HomeMy WebLinkAboutMinutes - November 13, 1946102 COUNCIL CHAMBERS CITY COUNCIL CITY HALL - CITY CF LODI WEDNESDAY, NOVEMBER 13, 1946 Pursuant to the adjournment taken from its regular meeting of November 6, 1946, the City Council of the City of Lodi met in adjourned regular session at 8:00 o'clock P.M. of Wednesday, November 13, 1946. Councilmen Haskell, Lytle, Riggs, Tolliver and Rinn present, none absent. Also attending City Engineer Henning, City Attorney West, Superintendent of Utilities Killelea. About twenty master plumbers and journeymen plumbers were present in response to the Council's invitation for discussion of proposed amendments to the " Plumbing Code " presented by the Master Plumbers Association. Minutes of the last meeting held November 6th were read by the Clark, approved as read and so endorsed by the Mayor. PUBLIC H..:1RINGS - At the direction of Mayor P3nn, proposed Ordinance No.331, relat- ing to plumbing and drainage work was brought up for discussion, the Mayor stating that the principal interest of the City Council was that a sound set of regulations be embodied in the proposed plumbing code; that the effect of a court decision in Horwith vs Fresnobe evaluated and that the proposed ordinance conform to the State Health and Safety Code. Mr Conrad Dietz, spokesman for the Master Plumbers contended that the Fresno case applied only to state licensed contractors and not to the men who actually performed plumbing work and urged that the provisions of the originally proposed ordinance relating to PLUMBING the examination of plumbers be retained. In answer to the content - CODE ion that the Board of Examiners as constituted in his original CONSIDERED draft might bar some qualified plumbers, Dietz stated that it was intended to blanket in those now in business in the City without a qualifying examination. At 9.34 P.M. the Mayor terminated discussion on this ordinance, asking the opinion of the group on the following points: (1) Retention of the Board of Examiners and Examination of Master Plumbers and Journeymen Plumbers for Certificates of Compet- ency. This apparently met with unanimous approval. (2) Substitution of " Standard Gas Code " in modernized form for the provisions of Part 2 of the proposed ordinance. This also was approved. (3) Imposition of a license fee of $100.00 per year for Master Plumbers. Approved on a vote of 10 for and 2 against. (4) Imposition of a $25.00 annual license fee for Gas Appliance Dealers, i.e. on one who sells and installs or who installs gas appliances. This apparently met with no objection. Farther consideration of this ordinance was then postponed until later in this meeting and the Plumbers Delegation left the room. CC:.MUNICATIONS AND REPORTS - Mr E. D. The City Clerk was directed to have Fire Chief Polenske investigate these fires and report his recommendations to the Council. On motion of Councilman Haskell, Lytle second, permission granted subject to approval of the proposed form of lay out and planting. Lodi Post No. 1968, Veterans of Foreign Wars applied for Stadium V.F.W. rental for 15 midget auto or motorcycle races during the 1947 STADIUM season. Application ordered to stand submitted until it was considered together with two other applications of similar intent. E.E.F RDUN S.P.POWER SING L-9037 GASOLINE 1947 Ernest E. Ferdun recommended changes in auto parking and location of bus stops that he claimed would be better than parallel park- ing and the present location of stops. On motion of Councilman Riggs, Tolliver second, the Mayor was directed to execute an agreement with Southern Pacific Company for a power line crossing to serve " Noodleke Tract " as requested by City Engineer Henning. The City Clerk was directed to advertise for the reception of sealed proposals for furnishing gasoline for the year 1947 on motion of Councilman Lytle, Riggs second. (minutes of Nov 13,1946, continued) 103 ORDINANCES & RESOLUTIONS - ORDINANCE NO. 339, entitled, " AN ORDINANCE REPEALING ORDINANCE NO. 204 ADOPTED AUGUST 20, 1934; REPEALING ORDINANCE N0. 