CO'' CIL C! A,:3ERS CITY CITY HALL - CITY 0LCOS WEDNESDAY, SEPTEMBER 5TH, 1945 1 The City Council of the City of Lodi met in regular meeting at 8:00 o'clock P.M. (P.W.T.) of Wednesday, September 5, 1945. Councilmen W. J. Coffield, W. E. Riggs, Harry J. Tolliver, Otto A. Neihe and Robert H. Rinn,(Mayor), present. Also attending: Glenn West, City Attorney, John A. Henning, Superin- tendent of Public Utilities, Clinton Henning, City Engineer, George D. Polenske, Fire Chief and C. S. Jackson, Chief of Police together with representatives of Lodi Post 22, American Legion, Veterans' Service, Lodi Motorcycle Club and Lodi City Employees Association. Minutes of the last regular meeting held August 15th, 1945 and of the adjourned meeting therefrom held August 16th were read, approved as read and so endorsed by the Mayor Lodi Post No 22, American Legion filed a written application for use of Lodi Stadium for the evenings of September 22 and 29 together with a copy of a proposed contract agreement between C.E.Baker and Billy Hunefeld and the Legion Post for the conducting of "midget auto races" on these dates. Veterans' Service made application by submission of an executed contract for use of the Stadium for motorcycle races, naming Al Lauer and Lodi Motorcycle Club as parties to conduct these races. Tentative dates for motorcycle races to be September 26 and October 3, Ezra Ehrhard of Lodi Motorcycle Club asked positive allocation of the date on Septem- ber 26. After discussion of the difficulties of maintaining track for these two sports, each of which requires a different kind of track, the Council offered September 22 and Cctober 12th or 13th to the Legion and September 26th and October 3 to the Veterans' Service. Messrs Randolph & Webb of the Lehion expressed acquiesance. Oral applications were then presented from both above organizations and from Oscar Dittmanson for allocation of the Stadien tracks for 1946. Mayor Rinn stated that this was another matter and that it would be well for all applicants to prepare their 1946 program early and present it to the Council together with other information as to accounting for receipts, disbursement of proceeds and evidence that the sponsoring body had substantial interests in such proceeds. Archie Closson, having filed an application in writing signed by himself and Lauren E. Wilkinson on behalf of Lodi Grape and Wine Festival Association requesting use of a part of the "hard ball" field in Lawrence Park for a carnival to run five days frau Sept- ember 12th, addressed the Council in furtherance of this application. On motion of Councilman Weihe, Coffield second, permission sought was granted, it being understood that all damage to property and utility bilis would be paid the City by the Association. PUBLIC PROCLAMATION NO 24 from Headquarters Western Defense Command was received. This proclamation removes all restrictions on the movement of aliens on the Western coast. Mrs Thirza M. Cole of Mason Hospital filed a written complaint against night-time and early morning noises arising from a milk trucking establishment and from street cleaning gangs. The City Clerk was directed to notify E.W.Tretheway of the milk company to cease these noises and the Foreman of Street Sweepers being in the Council Chamber, he promised to give attention to that part of the complaint directed against his men. State Board of Equalization notified the Council of the intended trans- fer of the beer and wine license of Kark Fischer from 606 S. Central Ave. to 35 N. Sacramento St. Reports of the Chief of Police, the City Poundmaster and the City Clerk for the month of August were received, read and ordered filed. UNFINISHED BUSINESS - LOT 3,BLK 1 WELISWOOD PUBLIC LIABILITY -a1;7Te xvr. Sale of the South 15 feet of Lot 3, Block 1 of Wellswood Park was authorized provided that Jacob Kessler, the intending purchaser granted the City an easement over the North 10 feet of Lot 4. The price of this parcel to be at least $200.00. On motion of Councilman Coffield, Riggs second, renewal of the present general liability policy with Home Indemnity fot three years was authorized provided premium charged was comparable to present premium. 