HomeMy WebLinkAboutMinutes - July 15, 1929349 Council Chambers -City :tall City of Lodi, July 15,1929 This regular meeting of the City Council of the City of Lodi was called to order by the Mayor at 8.15 PJ:t. on the date and at the E1ace first above written, Councilmen Road-, Shattuck, rieihe and Spooner present, Councilman Hale, absent. The minutes of the last regular meeting held July lst.,1929 were read, a_:proved as read and so endorsed by the Layor. The order of Public Hearings :,ias passed and the Council pro- ceeded to the hearing of cc unications and repox,s. The Clerk read letters from �:r. J.D.Galloway and frau Lir Charles Grunsky acceptin4 their appointments as consulting end ineers as authorized by Resolutions 585 and 586 adopted July Ist and the same were ordered filed. Gn motion -the Clerk :gas instructed to purchase eight old wooden benches from Mr. E.A.Benedict providing a fair price could be obtained. :Ir Forrest E. Cooper, ?ounchaster, applied for an increase in pay stating that his duties in the park end as ?oundmaster made the increased of his automobile necessary and that he haat to T ork at night on man- cases. On motion of Councilman Roach, Shattuck second, Mr many was allowed $125.00 monthly as salary It appearing that the City Treasurer had been able to make a very advantageous purchase of outstanding obligations of the City ::hereby the Special Bond Retirement I ad 'wad been overdrawn and that he had transferred the sum of $912.27 to this fund from the General Fund awaiting sanction of the City Council,, his action ?Pas a;,proved and the above sum ordered transferred by the adopt- ion of -Resolution No. 589 by the following vote:- PY-'S: Councilmen Shattuck, i1eihe, Roach and Spooner. .TOES: CounciLmen, Mone. ABSEIrl: Councilman dale. 3SGLWTON NO. 589. RESOLVED, that the transfer of the sum of $912.27 here- tofore transferred by the City Treasurer frau the General Fund to the Special Bond Retirement Fund be approved and said transfer id hereby authorized and directed. CM application of tie City Cleft, he was authorized to trade in the old'Dalton" adding machine in his office for a neer model of the same make. On motion of Councilman Roach, iieihe second, Mr J.A.Henning °ryas directed to furnish Lir J.D-.Gallowaywith certain information needed by him. in his capacity as consulting engineer of the City and also to incur such traveling expense as might be necessary_ in consulting with Mr Galloway in his offices at San Francisco. ` give building permits aSgregating $3,200.00 were granted. Audited claims numbered frau 12423 to 12598 in the -total amount of $5 308.18 sere allowed and ordered paid, the claim of Thi Lodi Ser. irel for 5211.19 beim reduced to $3.99 as their bill for $207.20 for publication_ of the delinquent tax list vias witheld from payment until the legalityb,f the charge could be investigated. In the matter of theempto ent of Mr. N.A.E'ckart, it appearin.gg on recommendation of the City Attorney that certain a&eindments to Resolution No. 587 passed and adopted July lst.,1929 were necessary, the City Council passed and adopted the following Resolution : 3,50 ?_,SLOT,'! BE IT 3ESCLVD, that Resolution No. 587 heretofore passed and adopted by the City Council of the City of Lodi at a regular meeting of said Council duly and regularly held on July lst.,lM,e And the same is hereby amended to read as follows :- iCLREAS the Citx of Lodi has cor—nnenced suit in the Superior Court of the State of California in and for the County of Calaveras, against East Bay y unicipal Utility District and others for the purpose of restraining the defebdents in said suit from diverting Mater out of the Mokel- umre River; AND '�oMI REAS, it will be necessary at the trial of said suit to introduce into evidence certain expert testimony as to the feasibility of the City of Lodi's proposed ower plant on the liokelumne River and as to run-off conditions, clow and general character off` the '•Tokelumne River; N07J TK -]P -:?FO --q7. BE IT RESOLVED that the City of Lodi does hereby employ i+.A.Eckart, Civil Engineer of Ban Fran- cisco California for the purpose of udying all natural conditions of said riverk and the feasibility of said pro- posed power project and for the purpose of giving his test- imony upon such subjects at the _trla7, of said suit; BE IT FURTHER F3SOLPED-, that said N.A.Eckart shall be paid for his services in studyithe conditions of the said river and the feasibility of sal proposed pourer projectfor the purpose of preparing his testimony, and for his services in ivfng testimony in open court upon the trial of said sui , at the rate of $50.00 per day for each day spent in the preparation of his testimony and for each day which he shall actually attend upon the trial of said action, and in addition thereto he shall be alloyed all reasonable ex- penses actually incurred in preparing saidtestimony and attending said trial, said moneys to be paid upon claims properly presented and allowed out of any moneys in the treasury of said City available for that purpose. The foregoing Resolution No. 588 was thereupon passed and adopted by the following vote AYES: Councilmen, Shattuck, Roach, ;eihe and Spooner. .NOES: None, ABSENT: Hale. Mayor ,7.A.Spooner applied for peYmission to leave the State of California for a period of not to exceed three weeks and the permission was -granted. on motion of Councilman Shattuc#, Roach second.
