HomeMy WebLinkAboutAgenda Report - December 3, 1997 (41)AGENDA TITLE: Encroachment Permit and Hold Harmless Agreement for 800 South Cherokee Lane MEETING DATE: December 3, 1997 PREPARED BY: Public Works Director RECOMMENDED ACTION: Approve the encroachment permit and hold harmless agreement for 800 South Cherokee Lane and direct the City Manager and City Clerk to execute the agreement on behalf of the City. BACKGROUND INFORMATION: Mr. Ronald Dancer, on behalf of the property owner, the Bonnie Jean Dancer Family Trust, has submitted a construction permit application (#12276) to obtain a building permit for the construction of a masonry fence along the north, south and east property lines of the subject parcel. The fence structure will encroach on an existing 8 -foot public utility easement (PUE) along the east property line. Said PUE contains an 8 -inch public water main and various utility service laterals. The Public Works Department has approved the encroachment on the condition that the masonry fence foundation be designed such that no additional load is imposed on the public water main or utility service laterals, that the owner execute a hold harmless agreement which will be recorded in the County Recorder's office, and obtain written approval for the encroachment from other public utilities. Plans showing an appropriate foundation design for utility crossings have been submitted to the Building Division of the Community Development Department for inclusion in the building permit. The owner has executed the encroachment permit application and required hold harmless agreement, provided written authorization for the encroachment from PG&E, Pacific Bell and MediaOne, and paid the necessary fees for recording the hold harmless agreement.
