This regular meeting of the City Oouncil of the
City of Lodi was called to order by the Kayor at 6:00 o'clock
P.;,;. on ';ednesday, December L, 1940. Councilmen Bull,
Graffigna, Riggs, ++eihe and Steele present, none absent.
The minutes of the last meeting held `november 20,
1940 were read, approved as read and so endorsed by the tayor.
No persons appearing the order of Public nearir_gs
was passed and the Council proceeded to take up the regular
order of business.
This beir_g the day, place and hour to which the
'nearing scheduled to be heard kovember 20, 1940 had been
postponed and no -persons appearing to protest against
the oroposed amendments to Ordinance iio. 238 as set forth
in said notice, Resolution No. 1061 was introduced on
motion of Councilman Graffigna, seconded by Cour_ciL*nan
S.e!he 'read at length by the Clerk and finally passed and
adopted by the assenting votes of all members of the
Council.

74FEREAS, after report and recomr._endation of the
City Planning Corumission, this City Council of the City of
Lodi did, en the 15th may of October, 19L-.0, order and direct
the City Clerk to publish a Notice of Hearing to be held
before this City Council begin in; at 8 o'clock P.1:. of
;4ednesday, ::ovember 20, 191;0 on this City Council's intention
to amend Ordinance 'No. 236 of the City of Lodi (Zoning
Ordinance) in the particulars set forth in said notice, a
co_y of said notice being annexed hereto and made part
hereof as Is set forth in full therein_, and,
'AHEREAS, on the day and at the hour set for
hearing, the Clerk produced the affidavit of Lynda Buchmiller,
the zrincipal clerk of the Lublisher of "The Lodi Times",
the newspaper of general circulation_ in which official
notices of this City are published, dated November 19, 19L;0
wherein it was stated that publication of said notice was
had on November 9, 16, 16 and 19, 19L0, and,
a,! -REAS, no persons appeared at said hearing either
in person_ or by writing, and this City Council then adjourned
said hearins to and until the hour of 6 o' clock P.1- of
'ivednesday, December L_ 1�-lr0, at which tiir_e no :rotests were
file.-; or presented, noir therefore,
BE IT RESOLVED, that this City Council herein finds,
determines and declares that the said Notice of hearing was
regularly published in tir..e, form and r.:anner as required by
lair and ordinance and by direction of this City council;
furthermore,

BE IT RESOLVED, that this City Council hereby finds
that no objections, oral or written, were ,resented at
said hearinn- or at any postponment thereof, and that this
City Council now has jurisdiction to amend said ordinance
in the rticulars set forth in said '.otice of rearing.

After the adoption of the foregoing Resolution,
Ordinance No. 270, entitled "A1'' CRDI'•,A':CE Ai:E iDATORY AHM
SUF--=,'E . TARY TO O?LINA.:CE r.0. 238 (ZO_YI"—' ODI •-A= CE)" was
introduced on notion of Councilman. Graf'igna, seccr_ded by
Councilnar_ '+;eine and read at length b3 the Clerk and ordered -
laid over until the next regular meeting of the City Council.
The CarpenterTs District Council of San Joaquin
County notified the City Council that the union schedule
of wades in San Joaquin County beginning January 1, 1941
would be at the --ate of ;,1.18 3/4 per hour.
The Lodi Civitan Club reco._-erded the re-
r.nointment of ':[r. ::enneth Lobaugh to the Recreation
Commission. At the order of the ..Iayor the matter arras laid
over until the next r�azlar r;eeting.
The reports of the Chief of Police and of the
ound-iaster for the month of :o-;er.:ber. vrere received, read
and ordered filed.
Two notices of ap:lication for alcoholic beverage
licenses were received from: the State Board of Eeualization.
Lusiness license aprlications !o. 1213 to 0 1218
inclusive were read and licenses ordered granted.
'r. Clinton er_ninj was reappointed City Engineer
for the calendar Tear 1941 by the adoption of Resolution
+o. 1062 and +,:r. Teras Tenn ,est as reappointed City Attorney
for the same period by the adoption of Resolution No. 1063.
Both resolutions :vere adopted by the following vote:

In the matter of the securing of easements along
the orth and mouth center line of Section 11, Tarr, R6E,
the Clerk was instructed to accept the easements secured
and the City Attorney was directed to instigate condemnation
Proceedings against non -consenting property owners on motion
of Councilman mull., seconded by Councilman Graffigna.
Ellis in the amount of X27,189.60 as approved by
the finance Cocaittee were allowed and warrants -ordered drawn
on :notion of Couacilnan Sraffigra, seconded by Councilman 'Weihe.
At 8:45 o' cloc's P.,. the Council was called into
executive session by the ::ayor and so continued until 9:45
o`clock F.2.:. ',',hen it returned to regular session and on motion
of Councilman ::raffiona, seconded by Councilnsan ,eine, the
following char_ -es in the payroll were directed effective
December 1, 19 0.

shall exceed 5' per actual mile traveled.
All other 'salaries and wages, e::cepting those
above mentioned, shall remain as at present.
