were read, approved as read and so endorsed by the Mayor.
PUBLIC HEARINGS - This order was passed
C0'_^"JNICATIONS-NOTICES-PEPORTS -
Notice of defects in the roofing of Lodi Armory was received from the
Adjutant General's Office and at the request of Assistant City Engineer
Singer, laid over for consideration later in the meeting.
Notices of transf--rs of alcoholic beverage licenses at _12 N.Sacramento
St and at 214 Ni. Cherokee Lane were received from the State Board of
Equalization.
A reco^:aendation from the City Planning Co:^.mission that the pedestrian
lanes on Elm'Street and on Pine Street from Sacramento Street to Main
Street be plainly marked and that parking or storage of automobiles and
trucks on these spaces be discontinued at once, was referred to the Chief
of Police.
The report of Coates & Herfurth, consulting actuaries for the State Emp-
loyees Petirement Association giving the estimated approximate contrib-
ution from the City of Lodi to that System for participation in the State
system +was received from the State Employees Retirement Association.
Owing to the complexity of the figures constituting and supporting the
estimate, the City Clerk was directed to ascertain if an actuary familiar
with these matters could be present in Lodi and explain to the Council
and to the Lodi City Employees Association the actual costs to the City
and to individual emnloyees.
Retort of Leo F. Kidd, of an independent audit of the City's accounts
for the two fiscal years preceeding June 30, 1944 was received and copies
referred to the Councilmen for study.
Mayor Rinn and City Clark Blakely reported briefly on the aims and objects
of the County'Supervisors association and the League of California Cities
in advocating the maintenance of state taxes at the level obtaining prior
to 1943 as discussed in a meeting of the Central Valley Division of the
League held February 15th
In the absence of City Attorney Glenn Fest due to illness, the City Clerk
reported that Mr -lest had requested 'that he report to the City Council
that judgement had been rendered in the suit of the City vs John E.Snyder
and others quieting title to eight parcels of tax -sold property in favor
of the City and that transactions for the sale of seven of these lots
could now be completed.
Mayor Rinn stated that he had been served with a copy of the complaint in
the 'suit of Herman S. Martin vs the City of Lodi arising out of the drown-
ing of the latters son Duane Martin at the Municipal Baths on July 12,1944.
In -as -much -as the claim filed in this case had been rejected by the Council
on October 18, 1944 and ordered referred to the City's insuror, Home Indem-
n nity Company, the Clerk was directed to notify the insurance company that
the City had received this service of complaint, City Attorney Glenn 71est
being already a --prised of progress in this case.
OPDIVANCES & RESOLUTIONS -
Ordinance No 307, entitled, " AN ORDINANCE AUTHORIZING SAN JOAQYIN LOCAL
HEALTH DISTRICT BY ITS DISTRICT HEALTH OFFICER, HIS AIDS AND ASSISTANTS,
TO ENFORCE CERTAIN LOCAL ORDINANCES RELATING TO HEALTH AND SANITARY MATTERS
IN THE CITY OF LCDI, CAL170PNIA " having lo --en regularly introduced on the
7th day of February, 1945, was brought up for passage on motion of Council-
man Coffield, Riggs second, second reading, after reading by title, omitted
by unanimous consent, and then finally passed, adopted and ordered to print
by the following vote:
AYES: Councilmen, Coffield, Riggs, Tolliver, 3eihe and P.inn
NOES: Councilmen, None.
ABSENT: Councilmen, None.
The Magor then signed the foregoing Ordinance No 307 in approval thereof.
UNIFINISHED BUSINESS -
The natter of the replacement of curbs, gutters and walks on the North-
east corner of the intersection of Pine and School Streets now coming
up for discussion, Marian Akerly, owner of the building affected by this
work, appeared and arued further that her share of the cost of this work
should be far less that the $1,000 to which she had previously agreed,
claiming that the present condition of these structures was due to faulty

repairs made by the City in 1937. Lr L. P. Singer, Assistant City Engineer
stated that he had no knowledge of the previous work but only of existing
conditions and that a good job could not be -performed without reconstruction
of the entire structures. The matter was again laid over pending resurvey of
the work by the City Engineering Department. In the mean time, the City attorney
and City Clerk were directed to prepare a Resolution of Intention for submission
to the City Council in accordance with the provisions of the '!Street Improvement
Act of 1911" relating to the repair of dilapidated street structures.
:'r George D. Polenske, Mr Robert G. McLane and Mr John A. Miller of the
City Employees Association presented a tabulation of salaries and wages now
in effect in Lodi and in several other cities with a presentation of their
request that certain wages be increased to the maximum allowed by Resolution
No 1142, that a few changes be made in the maximum wage allowed by this resol-
ution and that a blanket increase of $25.00 be granted all employees. In order
to determine the effect that the changes sought would have on City finances,
the City Clerk was directed to compute a list embodying the changes sought,
submit the same to the various department heads and, after they had indicated
any changes that they deemed necessary in individual wages, place copies in
the hands of the various Councilmen before the next meeting date.
As to the rental of the 'Iesterly eighty feet of Lot 14, Map No 1 of Live
Oak Colony, the Clerk was directed to obtain, if possible, bids for the season
of 1945 and submit them at the next council meeting.
Me_srs White and Singer of the City Engineering Department were requested
to review the 1944 contract with Foster & good Canning Company for waste disposal
and present recommendations for a similar contract for the 1945 season.
Business license applications submitted January 17th, having been approved
for issuance by the Chief of Police, were ordered granted.
A -plications for business licenses from Harold F.Broderick, Service Station,
131 N.Chero'.kee Lane, Ray H. Hauck, Service Station 100 N.Cherokee Lane,Mike
Pascs, Restaurant, 8 N. Main St, George Steuros, Restaurant 23 N. Cherokee Lane,
George Hanna, Painting Contractor, 356 E.-Jalnut St.,and Fred Schooley, Electrical
Contractor, Stockton were read and ordered referred to the Chief of Police in
accordance with Section 9 of Ordinance No 277.
On written recommendation of Arvid O.Pauly, Director of Recreation, Eddie
De Benedetti was a --pointed Play Ground Director -Athletic Specialist, at a salary
of a 175.:0 per month effective February 1, 1945. Probationary appointment.
The City Clerk was directed to certify to the Council as to the performance
record of :lilliam J. Ninnis, Janitor of the City Hall whose probationery period
expired December 31, 1944.
Judge J. C. Ferguson of the City Court being reported seriously ill in
a Sacramento hospital, City Attorney ,lest was directed to arrange for a legal
method of handling affairs in that court until Judge Ferguson return to duty.
- at 10:55 o'clock P.M. the Council retired into executive session and the
room cleared, so remaining until 12:15 o'clock P.M. of February 22, 1945 when
adjournment was taken on motion of Councilman vleihe.
