HomeMy WebLinkAboutMinutes - October 15, 1947203 COUNCIL CHAMBERS CITY COUNCIL CITY HALL - CITY OF LODI OCTOBER 15, 1947 This regular meeting of the City Council of the City of Lodi was called to order by the Mayor at 8:00 P.M. of Wednesday, October 15, 1947, Councilmen Haskell, Lytle, Riggs, Tolliver and Rinn (Mayor) present, none absent. Also attending City Engineer Henning, City .attorney nest, City Treasurer Yebb, ':ssistant City Engineer Heckenlaible, Superintendent of Utilities Heckenlaible, Fire Chief Polenske and Chief of Police Fore. 1 The minutes of the last regular meeting held October 1, 1947 and the meeting adjourned therefrom held October 8th were read, approved as read and so endorsed by the Mayor. PUBLIC HEARINGS - Mr Otto H. Kundert representing Lodi Tennis Club urged that the tennis courts in Hale Park be constructed without awaiting delivery of electrical equipment, the lack of bids on which item had caused rejection of award of contract on October lat. By unanimous consent, Assist - and City Engineer Heckenlaible was directed to attempt to secure firm commitments for construction of the concrete work and fencing as soon as possible and submit them to the City Council for approval, the lighting equipment to be secured as soon as available. Superintendent of Recreation Pauly and Mrs Stanley Whittaker of the P.T.A.Cooperative Day Nursery requested that the grounds occupied by the Day.Care Nursery oe more securely fenced and that more of the ground be planted to grass. Mayor Rinn requested Fire Chief Polenske, who is convers- and with the building and grounds, to investigate the cost of fencing and submit recommendations. This being the time and place set by Resolution No. 1359 adopted September 17,1947 for the reception of protests ANNCATION against the proposed annexation of the N 4.3 acres of the MEMORIAL S 10 acres _of the E 33 acres of the S7{, of Section 2,T3N, HOSPITAL R6E, designated " Memorial Hospital A,dition "; due pub - ADDITION lication of Notice of Hearing was proven by affidavit and on HEARING a call for objections to the annexation, none were offered, OP.D 355 either written or oral. The introduction of Ordinance No. i INTRODUCED 355, entitled, " AN ORDINANCE APPROVING THE A NNEXATION OF MEMORIAL HOSPITAL ADDITION I TO THE CITY OF LCOI, CALIFORNIA " was moved by Councilman Riggs, Haskell second and this ordinance was read at length by the City Clerk. By this same motion, the ordinance was ordered laid over for the statutory period of not less than five days. This also being the time and place for the reception of evidence favoring or opposing the vacation of the 'Jest 30 VACATION OF feet of a public alley in Lot 8, Block 13 Hutchins Audition PORTION OF as proposed in Resolution No 1360 adopted September 17,1947, ALLEY IN the Mayor called for interested persons to present their BLK 13,HUTCH- objections. No persons appearing, due notice of hearing INS ADDN having been proven by affidavit, and the City Council having ORD=RED therefore acquired jurisdiction so to do, vacation of this RES 1372 portion of a public alley was ordered by the adoption of ADOPTED - Resolution No. 1372, introduced by CouncilmanLytle, Tolliver second and carried by the following vote: AYES; Councilmen, Lytle, Tolliver, Haskell, Riggs and Rinn NOES: Councilmen, None. ABSENT: None. It appearing that the State Controller, acting on the opinion of the Attorney General, proposed to allocate moneys received PROTEST from alcoholic beverage licenses for the half year, January to ALCOHOLIC July, 1947 on the basis of the porortion set up in the Alco - BEVERAGE holic Beverage Control Act in effect prior to adoption of LICENSE FEE Chapter 712, Statutes of 1947, the Mayor was authorized to ALLOCATION protest the payment now due, if and when received, and claim DIRECTED. that the allocation due the City of Lodi is now 100; of the license fees and not 50% as will be contained in the Control- lers :7arrant. Motion Councilman Haskell, Tolliver second. STADIUM Superintendent of Streets and Parks Bruner presented his final PAINTING report on the painting of wood work in Lodi Stadium under FINAL REPORT Contract 1353, Contractor George Bruce. Wark ordered accepted RE'ORTS The monthly report of the Superintendent of Streets and Parks for September eras received, read and ordered filed, likewise the monthly and quarterly report of City Treasurer +Jobb. The City Clerks report for the quarter ended September 30,1947 and his annual fiscal report for the year ended July 1, 1947 were presented. On motion regularly made and carried, the Annual Report was