2Tonday,August 1,1932
-ie City Council of the City of Lodi met in regular
at S o'clock P.M. on the date first above written, Councilmen
C1ark,Keagle,Weihe and Steele present, Councilman Spooner
absent.
The reading of the minutes of the regular meeting; of
July 13th and the adJJ'ourned meeting of July 25th was dispensed
with, being incomplete, and the same was deferred to the next
meeting to be held August 15th,1932.
No persons a pearirig; the order of Public Hearings
was passed and the Uouncil proceeded to hear eounications
and reports :
The monthly report of the Chief of Police for July and
that of the City oound*master for the same month were received,
read and ordered filed.
A cocv unication from the County Ielfare Board stating
that a meeting would be held August lst, was read and ordered
filed.
A letter from the League of California Municipalities
acknowledging receipt of annual dues bas also read and ordered
filed.
A communication from the City Clark, then temporarily
absent, regarding the discontinuance of certain police pphones
on power roles in various parts of the City was read -and
briefly discussed. 1-ir Henning stated that his electricians
used these phones also but that he thought that the monthly
charge of $x.00 each was excessive. On motion of Councilman
W-eihe, Clark sec.;nd, the action of the City Clerk in ordering
the service discontinued was unaniu ously affirmed.
It appearing, from a letter from the City Treasurer,
that there was a deficianc in the Street Assessment Bond
Fund, owing to delinquent tax collections and also to meet
installments due on properties sold to the State or to the
City ar_d not displayed on the 1931 assessment roil, the
pproper transfers of funds were directed by the passage of
?esolution No. 667 by the following vote :-
AYES: Councilmen, Clark, Ke b le, Weihe and Steele.
CounciLmen, None. ABSENT: Councilman,Spooner.

A Resolution Directing that Certain Transfers of
Fords be Made by the Cit Treasurer to Pay Prin-
cipal and Interest on Delinquent Street improvement
Assessments in the Tag Year 1931-32.
n SOLV D, by the City Council of the City of Lodi that the
following transfers of funds be, and the'same are hereby
authorized to be made to satisfypayments of principal and
interest due on Street Improvemnt Bonds payable in the tax
year 1931-32 :-
(1) :rom General Hund to Street Assessment Bond Fund.
the sun of ME THOUSAND SEVEN HUNDRED TWO DOLLARS AND NINETY -
O r CENTS ($1,702.91), the said s= being the amount of street
improvement assessments delinquent July 31, 1932 plus $362.00
due from properties sold to the City or to the State of
Californiaand not displayed upon the said assessment roll;
(2) From "Street Assessment Account", a revolvir fund
in the custody of the City Clerk, to Street Assessment Bond
Fund, the sum of ONE THOUSAND TIFEE FUNDRED FIFTY-SIX and
SEVENTY TIiREE 0JINDREDTHS DOLLARS ($1,356.73), representing
the amounts due of principal and interest paid .in advance,
less amounts due from bonds or coupons whose maturity has been
previously advanced and the bond cancelled.
The City Council then co --mended Police Officer Clarence
Stonewall Jackson for his action in apprehending one Phillip
Gier on the night of July 25th,1932 b,� adopting the follcwing

resolution by unanimous vote :-

Jackson, =police officer of the City of Lodi, acting in the
line of his official duty, shot o.e Phillip Gier; and whereas,
it a, -pears that said Gier and his companion were then in
the act of burg larizinz a service station in said Cityy,
at the corner of ("herokee Lane and Load A venue,and thatm as
said Jackson a..oroached to arrest said burglars, said bier
stooped and made a motion as if to pick up some deadly
weak on, probably an iron bar which said Gier had at the time
in said service station, and that said Jackson thereupon
shot said Gier;
,10d, TIIMFO.E, BE IT RESOLVED:
First. That Lhe Council of said City regrets that it
was necessary for said C.S.Jackson, said Police Officer, to
shoot said Gier.
- Second. That said C.S.Jackson was justified in -shooting
said Gier, because said shooting was necessarily done in a
lawful attemt to arrest a person In the act of, committing
a felony, and because it then appeared to said C.S.Jackson
necessary to overcome resistance to arrest and to prevent
great bodily 'arm to said C.S.Jackson.
Third. That, while the City Council rerets the neces-
sity for said shootin,.it cormends the saig police of
F,officer
for performing his official duty, and recon -mends that all
police officers rigorously enforce the law in this city,
and deal with all offenders as severely as the law and the
facts may justify..
Street Superintendent B,C,Dou.:hertyy reported orally on
j the progress in patching gutters and sidewalks and .gas
instructed to continue the work throughout the City where
he thought it necessary.
Bills in the amount of $10,093.33 as a,_:proved by the
Finance Committee were allowed and ordered paid on motion of
Councilman Clark, keagle'second.
After'a short executive session, the City Council
adjourned to and until the day and hour of its next regular
meeting_to be held August 15, 1932.
