Public Hearings - This being the place and hour set for hearing on the appli- cation of Ruth and Joice Osberg for a varience from the strict VARIENCE OF application of the provisions of Ordinance No. 238 relating to OSBERG required side yard space at 1320 S. Pleasant avenue, proof of due ED GRANT- publication of notice was had and on a call for objections, none were offered and it was then ordered that this application be granted; motion Councilman Riggs, Haskell second. This also being the place, day and hour set by Resolution No. 1286 adopted November 6, 1946 for the reception of sealed bids OPENING OF for furnishing one or more 100 H.P. Deepwell Pumping Units, proof BIDS ON of publication of notice was made by affidavit, the Clerk reported PU,IPING that no proposals had been received by him in response to notice. UNITS It was then ordered, on motion of Councilman Haskell, Lytle second, PEADVERTI53- that readvertisement under the same specifications and similar LENT ORDERED. notice be had, bids to be returnable by 5.00 ?-M. of January 15, 1947. Communications, Notices & Reports - State Board of Equalization notice of the intended transfer of the liquor license at 122 N. Sacramento St, received and read. Lodi Smit, aircraft Owners and Pilots submitted the following list of representatives to serve with appointees of the City AVIATION Council on an Aviation Planning Cor::mission to be established: PLA-NIMING F.S.Van Arsdale, Clifford Gatzert, Harold F. Roush, Den B. Yood Coi3aSSION and R. D. McClure. This recommendation was approved but further action deferred until definite information as to the powers,duties and functions of such a Commission could be ascertained. Cn report from the City Planning Corrraission, the application VARIENCE OF of William Hildenbrand, 341 Palm Avenue, for permission to encroach ftILDENBRAND on the rear yard space at that address with an accessory attached garage was set for hearing at 8:00 P.M. of January 2, 1947. Monthly reports were received and read from the Chief of DEPORTS Police, the City Poundmaster and the City Clerk. City Engineer Henning reported on the work of his office during the month of November. The City Clerk presented a signed option agreement with Columbus Vaccarezza and wife for the purchase of forty-five acres north of OPTION FOR the Mokelumne River and easterly from the Central California ?LrXHASE OF Traction Company right of way as prepared by the City Attorney. DUMP GROUND The City Clerk was directed to write the Board of Supervisors in regard to the obtaining of rights of way and the improvement of a public road leading from�Dougherty Road to the proposed site. Mayor P.inn and City Attorney 7test explained the effect of two recent California Appelate Court decisions and the provisions of Section 800 et seq of the Health and Safety Code that made it necessary that the local Board of Health be the examining body. J.F.watson, a state licensed contractor, submitted a proposal RES 1293 for the laying of the pipe for the Sacramento Street Industrial ADOPTED Aaste Drain, a job on which the City had been unable to obtain SAC ST IND bids by legal advertisement, and it was ordered that this proposal VASTE DRAIN be accepted by the adoption of Resolution No. 1293 introduced by PIPE LAYING Councilman Riggs, Haskell second and carried by Ananimous consent. The same J. F. Matson also submitted his proposal to lay the pipe for the portion of Unit 1 of Pipe Line 1 of the Main Line Sewer RES. 1294 Outfall, a part of the work on which bid received had been rejected ADOPTED by Resolution No 1288, adopted November 20,1946 and also not FOR WIT i OF covered by the agreement with J. L. 'debater. This proposal being PIPE LINE 1 the only way to continue with this urgent project, it was accepted PIPE LAYn1G by the adoption of Resolution No. 1294, introduced by Councilman Tolliver, Lytle second and carried without dissenting vote. LODI Lodi Garden Club submitted a plan for a flower bed in front GARDEN CLUB of the City Hall and permission to put in the same was granted. Business License Applications of November 20th having been BUSINESS approved by the Chief of Police were ordered granted, applications LICENSES filed since that date were read and ordered referred to the Chief of Police in accordance with ordinance. Claims in the amount of $39050.69 as approved by the Finance CLAIMS - Corani.ttee were approved and ordered paid and additional sums in the aggregate 36 453.26 ordered paid on the City Engineers certificate by the following three resolutions adopted without dissenting vote: Resolution No. 1295 ordering payment on certification of RESOLUTION 1295 completion of the City Engineer for gutter work in an alley (1.WEBSTER) in Block 18, Mokelumne to warren ;Vebster of $474.60 introduced by Councilman Riggs, Tolliver second. Resclution No. 1296 ordering payment of $4 472.26 to Claude C. Wood for balance due on alley and street work contract P.ESCLL'TION 1296 awarded in august, less $625.00 witheld disputed items. Resolution No. 1297 transferring the sum of $1 506.40 from PWSOLUTION 1297 General Fund to City Clerk's Revolving Fund for disbursal to TP.:NSFERRING Contractor J. L. debater in amounts certified as due by the $1 506.40 City Engineer on account of pipe laying on outfall sewer. Chief of Police Jackson addressed the City Council in favor of the a?plication of Patrolman Avery E. White for leave of absence 3'IHZTE for twenty days without pay, stating that White had twelve days LEAVE vacation time, twelve days overtime and nine holidays due him with pay. Application ordered granted. Motion Haskell, Riggs second City Attorney proceed with actions to condemn sewer line rights of way after making offer of $800 per acre_for land taken plus any damage to special crops, such offer to obtain until noon of December 13, 1946. Motion carried without dissenting vote.
