Monday, June 15, 1931
This regular meeting of the City Council of the City
of Lodi met at 8.10 o'clock on the date above written,
Councilmen Keagle,3oach,Steele,".ieihe and Spooner present,
none absent.
The minutes of the last regular meeting held June let
were read, approved as read aid so endorsed by the elayor.
The report of the Committee on Finance & Revenue on
bank balances and on securities to secure the same request-
ed May 4th and delayed on account of the absence of the
Treasurer, was filed and ordered acceptedon motion of Council-
man Steele, .eihe second.
Cn motion of Councilman Steele, Keagle second, Mr
Howard Kobayashi was accepted as assignee of the contract
between the City, and G.J.Layton for the _purchase of surplus
sludge from the Sewage Disposal Plant.
The Clerk read a letter from the Secretary of Lodi
Volunteer Fire Department stating the results.of the depart-
ments election held June 12th,19o1 and on motion of Council-
man Keagle, .,feihe second, the officers elect were confirmed
as the officers of the department.
On motion of Councilman . eihe, Roach second Mr Henry
F. Elis and Hr '7ilson H. Thompson were re-a)pointed Trust-
ees of Lodi Public Library for the full terms beginning
July 1, 1931.
Cn motion of Councilman Kea;le .7eihe second, the
Clerk was directed to notifythe Cnief of Police that an
officer should be stationed in the CityHall duringthe
Noon hour especially during the first en days o± the month.
Three building permits a; regating $765.00 granted.
In the natter of pending suits versus Fast BayUtility
District et al, Mr Glenn :lest, City Attorney presened a
resolution which was numbered 639 -and passed by unanimous
vote of all members of the Council :-
P.BSCLUTION No. 639
HAS, the City of Lodi has heretofore cacmaenced
and there is now pending in the Superior Court of the State
of California in and for the County of San Joaquin, a cert-
ain suit against Bast Bay :unicipal Utility District and
Pacific Gas 4 Electric Company, a corporation, and others,
defendents, for the purpose of restraining the diversion of
waters from the :okelumne River; and whereas, the City of
Lodi has heretofore made and filed in said action a certain
offer to do equity in said action; and whereas; said def-
endents have heretofore requested time in which to study and
consider said offer and make counter proposals, and whereas,
the attorneys for said City have from time to time contin-
ued the tine of trial of said action at the request of
attorneys for said defendents so that said defendents might
have time in which to study the offer to do equity and in
which to make said counter pro:osals;
AND =SEAS the City Council of said City feels that
sufficient time been -ranted for the above purposes;
NO THEREFORE,
ORP., BE IT RESOLVED by the said City Council
that it is the sense of said Council that sufficient time
for the above purposes has been heretofore granted and that
the attorneys for said city are hereby instructed to bring
said action to trial abd try the same as soon as reasonably
possible.
Said City Council appreciates the fact that the attor-
neys for said City have endeavored to 'o ing about a satis-
factory settlement of said action without trial but feels k
that the said defendents have consumed entirely too much
time in study of said City's offer to do equity and in their

On motion. of Council.:anieine, Roach second,_ the City
Council adjourned to and until 8 o'clock ofonday, June
