Pursuant to the provisions of zoection No. 9918 of
the Elections Code of this State, the City Council of the
City of Lodi met at 8:00 o'clock P -M. on Monday, the 15th day
of April, 1940, Councilmen Clark, Graffigna, Weihe and Steele
present, the latter presiding. Oouncilman bpooner was absent,
being called from the City on urgent business and the Clerk
read a letter from iMr. Spooner expressing his regrets and
congratulating the Conncilimen elect.
The minutes of the last meeting of the Council
held Avri 1 3, 1910 were read, approved as read and so endorsed
by the Mayor.

Mr. john A. Henning, Superintendent of Public Utilities
addressed the Council by letter in regard to the purchase of
;materiais for the pumping plant and connecting, .rater line
now under way in the southwest corner of the Lake Park land.
On motion of Councilman. Graffigna, seconded by Councilman
Weihe, bur. Henning vas authorized to expend approximately
X15,000 for piping and $3,300 for pump and motor.
Claims No. 35305 to and including No. 35329 in
the total amount of X193.75 were allowed and ordered paid
on motion of Councilman Graffigna, seconded by Councilman
Clark.
This meeting being held on the first londay
following the date of the general municipal election of
April 9, 191,0, the City Clark presented his report of the
election together with the returns received from the five
precincts and the ballot box containing the absentee voters'
ballots. The Council was then resolved into a canvassing
board and after canvass of the returns received from the
precinct election officers, the ;Mayor appointed Councilman
Graffigna and councilman Clark tellers and proceeded to
canvass and declare the absentee vote. On completion of the canvass of
the votes cast as aforesaid, Resolution No. 1V44 was
introduced on motion of Councilman Graffigna, seconded by
Councilman Weihe.

RESOLUTION DECIARIYG RESULT OF ELECTION
WHEREAS a general municipal election was held and
conducted in the City of Lodi on Tuesday, the 9th day of
April, 19LO as required by law,
AND `:=HEAS, it appears that notice of said
election was duly and legally Given, that voting precincts
were properly established, that election officers were
appointed and election supplies furnished, and that in all
respects said election was held and conducted and the votes
cast thereat received and canvassed, and the returns thereof,
made, determined and declared in time, form and manner as
required by the general laws of the State providing for and
regulating municipal elections in cities of the fifth and
sixth class,
AP;D 's:=:EREAS, the City Council of said City of Lodi
met at the council chamber thereof on Ulonday, the 15th day
of April, 1940 to canvass the returns of said election and
install the newly elected officers; and whereas the council
finds as a result of said canvass that the number of votes
cast, the names of the persons voted for, and other matters
required by law, to be as hereinafter stated, now therefore
it is hereby

P.ESOLVED, determined and declared as follows:
That said regular mu:_icipal election was held
and conducted in the City of Lodi, California on Tuesday,
the 9th day of April, 1940, in time, form and manner as
required by law.
That there were five voting precincts established
in said City, for the purpose of holding said election, as
follows:
Consolidated Voting Precinct A. consisting of
State and County election precincts numbers 1, 2, 3, 6 and
7 as established for holding; state and county elections;
Consolidated Toting Precinct b, consisting of
State and County election precincts numbers 4, 5, 8 and 9
as established for holding State and County elections,
Consolidated Voting Precinct C consisting of
State and County election precincts, 10, 11, 13 and 19
as established for holding State and County elections;
Consolidated Voting Precinct A consisting of
State and County election precincts numbers 12, 14, 15 and
16 as established for holding State and County elections,
Consolidated Voting Precinct E consisting of
State and County election piecincts, numbers 17, lb and 20
as established for holding State and County elections;
That the whole number of ballots cast in said
City of Lodi at said election was 21U8;
That the names of the persons voted for, the
officers for which they were voted, the number of votes
received by each of said persons in each of said precincts,
together with the whole number of votes which they received
in the entire city, are as follows:

RESCL`II:D, therefore, that Et said general municipal
election held in the City of Lodi, April 9, 1940, the following
persons were elected to the following offices, respectively;
Clifford B. Bull was elected a member of the city
council for the full term of four years from and after
,aonday, April 15, 1940 and until his successor is elected
and qualified;
Vii. E. Higgs was elected a member of the city
council for the full term of four years from and after
?Monday, April 15, 191+0 and until his succecsor is elected
and qualified;
J. F. Blakely was re-elected as City Clerk for the
full term of four years from and after Ylonday, April 15, 1940
and until his successor is elected and qualified;
J. Hamilton Davis, was re-elected as City Treasurer
for the full tern of four years from and after b.onday,
April 151 1940 and until his successor is elected and qualified.
The foregoing Resolution No. 1044 was then passed
and adopted by the following vote:

On motion of Councilman Clark, the City Council
then adjourned sire die.

Monday, April 15, 1940.
Immediately following the a^journment of the
Cit; Council as above stated, the City Clerk announced
that he had previously taken the oath of office and called
the Council to order, administrating the oath of office
to the new councilmen elect, Mr. Clifford B. Bull and Mr.
1. E. Riggs.
Nominations for Mayor were then declared in
order, Councilman Steele nominating Coincilman Bull, who
declined the nomination. Councilman Weihe then nominated
Councilman Steele to succeed himself as Mayor of the City
and there being no other nominations, °.=r. Steele was
declared elected and opened the Meeting.
The Clerk stated that the City 'Treasurer and
ex -officio tax collector had been sworn in previously.
The City Clerk stated that a cor:plaint had been
filed with him by G. P. Ohlinger living four miles South
of Lodi that lye solution dumped into the Woodbridge
Irri?ation Canal by the roster and +good Cannery was
contaminating his land. City PIngineer, Clinton Henning
stated that he had made a slight investigation and that the
cannery was evidently allowing about 1100 gallons per day
of alkali solution to go down the storm sewers but what
its effect would be on the land he could not say. Further
investigation was left in the hands of the City Engineer.
Euilding Permit Application No. 2713 on appeal
from the City Building Inspector was discussed and the
building inspector directed to enforce the State Housing
Law which was being violated under this application.
Application No. 2715 for the construction of a
brooder house in Burr's Addition was denied and application
No. 2721 for a sign near Hutchins Street was ordered
referred to the City Planning Commission.
Several notices of application for liquor licenses
all being for extensions or change of ownership in present
premises were received from the ztate Board of hqualization
and no objections offered.
0. F. Kiaffke, E. A. Hurrle and Carl buster each
applied by letter for the appointment as caretaker at the
stadium.
On motion of Councilman V,"eihe, seconded by
Councilman Graffigna, the Clerk was directed to notify the
State Division of Highways that the City desired to accumulate
its second quarter cent gas funds for future expenditure.
The Mayor then made the following appointments of
members of standing committees of the Council.
