for said election and appointing boards of election therefor, and providing for notice thereof. WE3REAS the City Council of tie City of Lodi by resolu- tion passed and adopted at a regular meeting of said City Council on the 19th day of Larch, 1934, by affirmative vote of more than two-thirds of all of its members, did determine that the public interest and necessity demand the acquisition, construction and completion of the municipal improvement here- inafter mentioned, and did further determine the cost of said proposed municipal improvement will be too great to be paid out of the ordinary annual income and revenue of said mun- icipality, which resolution was duly entered on the minutes of said meeting of said City Council, and is now on file and of record in the Clerk's office of said City; and WHERSAS,t'r_is City Council is authorized to expend the funds of said City for the purpose aforesaid, bat no such funds are now available and it is necessary that the City of Lodi incur and create a bonded indebtedness for said purpose; provided that said bonded indebtedness shall not be in- curred or created unless a grant of moneys in aid of such improvement, satisfactory to the City Council, is made by the United States of America, or any agency of the United States government, 97 (Continuation of minutes of ::arch 20, 1934 and of recital of Ordinance fo. 202) COUNCIL CHAMBERS --CITY COUNCIL CITY HALL -- CITY OF LODI ^-1 CIT -2l COU:iCIL 02 THE CITY 0' LODI DO ORDAII,' AS '0LL0'r,3: Section 1. That a special municipal election be and is 'hereby ordered and will be held in said City of Lodi on Londay, the 23rd day of April, 1934, at which election shall be submitted to the aualified electors of said City t}e proposition of incurrin;C indebtedness of .said Cit,; in the principal sum of ;;250,000 for the object and purpose of acquiring, constructing and completing a mur-icipal im- provement of the City of Lodi,to crit, n hydro -electric generation system, includiniz lands, rights of tray, ease- ments, dam, penstock, power plant and building, transmission lines, conduits, wires, poles, substations, transformers, dynamos, motors, switches, machinery, apparatus, fixtures, equipment and other str LL , -tures, works, ri7^ts and properties, necessary or convenient to sererate-electricity to supply said City and its inhabitants with electricity for light, 'neat and power; provided that said bonded indebtedness shall not be incurred or created unless a Prant of moneys in aid of such impro.rement, satisfactory to the City Council, is made by the United States of-merica or any agency of the United States 3overnment. That the estimated cost of said proposed municipal improvement is the sum of nr250,000 and the amount of the principal of said indebtedness proposed to be incurred for said municipal improvement is the zu-n of •520,000. Section 2. That the said City Council proposes to issue and sell ond's o' said Cit; of Lodi in the said amount of Va520,000 for the object and purpose specified in the said proposition set fort'?. in Section 1 of this ordinance, if tv.o-thirds of the qualified electors voting at said special election shall vote in fa: -or of said proposition. Said 'bonds spall be negotiable in form and of the character known as serial, and shall bear interest at a rate rot exceeding fire (5) per cent per annul, payable semiannually. Section 3. That the said City Council does hereby submit to the qualified electors of said City of Lodi at said special municipal election the Said proposition set forth in section 1 of this ordinance, and designates and refers to said proposition in the form of ballot hereinafter prescribed for use at said election. Section 4. That the polls at the pollinz places hereinafter designated shall be opened at six 'o'clooi: A.L!, of said day of election and shall be kept open continuously there- after until seven o'clock P.',. of said day of election, when the polls shall be closed (except as provided in Section 1164 of the Political Code), and the election officers shall there- upon proceed to can -ass the ballots cast thereat. Section 5. That said special election shall be held and conducted, and the votes t' erect canvassed, and the returns thereof made, and the result thereof ascertained and determined as herein provided; and in all particulars not prescribed by this ordinance said election shall be held as provided by la-. for the olding of municipal elections in said City. No other notice of the election hereby called need be given.
