Pursuant to the adjou=.ent taken from the regular meeting
of October 5, 1931, the Citv Council -,:et in adjourned re alar
session at 6.05 o'clock P.". on the date first above written,
Colmicilmen Keagle, Roach, Steele, .leihe and Spooner present,
none absent.
This bei_- the date set for the hearing upon protests against
the az sessu!ent made by the Cit engineer to represent the costs
and expenses of the improvaaen� of Cherokee Lane as -oerforned
under Resolution of Intention No. 72 adopted.

After reading of the above by the Clerk, the Tayor invited
oral w=ent or elucidation of the matters under consideration
bat only general reaarks and inquiries as to the amounts of
individual asseoxients were offered.
As this day .;as a legal holiday, no action on the anneals
or on the assessment, was taken, uhe matter bein§ continued and
set over to and until a special meeting of the Council to be
held Tuesday, October 13, 1931 at 8.45 o'clock A.11:, and all
persons present were notified thereof and that the Council
would.listen to any further discussion at that meeting.
The City Council then adjourned.

At the call of the Yayor, Councilmen Keagle, Steele, ;:eine,
and Spooner met in the Council Chambers of the City Council
at 8.45 o'clock A-1% in special public session.
No persons a-ooearing at this time to appeal from the assess-
ment of the City engineer representing the costs and expenses
of the improvement of Cherokee Lane pursuant to Resolutio# of
Intention iro. 72, and all written nrotasts having been read
and considered, the folloiing resolution was introduced and
adopted by the following vote :-

1931 file with the City Clerk of the City of Lodi, an assess-
ment to rpnresent the costs and expenses of the street work and
improvement done and made by R0.IO9D H. CRtrSIL7 and/or his
successors and/or assigns, pursuant to Resolution of Intention
No. 72 of the City Council of the.City of Lodi, adopted April
13, 1931 ;

lication and posting in the tie and mariner provided by last,
of the filing of said assessment and of the time set for hear-
ing thereon, which time ,,as fixed in said notice as the 12th
day of October, 1931 at the hour of 8.00 o'clock P.7. of said

received, read and heard and considered said appeals and has
received evidence, oral and doc;r!e-ntary, concerning the correct-
ness of said assessment and of the pro-)er completion of the
street work and improvement for -ahich the same .-as issued ;

hour of 8.45 o'clock in the forenoon of said day ;
NOW, THEREFORE, IT I3 IMMY RESOLVM, by the City Council
of the City of Lodi that all appeals of every '_rind and nature
be and the same are hereby overruled and denied ;

and --warrant attached thereto, the ,proceedings leading up uo
the same and all acts and determinations of the Superintendent
of Streets and of the City Engineer in relation thereto be,
and the same are hereby confirmed, ratified and approved, and
the Superintendent od Streets is hereb ordered to deliver said
warrant, assessment and diatram to C. . '4 ers, assignee of
Ray-ond H. Crumey, the contractor, or to his agents or assigns
forthwith u,)on the payment by him or them of the incidental
expenses due thereon.
