Tuesday, January 2,1934
The City Council of the City of Lodi met in regular
session at 8 o'clock P.14. on the date first above written,
Councilmen Clark, Keagle, Spooner, Weihe and Steele present.
hone absent.
The minutes of the last meeting held December 18,1933
were read, approved as read and so endorsed by the Mayor.
1:o persons appearing, the order of Public Hearings
was passed and the Council proceeded to hear communications
and reports as follows :-
1. A letter from League of California Municipalities
stating that the Western States of California, Nevada, Utah
and Arizona had the opportunity of being used as a demon-
stration for regional and local planning under a Federal
grant of $250,000 and asking that a letter be written to
the Federal Planning Authority asking that this sum be
allotted to these states. On motion of Councilman Spooner,
Keagle second, the,Clerk was so instructed.
2. A certified copy of the award made by the State
Industrial Accident Commission in the matter of the death
of Jacob Banek. Ordered to the files.
. 3. The Report of the Chief of Police for the month of
December, 1933. Ordered received and filed.
4. The Report of the City Poundmaster for the month of
December, 1933, likewise ordered received and filed.
5. The Report of the Secretary of Lodi Volunteer hire
Department for the quarter ended December 31, 1933, which
r:as also ordered received and filed.
No reports of standing or special committees.
It appearing on the statement of the City Clerk that the
annual purchase agreement for the purchase of watt-hour
meters had expited December 31st, and that the Superintendeit
of Public Utilities recommended that the same be renewed,
the rurchase of such meters from DUNCAN ELECTRIC COMPANY for
the calendar year 1934 was ordered on motion of Councilman
Clark, Weihe second, and the Mayor thereupon executed the
agreement in triplicate.
Five building permits for structures to cost $1,100.00
were ordered granted.
In the matter of the application of the City for a loan
and grant from the Federal Government for the construction of
an hydro -electric power plant, it appearing that the adoption
of the Central Valley ;rater Project by the people of this
state at the last election would materially reduce "stand-by"
charges figured in the cost of operation of tee proposed
city plant, Resolution No. 699 was adopted on motion of
C-,uncilman leihe, Keagle second, the same being passed by
the following vote :-

"HER the City Attorney of the City of Lodi was auth-
orized by Resolution No. 696 at a regular meeting held Rovem-
ber E0, 1933 of the City Council of the City of Lodi to file
with the Federal rnergency Administration of Public V.orks, an
application for a grant and loan for the construction of a
hydro -electric power plant, and
�ER?FAS, the City Council of the City of Lodi theretofore
and on lyorember 6, 1933, .adopted Res.Dlution No. 694 as follows:

'ILR,�".EREAS, the State Viater Plan Project or Central
Valley Vater. Project which was passed by the last
Legislature to be financed by the Federal Govern-
ment has been held up by referendum and the Govern-
or of the State of California has called a special
election on December 19, 1933, to have the plan
approved or disapproved by the people, and
WHEREAS, this Council believes that the consummat-
ion of this plan will be for the best interest of
the people of the State Of California;
NOW, THEREFORE, BE IT RESOLVED, that this City
Council of the City of Lodi does hereby approve
and endorse the said State Water Plan and urges
the voters to give it their full support"
AND, WHEREAS, subsequent to the filing of the said Applic-
ation with the said Federal Aeministrator, the said referendum
election pertaining to the Central Valley Water Project was
favorably passed at a general election held on December 19th.,
1933, and,
.WHEREAS, the City of Lodi proposes the construction of a
hydro -electric power plant on the Yokelumne River, capable of
the,generation of approximately 18,000,000 kilo -watt-hours
per annum, to supply the electrical demand of its 21unicipal
Distribution System, together with that of the contigous
rural area, abd,
WAvR—T?AS, the advisory board of engineers employed by this
Council to investigate the proposed S:okelumnne River power plant
report that it will be necessary to supplement the output of
the above mentioned power plant during periods of low stream
flow and accidental break down, with power from an independent
source, the purchase of which power has been contemplated under
the present "P-6" schedule of the Pacific Gas and Electric
Company, and at a cost approximating three times the cost of
Central Valley Project power delivered at Antioch, some thirty
miles distant from the Lodi area, and,
WHEREAS, it would be necessary to transmit such power
from Antioch to the Lodi area by means of the construction of
the necessary facilities, the cost of which have been assumed
would be paid through the issuance and sale of bonds, and,
WHEREAS, for the duration of such transmission line cost
bonds, exclusive of bond principal redemptions, the Lodi area
saving to be made by seeurinf standby and supplimental power
from the Central Valley Project of California, as against the
securing of such power from the Pacific Gas and Electric Com-
-pany would be approximately 20%, whereas the saving would
be 40� subsequent to the bond redemption period, and,
XHZREAS, a line connection with the Central Valley Project
would not only afford standby and surplimental power at a cost
to the Lodi area materially below that of Pacific Gas and
Electric Company, but would in addition afford a profitable
outlet for surplus power that could be produced at the Lodi
biekelumne River Project. which power potentialities may be
wasted unless so disposed of, there being no other available
network except that controlled by the Pacific Gas and Electric
dompany, and,
WHi2EAS, the combined saving in cost to.the City of Lodi
and the contiguous rural area of securing all required electrical
energy from:
First: The Central Valley Project as against the Pacific
Gas & Electric Company would be 40% plus, and
Second: The proposed Lodi 16kelumne River Project as
against the Pacific Gas & Electric Company would
be 60% plus, and
Third: The said Lodi Project as against the Central Valley
Project would be 30%, plus ;
NOW., TLEREFORE, BE IT RESOLVED, that the Administrator,
Federal Emergency Administration of Public Works be and he is
hereby requested to take cognizance of the following facts;
viz:-

