City Hall - City of Lodi
Monday, August 17th,1931
This regular meeting of the City Council of the City of
Lodi was called to order by the Mayor at 8.05 o'clock on the
date first above written, Cow -oilmen $eagle, Roach, Steele,
weihe and Spooner present, none absent.
The minutes of the last regular meeting held August 3rd
1931 were read, approved as read nad so endorsed by the Mayor.
Miss Amy L. Boynton, Librarian of Lodi Public library
presented the estimate of the needs of the Library for the
next fiscal year and consideration was laid over until the
presentation of the annual budget.
Mr Cecil A. Williams representing the Lodi Business
Men's Association asked that some means of crossing Cherokee
bane be devised during the construction work now in progress
and the City Engineer was directed to take such steps as
possible to open main crossings and have the State put the
intersection at Lookeford Street in passable condition.
On motion of Councilman Weihe, Roach second, the Mayor
was authorized to sign a letter setting forth the terms and
conditions whereby the State of California would take care
of the construction of two ten -foot lanes running from
Loekeford Street to Vine Street on Cherokee Lane.
THe Clerk read a copy of a letter written by City Eng-
ineer Edward K. Hussey to R. H. Crummey and G. D. Myers
apprising them of the taking effect of the alien labor law
on public works.
The Clerk was authorized to purchase four copies of the
hand book on California Municipal Government to be issued
shortly by the League of California Municipalities.
Mr W. J. Robinson protested by letter against the water
charge made at 300 and 304 East Lodi Avenue but the charge
being according to ordinance, no remedy was possible except
through Mr Robinson's installing a new tap.
Two building permits for additions to existing dwellings
amounting to $200.00 were ordered granted.
The City Treasurer having reported to the Clerk that there
was a deficiency in the Street Assessment Bond Fund due to
1930 delinquencies, a transfer of funds was directed by the
adoption of the following -
RESOLUTION No. 641
WHEREAS, the City Treasurer reports an overdraft 00 the
General Fund of $1,658.56 to Street Assessment Bond Fund
caused by delinquent payments of principal and interest on
street improvement assessments due in 1930-31, and whereas,
there are outstanding bonds and eoaponsein addition to the
above amount still unpaid,(not presented), making a total
of 42,321.56 ;
RESOLVED, that the sum of 01,344.87 be transferred from
the General Fund to Street Assessment bond Fund and that the
City Clerk pay over to the City Treasurer for account of
the said Street Assessment Bond Fund from his Street Assessment
Account, the stmt of $746.09 collected on assessments paid
before due date on which the maturity of bonds have not been
advanced and the money paid in.
The foregoing Resolution Ro. 641 was passed and adopted
by the following vote :-

On arrlication of the Class Secretary, the Class of
1911 of Lodi Union High School was allowed the use of the park
at Maple Square for the evening of August 23=d.
TRe California Vine7ardists .association having a -plied
for a room for the next crop season, the Clem was instructed
to let them have a room on the-lcwer floor at $15.00 per month

the grantee at the regular meeting of the City Council held
August 3rd.,1931 and thereat laid over for the statutory period
of not less than five days, was introduced for final passage and
finally passed and ordered to print by the following vote :-
AYES Councilmen Steele,"deihe,Seagle,Roach & Spooner.
NOES None ABSENT None.
The contract for flowage rights in the "south branch"
canal of Woodbridge Irrigation District presented to the City
Council July 6, 1931 was again brought up amended as to the
preservation of the riazht to sell water to D. B. Doepke in
the years 1932 and 1933 and execution of the contract was,
directed by the adoption of Resolution No. 642 by the follow-
ing vote :-
AYES Councilmen,Steele,Weihe,Seagle,Roaoh,Spooner.
NOES None ABSENT None.

Bills in the amount of $4,403.65 as approved by the
Finance Committee were allowed and ordered paid on motion of
Councilman "leihe, Roach second.
M= Robert M. Searls being in attendence, addressed the
Council and citizens present on the stens taken to bring about
a settlement of water rights with East Bay Municipal Utility
District and Pacific Gas & Electric Company.
After hearing Mr Searls report and discussing the same,
the following resolution was adopted
R ^ SC LUT ION No. 643
t'lHAREAS, an action numbered 22415 wherein this City is
plaintiff and East Bay Municipal Utility District, 2acific Gad
and Electric Company and others defendants, has been set for
trial on September lst.,1931 in the Superior Court of San
Joaquin County ;
AND, vTHEMEAS, Mr.Rohert M. Searle, Associate Counsel
for the City has rendered a fall report orally this evening to
this City Council, stating the efforts made to effect a com-
promise_settlement without success :
RESCIVM- , that this City Council of the City of Lodi in
- regular session this seventeenth day of August, 1931, hereby
commends Mr Searle and Mr Glemm West, City Attorney, for their
efforts in endeavoring to safeguard the City's rights and
accepts Mr Sea=ls report without reservation, feeling that
everything has been done to effect an amicable settlement pos-
sible under the circumstances :
ALSO, BE IT RESOLVED, that this City Council hereby
does direct that the pending suit be immediately brought to
trial, using every means at the command of the City to prosecute
it to a successful conclusion and that the City Attorney co-
operate with air Sea=ls, using his knowledge of local conditions
as an espacial'aid in furthering our purposes as well as pat-
ting forth every effort possible to effect a speedy and a
complete hearing of our cause.
The foregcing 3esolation No. 643 was adopted by the fol-
lowing vote :-
AYES: Councilmen, Steele, Weihe, Roach, $eagle, ',4eihe
and Spooner.
NOES: Council -:en, 2done.

No further business appearing, the City Council adjourn-
ed on notion of Councilman Fleihe to 8 o'clock P.M. of Monday,
August 24, 1931.
