HomeMy WebLinkAboutMinutes - November 6, 1946COUICIL CHA'.'2cR5 CITY COUICIL CITY HALL - CITY OF LODI ?%UNE'SDAY, NOVELMER 6TH., 1946 This regular meeting of the City Council of the City of Lodi was called to order by the Mayor at 8:00 o'clock P.M. of Wednesday, November 6, 1946, Council- men Haskell, Lytie, Riggs; Tolliver and Rinn present, none absent. Also attending, City attorney West, City Engineer Henning, Chief of Police Jackson and Superintendent of Utilities Killelea. The minutes of the last meeting held October 23,1946 were read, approved as read and so endorsed by the Mayor. PUBLIC HEARINGS - This being the date set for the reception of sealed bids for the construction of " Unit 1 of Pipeline i " of the City's main line outfall sewer, due publication of notice was proven by affidavit and the Council proceeded to open and canvass the bids received, to -wit, the only proposal received, being that of Iver W. Swanson dba Stockton Construction Company. The total amount of this proposal was $38,525.00, considerably in excess of the City Engineer's estimate. Bid referred to the City Engineer for report to the Council on Novem- ber 13th. Applications for variences from the strict application of the provisions of Ordinance No 238 set for hearing October 30th and postponed to this time and similar variences scheduled regularly for hearing also at this meeting coming on for to be heard; in each several instance proof of due notice was adduced and on calls for objections none were offered. It was then ordered that such variences as applied for be granted to the following: C. R. Miller, Geo. Stavros, A. Maggio and A. Serale. "Ksieger Addition" - Publication of notice of hearing being proven by affidavit of the principal clerk of the publisher of ANNaCATION OF The Lodi Times, such notice being contained in Resolution No. KRIEGM ADDITIO1280 adopted October 9th,1946 and it appearing that the time, N. hour and place of such hearing had been regularly adjourned to HEARING this time, the Mayor called for objections to the proposed annexation of this addition. No objections in writing or oral were forthcoming and the adoption of an ordinance approving this annexation was postponed to an hour later in this meeting. COLWJNICATIONS - R.WEBER Reinhold ;Veber applied for appointment to the position of City PLBG INSP. Plumbing Inspector. Application ordered filed for consideration APPLICATION when the position was created. State Board of Equalization gave notice of applications for S.B.E. alcoholic beverage licenses at 117 N. Sacramento St and at 112 East Elm Street The District Office of the Division of Highways requested that AIRPORTS the City give notice of proposed airport locations in keeping & DIV HIWAYS with regulations of the Civil Aeronautics Authority and the Public Roads Administration. The Department of California, American Legion, forwarded a copy of a resolution adopted in convention of that body endorsing the Federal Airport Program and the master plan embodied therein. K. L. Lobaugh, agent of Hone Indemnity Company, carrier of the City's public liability insurance, submitted a statement of the AIRPORT cost of including the KingsburyK6ld_Airport in the coverage LIABILITY now maintained by the City, limits of 5C-100,000 for public INSURANCE liability and 100 000 property damage. On the advice of the City Attorney, the City Clerk was directed to ascertain the cost of increasing the public liability coverage to 50-200 000 and if this cost did not exceed $20.00 annually, to place the order for this policy with Lobaugh. At this time, City Attorney rifest presented a resolution granting Standard Oil Company of California a revocable permit to install S.O.COMPANY and operate a gasoline and oil service station on Kingsbury Air - PERMIT FOR field, such resolution to be Numbered 1287. On the reading of STATION AT this resolution, the same was proposed for adoption by Councilman AIRPORT Haskell, Lytle second. This resolution was then passed by the RES. 1287 assenting votes of all members of the City Council. Country Club Spraying Service offered to spray sycamore trees COUNTRY CLUB along city streets and in parks for 5¢ per gallon of spray SPRAYING applied, estimating the total gallonage to be 42 000 gallons. PROPOSAL Proposal ordered laid over to ascertain if other contractors would be