First: That the City Council of the City of Lodi did,
at its regular session held September 5,1933,
adopt its Resolution No. 687 wherein this
Council declared its intention to file with
the State Advisory Board of the Federal Zmerg-
ency Administration of Public Works. a detailed
arplication jn accordance with the requirements
of Circular Pio. 2, and in the said Resolution,
requested that the same be recorded by the
PuUlic 'horks Administrator and be considered
and given preference as to the date of its
filing, pending the filing of the detailed
application as aforesaid, acid,
SECOND: That there is no conflict of purpose or economic
duplication as between the proposed "Central
Valley Project of California" and the "Mokelumne
River Power Development of the City of.Lodi", and,
THIRD: That the construction of the said Central Valley
Project will be of material benefit to the said
City of Lodi power project, and,
FOURTH: That the s) -id City of Lodi Project is, because
of the unusal conditions attaching thereto, and
in the area proposed to be served, pecularialy
economie,of Construction and operation, and,
FIFTH: That the Lodi area, because of its intensive
soil development and population density is un-
usually susceptible to and receptive of the
adoption of an electrical generation sad
distribution system within its and the City of
Lodi's control and regulation, and,
SIXTH: That the proposed Lodi Mokelumne River Hydro-
electric Development is aconomically advant-
ageous andjustifiable when considered in con-
nection with all other sources of permanent
electrical energy generation as considered by
this Council, and,
SEVENTH: That the,actual construction of the said Lodi
Power Project can be commenced within a few
weeks subsequent to the assurance of the avail-
ability of the funds requested in the Application
of the City of Lodi to the Federal Emergency
Administration of Public Works.
BE IT FUR,HER i SOLVE, that the City Council of the City
of Lodi hereby directs the City Attorney to file four certified
copies of this resolution with the Administrator, Federal
mergency Administration of Public Works and request that the
same be attached to and made a part of the application of the
City of Lodi heretofore filed with the said Administrator.

The City Council raving heretofore ordered advertisement
for the reception of sealed proposals for the publication of
the City's legal publications for the calendar year, and two
proposals having been recei$ed in accordance with said notice,
the proposals were now publicly opened and declared and on
due consideration, it appearing that the proposal of Moore and
:toper. publishers of The Lodi Sentinel was entitled to award,

this City Council has heretofore adopted specif-
ications for the publication of legal notices required by law
to be published in a newspaper of general circulation, printed
and published in this City ;

Clerk has had published a notice inviting sealed proposals for
said publication, to be received, opened and publicly declared
on this the second day of January, 1934, as more fully appears
from the affidavit of Naomi 3. Walters, now on file ;

sealed proposals have beer submitted; to -wit :

1721 per column inch; for.next subsequent 151 and for third and
subsequent publications 141 per column inch;
The proposal of TEL' LODI 3LNTINZL, bidding for first pub-
lication 111, second Bye, third.6y and all publications there-
after at 41 per column inch;
N0PW, THSRs_^ORE, this City Council having publicly opened
and considered the bids aforesaid, finds that the proposal of
THE. LODI SMITINE'L to be the lowest and best proposal received
and hereby awards the contract for said publication to the said
newspaper at the price named in its proposal and hereby rejects
all and any other bids or proposals received.
The foregoing Resolution No. 700 was adopted by the follow-
ing vote :-

