This regular meeting of the City- Council of the
City of Lodi met in regular session at 8:00 o'clock F.M.
on the date first above written. Councilmen Clark,
Graffigna, Spooner, ;:eihe and Steele present, none absent.
The minutes of the last Meeting held August
1, 1L38 were read, approved as read and so endorsed by the
! ayor.
Attorney Prank A. Henning again appeared before the
Council asking that the Council do not pass the contemplated
camp ground ordinance until it should have been adopted by
the Board of Supervisors of San Joaquin County. Mr. Henning
stated he was authorized by Lr. Elmer Hirst and Mrs. Fannie
Smith to make the proposal, that, should the Council not
pass the contemplated ordinance, they, Hirst and Smith
would agree to go out of the camp ground business at the end
of 1940. Lr. Henning stated that they needed this additional
time in order to recoup upon their- investments. 'Mr. Robert
Rinn who represented several property owners affected by
the presence of these two camp grounds asked that the
ordinance be adopted at once. The Mayor stated that action
would be taken under the proper heading later in the meeting.
I::r. Dempsey D. Smith, Secretary -}Manager of the
Lodi District Chamber of Con'erce asked that the City
provide labor to install lights in the grape booth for the
coning Grape and Vine r'estival and also that the City furnish
electricity for lighting. This was approved on motion of
Councilman Spooner, seconded by Councilman lie: -he.
The Clerk was authorized to enter into an
agreement for termite proofing of both fire houses at a
cost of $63.00 with the understanding that the contract
give a five year guarantee of this work.
A proposal submitted by Ir. L. F. Scattergood,
of the 6ureau of Light and power of the City of Los Angeles,
that the City contribute the sum of 32 per meter to
"Industrial West" for the purpose of installing a large
industrial relief map at the Golden Gate International
Exposition was ordered tabled but the proposal was referred
go the Secretary of the Chamber of Comr-erce for investigation
as to its nerit.
The Clerk read a notification of application of
Otto Barth, et al for a liquor permit at the Log Cabin
situated at the corner of Cherokee Lane and the San Andreas
Highway.
A communication was received from 'kalter B. Hogan
calling the attention of the Council to the coming conference
on Highway Safety to be held in Los Angeles in September.
The City Cleric submitted his annual report of
the financial transactions of the City and was directed to
have it printed in full in the Lodi News -Sentinel.
One application for business license No. 5!9
was ap_roved and license ordered granted.
The claim of Helen Etherton for damage done to
clothes caused by oil spray not allowed on August 1st was
referred to the City Clerk with directions to obtain the
best settlement possible.

P_ letter from lir. J. F. Bauermeister, l,:inister of
the Saint Peter Lutheran_ Church in regard to the exposure
of the South face of the City _'Hall to the su:mner sun was
read and no action taken.
On ruction of Councilman_ Spooner, seconded by
Councilman V:eihe, the Clerk was directed to renes: the city's
liability and property damage insurance policy with the
J. S. L:ontgorcery Company for the coming year. City Attorney
Glenn best asked that the provisions of the policy be
classified so as to plainly include the City's liability when
acting in a proprietary capacity.

-n the amount of �9,611.c5 as approved by the Finance
Comr.ittee were allow6d and ordered paid on motion of
Courcilnan Clark, seconded by Councilman :".eihe.
Councilman Graffigna stated that the Chief of the
Fire Department would like to meet with the City Council in
regard to the needs of the depsrtmert. He was directed to
advise the Chief that time would be set aside for this
purpose after the next regular meeting of the Council.
Mayor Steele called attention to the water•-
loE ed condition of the boat landings at the Lake Park and
after some discussion it was decided to let the matter stand
until the water would be drained from the lake next fall.
•'+ayor Steele also reported on the status of the
complaint of August Lippert in regard to the kennel of dogs
kept by one Smith on the old Boehmer -Place.
Fred tin. Post, tanager of the City Sewage
Disposal Plant asked for the services of another operator
at the nlant. Pio action taken.

Jure 20, 1938 was brought up for final passage and adoption
on motion of Councilman 'Graffigna seconded by Councilman
Y:eihe and a vote being had on the motion, the ordinance failed
of ado -,tion by the f ollovingvote:

Szooner and Steele
ABSE ;^: Counciln_en, None.
The foregoing proceedure in regard to Ordinance
Ido. 2ll4 was taken on the advice of City Attorney Glenn West

of the title as above set forth, further reading of the body
of the ordinance was waived by unanimous vote of all members
of the Council as copies of the proposed ordinance had been

The City Clerk and City Attorney were authorized
to attend the annual convention of the League of California
Municipalities to be held in Santa Barbara September 6th
to 9th. No further business appearing the City Council
then adjourned to the day and date of its next regular
meeting.
