Elm Street (APN 043-082-01) as an Abatement Action ($80,645) MEETING DATE: November 5, 1997 PREPARED BY: Community Development Director RECOMMENDED ACTION: That the City Council adopt the attached resolution awarding the contract for the above project to Diede Construction, Inc., Woodbridge, in the amount of $80,645, and appropriate funds in accordance with the recommendation shown below. BACKGROUND INFORMATION: This project consists of abatement and proper disposal of asbestos materials present within the structure, selective demolition of the northern 201 -foot section of the building, removal of demolition debris, and grading and compaction of the site. The property owner was first issued a Notice of Public Nuisance and Order to Abate by the Community Development Department's Building Division on February 6, 1996. On December 6, 1996, the Department's Community Improvement Division issued a second Notice and Order, for demolition to be completed by January 20, 1997. By March 19, 1997, the property owner had not undertaken the project, and the City Council authorized staff to proceed with advertisement for bids to initiate abatement action. On October 17, 1997, the City received and opened the following three bids for the work: AC&S, West Sacramento $54,675.00 Diede Construction, Woodbridge $80,645.00 West Coast Environmental, Rancho Cordova $81,800.00 The low bidder, AC&S of West Sacramento, failed to submit several required documents. Required by the bid, but not submitted by AC&S, were proof of current Asbestos Certification, a preliminary work schedule, and references for similar projects. The second -low bidder, Diede Construction of Woodbridge, met all requirements of the bid, including Contractors State License with A, B, and ASB Classifications. Diede listed RB Construction of Fremont, California, as the subcontractor holding the State Asbestos Certificate. FUNDING: Community Development Repair and Demolition Fund. Project Estimate: $80,000 The costs for this abatement are paid from the Repair and Demolition Fund, a revolving fund which Is replenished when funds are recovered from billing the property owner, or if necessary, placing the appropriate property lien. The City plans to seek recovery from the property owner not only for the cost of abatement ($80,645), but also for administrative costs incurred in the handling of this project. Funding Approved. ELM STREET AS AN ABATEMENT ACTION WHEREAS, in answer to notice duly published in accordance with law and the order of this City Council, sealed bids were received and publicly opened on October 17, 1997 at 2:00 p.m. for the Asbestos Abatement and Demolition of Collapsing Commercial Structure located at 17 E.EIm Street, Lodi, California. WHEREAS, said bids have been compared, checked, and tabulated and a report thereof filed with the City Manager as follows: i d r Location Bid Amount AC&S West Sacramento $54,675.00* Diede Construction Woodbridge $80,645.00 West Coast Environmental Rancho Cordova $81,800.00 • Failed to submit several required documents. WHEREAS, the City Manager recommends award of the bid for Asbestos Abatement and Demolition of Collapsing Commercial Structure located at 17 E. Elm Street, Lodi, California be made to the lowest responsible bidder, Diede Construction of Woodbridge, California; and NOW, THEREFORE, BE IT RESOLVED by the Lodi City Council that the award of the bid for Asbestos Abatement and Demolition of Collapsing Commercial Structure located at 17 E. Elm Street, Lodi, California, be and the same is hereby awarded to the lowest responsible bidder, Diede Construction of Woodbridge , California in the amount of $80,645.00.