inter#sted in this work. Lodi Post, No 22, American Legion applied for use of Lodi Stadium LEGION once a week from May 15th to September 15th 1947 for staging APPLICATION midget auto races. Application ordered submitted for later FCP. Wood, Contractor for street and alley work under contract awarded August 7,1946, was granted a C. WOOD further extension of fifteen working days in which to complete his CONTRACT contract, motion Councilman Rings, Tolliver second. EXTENDED Frank Held at this time complained about the quality of the work COMPLAINT OF being done by the above contractor in the alley east of Garfield F.H.HELD Street, between Pine and Elm Streets. Complaint referred to the Superintendent of Streets. The City Planning Commission reco:=mended that a varience be grant- VARIENCE OF ed Ruth & Joice Osberg for the erection of a fireplace partly OSBERG within the sideyard required at 1320 S. Pleasant Avenue. On motion of Councilman Haskell, Lytle second, this matter was set for hearing November 20, 1946 after notice. Reports of the Chief of Police, the City Poundmaster and the City REPORTS Clerk for October were received, read and ordered filed . City Engineer Henning also presented his activity report for October. It appearing that Geo. T. Emde had started placement of a levee to the west of the City's Taste & Sewage Disposal Plant Site P & S FOR and that the City was bound by previous agreements to levee the LEVEE nest end of its right of way to 1.1hite Slough, the City Engineer ORDERED was directed to prepate plans and specifications for the construction of the required works MnYCO The Mayor was authorized to enter into an agreement with South- S.P.POWER ern Pacific Company for a power line crossing over the Valley LINE XING Springs branch of that Company to serve Yayco Gas Company. On receipt of satisfactory performance ratings from the Superin- P0.3TrEF. i, SCHICK tendent of Streets, Laborer Robert E. Porter, Truck Driver Belford & BABITZKE Schick and Truck Driver +iiliam Babitzke, each having -completed PEFAiANZNT six months of probationary appointment, were confirmed as perm - EMPLOYEES anent employees in their several classifications. Spencer C. Joerke filed his written resignation as Police Patrol - RESIGNATION man and on application of Chief of Police Jackson, Leonard Becker JOERKE from the eligible list was appointed probationery patrolman at APPOINT! MI the present entrance salary of $210.00 effective on his qualifying BxKZR for the position. ORDINANCES & RESOLUTIONS - ORD . 331 Introduction of Ordinance No. 331,• providing rules and regulations SET OVER for plumbing was again set over for introduction until November 13 and the Clerk was directed to notify all plumbers of record by mail of the Council's intentions regarding these regulations. The City Council having acquired jurisdiction so to do, as set forth previously in these minutes under " Public Hearings " it was A_ti1N'CATION OF moved by Councilman Haskell, Riggs second, that CIMINANCE NO. 336, KF=ER ADON entitled, " AN ORDINANCE APPROVING THE ANIiIATION OF " taUTAM CRD. 336 ADDITION " TO THE CITY OF LODI, CALIFORNIA " be introduced, read INTRODUCED and laid over for the statutory period of not less than five days and it was so ordered by the following vote: AYES: Councilmen Haskell, Riggs, Lytle, Tolliver and Rina. NOES: Councilmen, None. ABSENT: Councilmen, None. In the matter of rearranging parking time limits in the down -torn section, the Clerk submitted a proposed ordinance framed in PARKING TIME accordance with the recommendations of the Retail Merchants Bureau REGULATIONS but it appearing that it may be necessary to change these time LAID OVEx limits and the areas to be controlled on short notice, it was directed that an ordinance be submitted allowing the Council to designate parking -time restrictions in various locations by resolution. FLAT RATE A proposed Ordinance to be numbered No. 340 was deferred for ;LATER RATES introduction so that flat rates for furnishing water could be LAID OTSR revamped to cover various uses, commercial, industrial and domestic. After discussion of regulation of methods of parking of motor PARKING vehicles, no action was taken at this time as Ordinance NO -337 METHODS would not become effective until November 23rd and then only if legal signs and street markings were in place.
