HomeMy WebLinkAboutMinutes - June 4, 1941252 0 -07_:CT_-C A,:7ERS -- 'CITE' C0 'CT _-- "-Ei= -- CIT`_' OF L -DI �'=T3SDAY, JUNE 4, 1941 a This regular meeting of the City Council of the City of Lodi was called to order by the Vayor at 8:00 o'clock P.L. on the day and at the place first above in these minutes written, Councilmen Bull, Graffigna, Riggs, °Neihe and Mayor Steele present, none absent. The minutes of the last meeting held May 21, 1941 were read, appr- oved as read and so endorsed by the Mayor. _ I Communications from Faulkner,Oaks & Faulkner and from A.F.Harrison Company regarding the annual audit of City accounts were received, read and referred to the Finance Committee. Reports of the Chief of Police and of the City Poundmaster for the month of May were read as filed with the City Clerk. ORDINzNCE NO. 272, entitled " AN ORDINANCE AP3:NDING C=DINANCE NO.221 OF THE CITY C: LCDI, RELATING TO BUSINESS LICENSES WITHIN S_,ID CITY BY AD- DING THERETO A SECTION TO BE KNOW AS "SECTION 9-a" AND BY Aga" YDING SUB- DIVISIONS 1 AND 9 AND 18 OF SECTION 13, TFiE_Td;OF, AND BY P21=- ING SECTION 18 =OF." was introduced on motion of Councilman Graffigaa, seconded by Councilman Riggs and by the same motion, laid over for the statutory period of not less than five days by the following record vote: AYE: Councilmen, Graffigna, Riggs, Bull and Steele NOBS: Councilmen, Weihe. ABSENT: Councilmen, None. The order of Public Hearings having been passed earlier in the meet- ing, was now taken up and Mrs Theodore Suess addressed the Council alleg- ing unfair enforcement of Ordinance No. 271 relating to the sale of raw and uncooked meats, claiming that one dealer was not complying with the closing features of the ordinance. The Mayor directed that Mrs Suess' complaint be considered later in the meeting under "New Business" Mr John H. Kundert, conducting business at 15 pest Pine Street asked that he be allowed to park his delivery truck in the alley on the side of the premises occupied by him. No objections were offered to the applications of Union Oil Company for service station driveways on the Northeast corner of Oak & Church Sts and on the Southwest corner of Locust Street and Cherokee Lane. In the matter of the application of David Melcher of 209 S.Crescent Avenue for a varience permit to allow encroachment on a rear -yard area, the Council directed that such variance be issued as the lot was so sit- uated that no damage to existing properties would ensue and the encroach- ment would be so slight that the purposes of the zoning ordinance would be practically preserved. The application of Mitchell & Koenig for a use permit to allow con- struction of a building for automobile storage at 208-210 West Pine St. was referred to the City Planning Commission in accordance with the prov- isions of Ordinance No 238. A�plicatioas for business licenses from Jerome Evans, Awnings, W.G. Clemings, Upholstering and Aden J.Rott, Watkins Products were allowed and licenses ordered granted on motion duly made and carried.. Specifications for Police Radio Equipment as prepared and submitted by City 7ngineer Clinton Senning were approved, adopted as such and adver- tisement directed by the adoption of Resolution No. 1080 passed by unan- imous vote of all members of the City Council. Claims as approved by the Finance Committee in the emcunt of $26407.22 were allowed and warrants ordered drawn in payment thereof on motion of Councilman Graffii;na, seconded by Councilman Aeihe. (minutes of June 4,1941 continued) 2 5 t IL H -E?S -- __ CC 7.CT_L CITY HALL -- 07-F LCDI ,lt this time, the Council took under consideration the matter of the complaint of 1'.rs Theodore Suess in regard to the enforcement of Odin Rance No 271, particularly as it a -plied to members of the Seventh Day Adventists Church engaged in the business of selling uncooked meats. The Mayor dir- ected that the police enforce the provisions of this ordinance and that the Co -ai.ttee of the Council on public Health and Safety observe the result of such enforcement to determine if sentiment demanded repeal or enforce- ment of the ordinance. John Vitschke again acdressed the Council in regard to owning Olive Court from California Street to Pleasant Avenue but it appearing that there was no co-operation between parties at interest, no action could be taken. On recommendation of Councilman Bull, the Lake Park was thrown open to motor -boat owners on one evening each week for a trial period of one month, the existing 5 LIPH limit on these craft to be lifted on such eve- nings.
