City Hall -City of Lodi
Monday;January 5th., 1930
This regular meeting of the City Council of the City
of Lodi was called to order by the'. ayor at 8 o'clock P.M.
at the place and on the date first hereinabove written,
. Councilmen Keagle, Roach, Steele, Jeihe and Spooner,Wayor,
present, none absent.
The minutes of the last re,ular meeting held December
15th.,1930 and of the adjournments therefrom on December
17th, December 22nd -and December 29th, 1930 were read,
approved as read and so endorsed:by tie Mayor.
Mr taildreich E. Looser, President of Lodi Volunteer
Fire Department again appeared before the Council in regard
to the directed the Council's attention to f the e Department. ttththee also
furniture stored in the Maple Square Fire House had not been
removed.
Reports from the Chief of Police and the City Pound -
master for December were read and ordered filed.
A. Lutz applied by letter for the erection of a street
liEht at Vine and Garfield Streets. Referred to Supt. Henning.
The. Chief of the Fire Department filed his quarterly
report and the same was read and ordered filed.
Councilman Jeihe submitted a report on the condition
of the cork elm trees in the older part of the City and
asked that the tree.spaces in Lawrence Park be enriched
.with sludge from the sewer plant. As this sludge is under
contract for sale, he :.as authorized to purchase sufficient
gypsum fertilizer for the purpose.
Le Rot B. Cross applied by letter for the position of
janitor at the,City Hall. Application ordered filed.
Bills in the amount of $12,847.63 as approved by the
Finance Carnnittee were allowed and ordered paid.
Mr Glenn :fest City Attorney orallx reported on matters
connected with the City s suits against Last Bay Municipal
Utility District and Pacific Gas and Electric Company.
The Colorado Power Company having offered a suppliment-
ary- deed extending the times of performance of certain con-
ditions subsequent contained in the deed of January 9th.,
1929 as petitioned by the City in its Resolution No. 623
on December 15th. 1930, the supplimentary deed was accepted
by the adoption of the following :-

CITY COUNCIL OF TRE
BE.IT 'ESOLVHD BY THE/CITY OF LODI, a municipal corp-
oration of of the sixth class of the County of San Joaquin,
State of California that, whereas Colorado Power Company,
a Corporation, has -delivered to said City a certain "3up-
pliment to Deed" dated December 17th. 1930;
NOTH 'CRE said City of Lodi does herebyaccept
the said "Suoalim ent to Deed" subject to all the erns and
conditions thereof and directs the said "Suppliment to Deed"
be recorded in the office of the County Recorder of the County
of Calaveras State of and in the office -of the
County Recorder of the County -of California,mador, State of California
and that a certified copy of this resolution be annexed to
said "Supplinent to Deed".
The foregoing Resolution Was adopted by the unanimous
vote of all members of the City Council, viz, by the votes
of Councilmen Steele, Jeihe, Kbagle, Roach and Spooner.
It appearing from a further report of the City Attorney
that, after a conferance held in the City of San Francisco,
that it was desireable to allow defendents in the suits of

the City vs. East Bay 11unicipal Utility District and Pacific
Gas and Electric Company an extension of sixty days from
oetruary 2nd. ,1931, Qhe date on zhich the action i4as sched-
uled to be heard in the Superior Court of San Joaquin County,
in ;rhich to appear in said suits. a continuance 7, -as author-
ized for the period stated by the adoption of ;
SGLUTIGN NO. 625.
B] IT .3 30LVED by the City Council of the City of Lodi,
San Joaquin County, California, that :
.-i"_ ' said City has com.•nenced and there is now pend-
ing in the Superior Court of the State of California in and
for 'the County of San Joaquin, an action abainst Easy Day
unicioal Utility Distrief, Pacific Gas &Electric Company,
and J.y-.i. Preston Jr., which action is numbered 22415 and
which action has been set for trial to commence February 2nd,
1931;
A?:D Last kunicipal Utility District and Pacif-
ic Gas & electric Liompa_ny, defendants in said action, have
requested that the trial of .said action be continued for a
period of sixty days for the purpose of permitting negotiat-
ions for settlement between �.Iie partles to said action to be
carried on, and whereas said defendents, east Bay kunicipal
Utilit District and Pacific Gas & Electric Company have
assured said City of Lodi that they would make every reason-
able effort for „he purpose of .effecting a settlement of
said litigation;
N0:7, THI]RE ORF BE, IT RESOLVED, that Glenn '.rest, City
Attorneyand Robert Y. Searls, Special Counsel representing
said Ciy in said litiggaation be and they are hereby author-
ized to enter into a stipulation with the defendants in
said action and their attorneys agreei to said ccntinuance
of the time of the trial of said action for such period of
sixty days.

and Spooner.
