HomeMy WebLinkAboutMinutes - March 30, 1925119 City Hall, City of Lodi Monday, March 30 - 19Z5 The Board of Trustees of the City of Lodi met in adjourn- ed regular session at 8 o'clock P.M. on the above date, Trustees Hale, Mettler, Roach, Shattuck and Spooner present, none absent. The minutes.of the regular meeting of March 16th,1925 were read, approved as read and so endorsed by the President. This_being_the date set by Resolution No. 475 passed March 16th., for the hearing of protests against the opening of Hutchins Street as undertaken pursuant to Resolution of Intent- ion No. 474, adopted January 19th.,1925, and it appearing on affidavit of the Clerk that notice of the time and place of hearing had been duly mailed to the several objectors, the Board proceeded to consider the merit of the objections advanced. Attorney J.M.McMahon addressed the Board in support of the written objections advanced and advocated the opening of California Street southerly in lieu of the proposed work. No further persons addressing the Board, Trustee Hale, seconded by Trustee Shattuck introduced Resolution No. 476 and the same was passed and adopted by the followingTvote:- ' AYES: Trustees, Nate, Shattuck, Mettler, Roach and Spooner. NOES: Trustees, None. ABSENT: Trustees, None. RESOLUTION -NO. 476 RESOLUTION OVERRULING ALT,R ED OBJECTIONS TO WORK OR INPRROVA 1T UNDER RESOLUTION OF INTENTION NO. 474. WHEREAS, on the 19th day of January, 1925, the Board of Trustees and City Council of the City of Lodi, San Joaquin Countyy • California, duly passed and adopted Resolution of Intention No.474; and whereas notices of the Jassage of said resolution have been posted, given and pnbli§hed in ail respects as rewired by law and in all respects as required by said Resolution of-IIntention; and whereas on March 12th. 1925, more than ten days since the com- pletion of the publication of said notices, John H. Brown,E.J.Cain, ueor a Heinitz,Geor~e G.Heinitz,George Abbott,John LobelJohn Shiers, Geo.F.Stafford,J.C.deinberger J.F.Terwillager,Jacob Heinitz 7t. 0. Corel]. am.H.Menzel,Andrew gutlick,�tm.Corell Thosias Huron and 1aria Focacci filed with the Clerk of said Board their alleged written objections to the work and i..rovement mentioned in said Resolution of Intention and to all ters therein contained; and whereas no written objections and no objections whateverhave been made within ten days since the completion of the publication of said notices, which time of publication expired on February 27th, 1925; and whereas said Board of Trustees dad on March 16th.,1925, and without waiving the fact that said alleged written objectiona of said protestants and objectioners were not filed within the time allowed by law, fix a tine, to -wit, March 30th.,1925 at eight o'clock in the afternoon forhearing said alleged objections; and whereas the said City Clerk thereupon notified the said protestants adobjectioners of the time fixed for the hearing of their alleged objections, bydepositing e. notice thereof in the Post Office of said City,wih postage prepaid, addressed to each of said object- ioners;and sad alleged objections coming on duly and regulary to be heard at the time specified in said notice to -wit, at eight o'clock in the afternoon on March 30th.,1925; and said Board -LNV havinngg fully heard the same and all evidence and matters sub- mitted in support thereof - BE 1T RESOLVED: Thai said alle d objections of said pro- testants and objectioners and the whole thereof are without merit and said alleged objections and each and all thereof are hereby overruled. BE IT FURTHER RESOLVED: That although the said Board of Trustees has heard and decided said elle ed objections upon their merits, said Board and City Council has not and does not waive the fact that said alleged objections of said protestants were not filed within the time allowed by law. -----------------e----------------- The Clerk read a letter from the local V.C.T.U. thanking the Board for their enforcement of the "Curfew Ordinance" The application ofelo Palermo for permission to inst- all a: grass si4a in front his ice-cream factory at Oak and Garfield Streets with the interior side above the side -walk grade vias referred to the City .Planning Commission on motion of Trustee Shattuck. Clyde S. Jackson submitted a verbal proposal to establish a traffic squad in the City under the supervision of the City Marshal this service to be in connection with similar service in the 6ity of Tran and to cover the services of a mounted trafic officer for three daps per week at $10.00 per day. It was decided, tentatively, that the Board zmcbix providing that the City of Tracy adopted this service, *k=kxkimgc would employ Mr Jackson for a: trial period of three months. Supt. of Public Utilities, J.A.Hennin§ submitted a let- ter received by him from Mr H.D.Miller of the 'western States Gas & Electric Company wherein his Company set a: price of $614.47 on their power transmission line to the City's pump on the Sanguinetti place; this rice included six poles, wire, fixtures, cross arms 3 - 3 KW 200-4400 volt transformersr; cut-outa.and meter. trustee Shattuck stated that he had person- ally viewed the line and thought the price in excess of re- placement cost and on his motion, seconded by Trustee Mettler, the.Clerk was directed to submit. the Company an offer of $450 for the line subject to acceptance on or before April 20th.,1925. r'our building permits at a total estimated cost of $2 250.00 were allowed, The application of Yee Lee to build a frame §arse at #212-N.
