HomeMy WebLinkAboutMinutes - July 18, 1932493 Council Chambers -City Council City Hall - City of Lodi Monday, July 18,1932 The City Council of the City of Lodi met in regular session at 8.DO o'clock on the date first above written, Councilmen Clark,Keagle,S�pooner,�yeihe and Steele present,. none absent. The minutes of the last meeting held July 5thf,1932 were read, approved as read and so endorsed by, the Mayor. Pao ppersons appearing,. the order of Public Hearins was passed and the Council proceeded to hear communications and reports A letter from Publicly Owned Gas & Electric Utilities Association calling a meeting to be held in Los Angeles on the 22nd, laid over for further consideration. The report of the City Treasurer and the report of the City Clerk for the quarter ended June 30th,1932 were received, read and on motion, ordered filed. The City Clerk notified the Council byq latter that he had received the assessment list for 1932-33 from the City Assessor. The following resolution was then introduced r RESOLUTION NO. 663 t IN THE MA TER OF THEE APPROVAL OF THE ELECTED. OFFICERS OF LCDI VOLUNTEER FIRE DEPARMENT FOR TIIE FISCAL YEAR REGI :ING JULY 1, 1932 ., REAS, Ordinance No. 163 of this City requires that this City Council appoint the members of said Department as may receive compensation from the City of.Lodi, as officers of said Department, and , W1 2REAS, Lodi Volunteer Fire Department did submit a list of its elected officers recommended for such appoint- ment on July 5, 1932, said officers to take office on July 1, 1932 for the fiscal year beginning on that date ; NMY T:CREFORE , BE IT RESOLVED, that this City Council hereby apppints the members of said Lodi Volunteer Fire Department shown on the list neat attached as recommended for appointment by said Department to be the officers of said Department and to be compensated as such for the cur- rent fiscal year, save and except the member elected by f said Department to be the President thereof ; I BE IT ALSO RESOLVED, that a copy of this Resolution I be sent to he Secretary of Lodi Volunteer Fire Department so that action may be taken in regard to the exception herein noted. The foregoing Resolution No. 663 was then passed and adopted by the following vote : AYES: Councilmen, Spooner,deihe,Clark,Keagle & Steele NOES: None. ABSENT: None. Resolution No. 664 was then introduced 4 a 4 (minutes of July 18,1932 cont.) IESGLUTION No. 664 BE IT RESOLVED, by the City Council of the City of Lodi, San Joaquin County, California, that Robert M. Searls, Att- orney at Law, special counsel representing said City, and Glenn Jest, City Attorney of said City, be and they are here- by authorized and directed to dismiss that certain action now pending in the Superior Court of the State of California, in and for the County of San Joaquin, entitled "City of Lodi, etc., vs. East Bay Municipal Utility District, et al," and numbered 22,415, in so far ONLY as said action affects defendants, J. J. Preston. Jr.. and Stephen E. Kieffer, said action not to be dismissed as to any other defendant in said action. The foregoing resolution No. 664 was thereupon passed and adopted by the following vote :- AYES: Councilmen, Spooner,.1eihe,Clark,Keagle & Steele. ?NOES: Councilmen, None. ABSENT: Councilmen, None. At Lhe order of theMayor, the City Council was res- olved into executive meeting of Committee of the :!hole and on return to open session, the following resolutions were introduced, passed and adopted RESOLUTION No. 665 BE IT RESOLVED, by the City Council of the Cityy of Lodi, San Joaquin County, California, that Glenn :Jest ,City Attorney of and for said City, be and he is hereby instruct- ed to communicate with Forrest Curry, Co%--ressman of and for the District in which the Citp of Lodi is situated, relative to protest filed by. the Cityy of Lodi against East Bay Hunicipal Utility District's application for Project License No. 1134 to construct and operate its Middle Bar Reservoir on the Mokelumne River ; BE IT F RTRt RESOLVED, that said City Attorney endeavor to induce said Forrest Curry, as such Congressman, to interview the Federal Power Commission to the end that a decision on said protest and application may be obtained as soon as possible. The foregoing Resolution No. 665 was thereupon adopted by the following vote :- AYES: Councilmen Spooner.Jeihe,Clark,Keagle & Steele NOES: Councilmen, None. ABSEINT: CounciLmen, None, RESOLUTION No. 666 `1?I�REAS, The Federal Power Commission heretofore is- sued, or �uroorted to issue its Project License No. 567 to East Bay _Junicipal Utility District, authorizing said District to build and operate its Pardee Reservoir" on the Mokelunne River; AND, ;REAS Glenn -lest, City Attorney of the City of Lodi, San Joaquin bounty, California, states that he is in- formed that roper notice of the filing and hearing upon atiplication for said project license was not publishes or given • N0:7, TiEREFORE,BE IT RESOLVED, that the said Citpp Attorney is hereby authorized and directed to file smith the Federal Power Commission, a petition and such other papers or pleadings as to him may seem fit and proper for the purpose of obtaining the cancellation or modification of sai$ Project License No. 567 upon the ground that notice of the filing and hearing of petition on said project license was not properly published or given or upon any other ground or groundds that may seem proper to said City Attorney.. BE IT FURTHER RESOLVED, that said City Attorney is hereby authorized to commence or prosecute any other Kr or action before said commission or before any court dor the purpose of obtain' the cancellation or modification of said _roect License No.567 upon any ground or grounds as tc said City Aitorney may seem fit or proper. The foregoing Resolution No. 666 eras thereupon adopted by, the following vote AYES: CounciInen, Spooner,Jeihe,Clark,heagle & Steele. `TOES: Councilmen, None. ABSENT: Councilmen, hone.
