This regular meeting of the City Council of the City of Lodi was
called to order by the Mayor at 8:00 o'clock P.M. on the day and at the
place first above written, Councilim n Bull, Graffigna, R1.7gs, "leihe and
Steele present, none absent.
The minutes of the last meeting held April 2, 1941 were read,
approved as read and so endorsed by the Mayor.
This being the day, place and hour set for the opening of bids
for the construction of a refreshment stand at Lake Park, and the Clerk
presenting a proper affidavit of publication of -notice thereof, the Council
proceeded to publicly open and declare the bids received, the same being as
follows:
Fred C. Bender, 323 N. Stockton St. ........... $ 3,483.00
Hieb Brothers , 428 N. School St . ............. 2,481.00
it appearing that the bid of Hieb Brothers was the lowest and best
bid received, award of contract was made to them by the adoption of Resolution
No. 1074, introduced by Councilman Graffigna, Weihe second, and passed by
unanimous vote of all members of the City Council.
At this time, Firs Chief Earl May presented Mr Theodore Sanguinetti,
County co-ordinator in the National Defense Program, who a3dressed the Council
on the necessity for planning for interchange of fire -fighting equipment between
communities. The Council expressed its willingness to cooperate in the plan
when legislation now pending would provide ways and means to permit it.
..:r B. "1. Fuller presented a tentative summer program prepared by
the City Recreation Commission, calling for the expenditure of:
415.71 for equipment
$ 390.00 for supervisor's salaries
$ 644.00 for director's salaries
$ 1449.71
11r Fuller stated that the above amount would be reduced by $644.00
id the services of W.P.A. directors could be obtained from the Federal Govern-
ment. Action on a7proval of the Commission's budget was deferred until later
in the evening.
Messrs S.T.Koontz, Williem Radtke and John Nietschke asked that the
Council take proceedings to open Olive Court from California Street to Pleas -
and Avenue, stating that there was but one dissenting owner as each of them
were willing to donate land necessary for the street. At the order of the Mayor,
this matter vas referred to the Committee on Streets for report at the nest
Council meeting.
qtr Edgard Hutchins asked that the Council declare its position in
regard to the opening of Sunset Drive in Hutchins Homestead No. 3. Council- p
man Otto A. Weihe, Chairman of the Street & Highway Cocaittee,stated that
a meeting had been had with Mr Hutchins by that Committee.;!.r Hutchins had
requested extension of electric service to lots west of Fairmont Avenue, use d
of City forms for curb and gutter and the grading of Sunset Drive north of
Walnut Street. On motion of Councilman Bull, Riggs second, the City Engineer 4��
was directed to prepare plans and specifications for curbs, gutters and c a
drainage structures on Sunset north of Walnut Street, all installation work, F
except on storm drains to be at the expense of the property owner.C�
Yr O.B.Stevens asked Council action in the matter of the opening
of Cypress Street, formerly Spinach Street, and the City Clerk presented
a tentative plan for assessment of property owners to accomplish this purpose.
On motion of Councilman Bull, Graffigna second, the Clerk Aas instructed to
submit the plan to affected property owners and report results to the Council.
Mr Joe Adcock appeared in regard to his application No. 273 pending
before the Council, for license to vend ice-cream from street carts, stating
that he would secure a permanent place of business as soon as the application
received favorable attention. He was informed that the application world have
to take its statutory course.

Departing from the regular order of business, end on motion of
Councilmen Bull, Weihe second, the Council approved the program of the
City Recreation Commission to cover a period of 12 or 13 weeks at the
expense stated in the application made earlier in the evening.
Dr W. H. Crosswhite solicited an appropriation from the City
_ toward the expenses of the Junior Traffic Patrol and on motion of
Councilman Graffigna, Weihe second, the sum of $25.00 was ordered
allocated toward the purchase of equipment for the patrol.
On motion of Mayor Steele,'Graffigna second, the Clerk was
directed to communicate the desires of the City Council to James E.
Thorpe, Assemblyman and Bradford S. Crittenden, State Senator on the
following legislation now pending in Sacramento: The Council's
opposition to AB 1970 and its companion measures AB 371 and 372 in
regard to the time for filing notice of claim against sixth -class
cities; its o:•position to AB 270 seeking to repeal the "prima-facie"
parking tag law; its opposition to the mandatory police tenure bill,
AB 501; against SB 110 relating to annexations of territory; against
SB 1802 making a 72 hour week mandatory for firemen and against AB2258
requiring incineration of garbage.
Mayor Steele, a member of a Council Committee to secure and
place a memorial plaque on or near Pioneer Oak in the Stadium grounds
recommended that the plaque be placed on a stone block on one of the
stadium ramps. No o,:. -position offered.
On motion of Councilman Bull, Riggs sedond, the City Engineer
was authorized to contact soil conservation experts in regard to obtain-
ing plant coverage to stabilize the stadium walls.
A refund of $1196.18 on compensation insurance accompanied a
letter from the State Compensation Fiend congratulating the City on its
safety record which had enabled the above as a dividend representing
32�% of premiums paid in the fiscal year 1939-40.
The Division of Highways requested that the City present its
budget for the 1941-43 bi-ennium. Referred to City Engineer and City
Clerk.
On motion of Mayor Steele, Riggs second, the City Engineer was
directed to prepare specifications for installation of two-way, frequency
modulated police radio and repeater station.
On motion made and carried, the Clerk was directed to serve an
abatement notice on the owners of the old de -hydrator property on North
Main Street as being a common nuisance.
Ordinance No. 272, amending Ordinance No. 221 relating to license
taxes was ordered laid over as no meeting had been had with the committee
from the Retail Merchants Bureau of the Chamber of Commerce.
The City Engineer was directed to prepare an application to W.P.A.
for construction of storm drains acid 'sanitary sewers for submission to the
City Council. This was done on motion of Councilman Bull, Riggs second.
The City Engineer, on motion of Councilman Riggs, Bull second, was also
directed to prepare specifications for filtros plates at the Sewage Disposal
Plant, under which advertisement would be had later.
The Clerk submitted business license applications Nos 268 _to 273
inclusive. All were granted except #1832 and #1834, which being new business
and not renewals, were ordered to take the course prescribed by ordinance.
The Clerk was directed to advertise for sealed bids on a truck for
the department of public utilities and for the water and sewer department in
the form presented by the Superintendent of Public Utilities
On motion of Councilman Ball, the Council then adjourned.