It appearing that the Federal government would have funds
available through the Civil Works Administration for the emp-
�oyment of labor in municipal projects not possible of const-
ruction out of the ordinary income of the City, the following
resolution was adopted :-

WHEREAS, the Federal Government has made available funds
to be expended upon certain public works projects -in the State
of California through. the Federal Civil Works Administration
for California; .
5OW, TI R;FORE, the City Council of the City of Lodi, County
of San Joaquin, State of California, does hereby resolve, determime
and declare as follows :
1. That application be and is hereby made to the Federal Civil
'Works Administration for San Joaquin County for the approval of the
Federal Civil tlrorks Administration for California, of the following
project, subject to the rules and regulations of said Federal
Civil works Administration :
"The construction, replacement and repair of damaged
curbing. gutters and sidewalks throughout the City
in accordance with the recommendations of the City
Zngineer"
L. That the above project has not heretofore been submitted
-to the Federal Civil Works Administration and that the same can-
not be financed in accordance with the terms of Circular No. 2
of the national Industrial Recovery Act; -
3. That the above project would not and could not be
financed or carried forward in any other manner, and that it would
not take the place in any way of any normal function of govern-
ment in said City;
4. That the above project is of general public benefit,
economically sound and of permanent value;
5. That the City Engineer be, and he is hereby authorized and
instructed to certify uuon the application contained herein, as to
the correctness of the plans and specifications and the estimate
of labor, materials and supplies required;
6. T) -at the City of Lodi has sufficient to furnish the money,
equipment and other materials and services of value set forth
under Iteil III of the application, and upon approval of the
application, will furnish all the items listed;
7. That the City Clerk shall certify as to the passage of this
resolution and forward three certified copies thereof to the Federal
Civil Vorks administration for San Joaquin County at Stockton.

The foregoing Resolution No. 701 was thereupon passed and
adopted by the following vote:
AYES: Councilmen,Spoon-er,rreihe,Clark,i:eagle and Steele.
NOES: Councilmen, Done. A33.0T: None.
Bills in the amount of ;A1O,495.91 as arproved by the
Finance Committee were allowed and ordered paid on motion of
Councilman Clark, Weihe second.
Superintendent of Public Utilities John A. Henning reported
that the continuation of the Forth Sacramento Street storm drain
had been completed, the Federal Civil Works administration
furnishing the labor.
Colorado Dower Company was requested to extend the time
for the performance of certain conditions subsequent to the
deed of January 9th.,1929 for a period of six months from and
after January 9th.,1934 by the adoption of the following:
RESOLUTION NO. 702
WHEREAS, under the terms of a deed dated January 9, 1929,
delivered to and accepted by the City of Lodi in accordance with
Resolutions lyos. 566 and 567, by which the Colorado Power Company
conveyed to the City of Lodi certain riparian lands and water
rights situate in and along the Yokelumne River in Calaveras
and Amador Counties, California, more particularly described in
said deed, the City of Lodi ;gas required to perform certain
conditions subsequent, as a prerequisite to retaining title
thereunder, and,
Wy=?SAS, by three certain supplimentary deeds, the times for
performance of said conditions subsequent have been extended by
said Colorado Power Company, as all appears by recorded deeds; and,
AUEREAS, the City of Lodi has applied to the United States
National Recovery Administration for a grant and loan, and said
matter will not be determined before January 9, 1934;
,OV-., THERE.FORE, BE IT RESOLVED, that tke City Council of the
City of Lodi does hereby request the Colorado Power Company to
extend the time allowed by said deed of:January 9, 1929 as already
extended by said three supplimentary deeds, for an additional
period of six months, within which the conditions and reeuirements
enumerated in said deed dated January 9, 1929 as conditions
numbered "THIRD", "FOURTH", and "SIXTH", may be performed
and complied with by the City of Lodi, grantee thereunder, upon
the same understanding by the City of Lodi set forth in said
Resolutions hos. 566 and 567;
BE IT FURTHER RZSOLVED, that a certified copy of this
resolution be transmitted by the Clerk of this Board to Colorado
Power Ccnpany for its consideration, together with a request that
the said Company shall, if ao-reeable thereto, cause to be trans-
mitted to said Clerk, a duly executed supplimentary deed on or
before January 9, 1934.