315 AS OFD. 339 ADOPTED DECEMBM- 19, 1945 AND AMENDING ORDINANCE NO. 337 ADOPTED INTRODUCED OCTOBER 23, 1946 " was introduced by Councilman Haskell, Riggs second, read at length by the City Clerk and then ordered laid over for the statutory period of not less than five days. This being the day, place and hour set in Resolution No. 1279 HEARING ON adopted October 23, 1946 for the reception of objections to TURNAGE ADDN, the proposed annexation of " Turnage Addition " , due publicat- ion of notice was proven by affidavit of the principal clerk of ORD. 340 the publisher of The Lodi Times. The Mayor than called for INTRODUCED objections, the City Clerk reporting that none had been filed APPROVING with him. No objections being forthcoming, ORDINANCE NO. 340, A`3NEXATION entitled " AN ORDINANCE APPROVING THE AtRMATION OF " TURNAGE ADDITION " TO THE CITY OF LODI, CALIFORNIA " was introduced on motion of Councilman Lytle, Riggs second, read by the Clerk and then ordered laid over for the statutory period of not less than five days by unanimous vote ORDINANCE NO. 938, entitled,"AN ORDINANCE APPROVING THE ANNEX- ATION OF " KRI- F ADDITION " TO THE CITY OF LODI, CALIFORNIA" having been regularly introduced November 6th,1946 was brought ANIMATION OF up for passage on motion of Councilman Riggs, Lytle second, and, KRIEGER ADDN. after reading by title, second reading was omitted by unanimous APPROVED. consent, and this ordinance finally passed, adopted and ordered ORD. 338 to print by the following vote: PASSED. ATME - Councilmen, Riggs, Lytle, Haskell, Tolliver and Rinn. NOES: Councilmen, None. ABSENT: Councilmen; None. The Mayor then signed Ordinance No. 338 in approval thereof. Ordinance No. 341, fixing flat rates for water and a resolution determining on what streets or portions of streets parallel parking of automobiles would be permitted were ordered laid over. The Clerk was directed to prepare and submit at the next meeting, Ordinance No. 331 embodying the establishment of a Board of ORD. 331 Plumbing Examiners, appeals from this Board to be made to the LAID OVER City Council; provisions for the $100.00 and $25.00 license to be required from Master Plumbers and Gas Appliance Dealers and the substitution of the "Standard Gas Code" for Part 2 of the Ordinance as originally submitted. J. L. Webster submitted a written proposal covering part of the PROPOSAL OF work contemplated as " Unit 1 of Pipe Line 1 " on which bids were WEBSTER ON opened November 6th. City Engineer Henning was directed to obtain PIPE LINE commitments that would enable the City Council to determine the cost of completing this portion of the outfall sewer line. The Council was then called into executive session at 11:5 P.M. and the room cleared, returning to open meeting at 11:25 P.M. On motion of Councilman Haskell, Riggs second, Mayor Rim was directed to execute a lease as prepared and read by the City Attor- ney wherein the City would lease to George W. Both motions carried by unanimous vote, all members of the Council voting thereon. An easement deed for a twenty -foot right of way extending across the several properties of Emde and wife in which the City's main line sewage and waste line outfall sewer or sewers would be located was then accepted on motion of Councilman Riggs, Haskell second. In this connection, (this sewer right of way), the Mayor was authorized to enter into a contract with Emde appertaining to the sewers to be located in the right of way granted, such as location of mar -holes, inlet and outlet valves etc. At 12:45 o'clock A.M. of Thursday, November 14, 1946, adjournment to 5:30 P.M. of Monday, November 16, 1945 on motion of Councilman Riggs, srch adjournment to be for the purpose, but not limited to 104 (minutes of 11-13-46, continued) the completion of matters postponed from this meeting, particularly to receive reports of the City Engineer as to the feasibility of doing the work on " Unit 1 of Pipe Line 1 " of the outfall line by f6rce account as the bids opened Nove7ber 6th were not deemed satisfactory, In this adjournment, it was agreed that should the City Engineer be not able to obtain firm prices by 5:30 P.M. of the 18th., the City Clerk should adjourn the meeting to the same hour of Tuesday, November 19th,1946 and so notify all members of the Council. TUESDAY, NOVEMBER 19, 1946 After consultation with Mayor Rinn by telephone, it was detern.ined that no usful purpose could be served by meeting at 5:30 P.M. of this day and the meeting as adjourned on November 13th was therefore not held, the matters scheduled for action thereat to be taken up at the regular meeting to be held lrednesday, November 20, 1946.