2 COU'ICIL CHAMBERS CITY COU.XIL CITY HALL - CITY OF LODI (Minutes of Sept 5,1945 continued) NEW BUSINESS - License matters - On recommendation of the City Engineer that BUSINESS Kosao Tamura had made substantial compliance with the building LICENSES laws, his application for a license to conduct a rooming house at 4 North Main was granted,•it to be understood that this K. TAMIRA license did not apply to the building is the rear of this concrete structure, which latter had been condemned for human habitation. I In the matter of the employment of an Assistant to the City Engineer, it was directed on motion of Councilman Co£field, APPOINTS ME OF seconded by Councilman :?eine, that the City offer Mr A. C. AN ASSISTANT Heckenliable of Richland, Washington, the only qualified - CITY &GINEER applicant, a temporary employment at $350.00 per month for ninety days, permanent employment to depend on his qualify- ing for the position under the terms of the rules of the Department of Personnel. Applications for licenses from L.P.Singer, Contractor, James .' NFN A. Tay+&or, Photo Service, Justus W.Brand, Contractor, Maurice APPLICATIONS N.Christopherson, Cgntractor and John P/ Jeleti, Merchant were presented and ordered to take the course prescribed by ordinance. CLAIMS The resignation of Spencer C. Joerke, Police Patrolman, was PESIGNATION OF read. Chief Jackson was authorized to obtain the services of JO -;M. part-time temporary police officers , he having been unsue- cessful in obtaining men from the existing eligibe list. It was suggested to Chief Jackson that he have the Personnel P.G.& E, Clerk again endeavor to obtain applicants. CONTRACT A delayed application for sick leave accompanied by the cert- CLAUD ALLEN ificate of a licensed physician was received from Claud Allen. SICK LEAVE It appearing that Mr Allen had 42 days accrued sick leave, it was directed that he be allowed this leave with pay computed from July 11th, the date on which he would be due to return to work from annual vacation, any further leave without pay to be subject to'his applying for the same. _ A letter signed by 46 city employees claiming an injustice to other employees in the increases in pay allowed the clerks COMPLAINT OF in the City Clerk's office on the City Clerk's recommendation 46 Employees. was read and Mr G.D.Polenske of the City Employees Association addressed the Council in explanation thereof. The City Clerk was instructed to answer this complaint and set forth the reasons applying in this instance so as to clear up any mis- understanding. On motion of Councilman Coffield, Weihe second, the City PURCHASE OF Engineer -was directed to purchase the Federal Pumping Unit C.D.FIRE EQT, and accessories now in custody of the local Property Officer of the Department of Civil Defense at a price of $482.91 Claims in the total amount of $ 35,499.62 as approved by the CLAIMS Finance Committee were allowed and ordered paid on motion of Councilman Weihe, Riggs second. At this time, the Council again entered into discussion and consideration of the five year term contract offered by Pacific Gas and Electric Company, particularly as to the P.G.& E, position in which the City would be placed before the State CONTRACT Railroad Commission at its hearing in San Francisco on Sept. 13th if it had not executed this agreement. Mr Roy Strum, _ Local Agent of P.G.& E, argued that, if the City was signat- ory to the contract, together with other cities to whom it had been offered, his Company would be necessarily support- ing the offered rate, but, if the City had no signed contract and appeared as an objector to its terms, his Company would, perforce, be in opposition to the granting of the new rate to any municipal power user not bound by the five year term. Discussion continued until midnight when Councilman Coffield, seconded by Councilman Weihe, moved the adoption of Resolution No 1238, directing execution of the offered contract and also directing the City Attorney, City Engineer and Superintendent 3 COUICIL CHA7,3-rR3 CIT'. This resolution was then adopted by the Res. 1238 following vote: AYES: Councilmen_, Co£field, Weihe and Rinn - NOES: Councilman, Tolliver NOT VOTING: Councilman Riggs.