ordered published in The Lodi Times and 100 copies made in pamphlet form. (minutes of October 15. continued) 205 COUACTL CHAMB-ERS CITY COUNCIL CITY HALL - CITY OF LODI In furtherance of efforts to combat the application of Pacific Telephone and Telegraph Company for rate increases, the RFS. 1369 sum of $500.00 was appropriated to be paid to the City of APPROPRIATING Sacramento for the hiring of expert testimony, the same to $500.00 to be pooled with the contributions of Northern California PROTEST TEL. Cities, by the adoption of Resolution No. 13692 passed and RATE INCREASE adopted by the following vote: ADOPTED AYES: Councilmen, Haskell, Riggs, Lytle, Tolliver and Rinn NOES: Councilmen, None. ABSENT: None. Notices of'several dates and places set by the Bureau of Reclamation for public hearings on the intended construct- ion of Folsom Dam and appertenant canals was received and read. Mayor Rinn and City Engineer Henning stating the importance FOLSOM DAM that this project would mean to water users between Sacramento INFLUENCE ON and Ripon, Mr Henning particularly emphasizing the effect NATER SUPPLY that this storage mould have on the rapidly depleting under- ground water stratas now lowering about one foot per year due to increased uses of irrigating waters and demands for domestic supply. Ur Henning suggested that a terse statement of Lodi's water problems be prepared and forwarded to the Bureau of Reclamation in support of the proposed development of streams east of the City. Tentative recommendations of City Treasurer Vincent C. Webb as to proceedure and methods for collecting and accounting BUSINESS for business license taxes, the surveys necessary therefore, LICENSE obtaining the information for levying sewer rental charges PROCEDURE and the incidental accumulation of statistics required by APPROVED the survey now being made by California Youth Authority were approved and Mr i7ebb was authorized to have necessary forms printed. Business license applications presented October 1st, as approved by the Chieg of Police, were given second reading BUSINESS and ordered granted. License applications received since LICENSES October 1st were read and referred to Chief Fore. Mr Fore APID LIQUOR reported that applications for transfers of alcoholic bever- LICE<+lSE age licenses at 110 N. Sacramento Street and at 431 South PERMITS Cherokee Lane were in order, therefore no protests were directed. At this time Robert H. Muilen, Attorney for R. J. Reiman _ a --dressed the Council regarding his efforts to annex the FOSTER & WCOD It Reiman Tract " to the City through a progressive series INT"2 of annexations and requested reconsideration of the contract CONTRACT with Reiman executed August 27, 1947 and relating to sharing WATER AND the costs of sewers and water mains laid by the city to SEWER TO serve the dwellings in Reiman Tract, particularly as relating REIMAN TRACT to the water Line in Pacific Avenue and the Cross Street MODIFIED sewer, both permanent structures constructed at a cost of CONTRACT 52 590.24. It was agreed that these were properly additions AUTHORIZED to the City systems and when annexation was completed or these facilities made accessable to Ethers than Reiman or his successors in interest, he should be reimbursed for their costs. City Engineer Henning promised to draw up an amended contract for submission to Mr Mullen and by him to be presented to the City Council for approval. City engineer Henning presented a modified form of interim _ contract for industrial waste disposal with Foster & 4bod FOSTER & WCOD Canning Company, riving that Company credit for separation INT"2 of wash waters from cannery wastes amounting to about $600 CONTRACT or at an estimated net cost of $4 852.48. On motion of ;7ASTE Councilman Tolliver, Lytle second, the Clerk was directed to DISPOSAL submit this contract to the Foster and i7ood Company for execution. Mayor Rinn read a letter from War Assets Administration KINGSBURY transmitting a copy of Public Law No. 289, 80th Congress, AIRPORT relating to disposal of airports classified as surplus and stating that a representative of War Assets Adminis- tration would meet with the City Council at an early date 206 (minutes of October 15,1947 COU`JCIL CHAMBERS CITY CODICIL CITY [TALL - CIT:` OF LODI Mayor Rinn then read a telegram from Charles Luckxan, Chairman of President Truman's Citizens Food Savings Committee requesting PRESIDENT'S that all individuals and organizations cooperate in obtaining FOOD SAVING fu�il compliance with the four basic points of the President's PROGRAM program, i.e. No meat on Tuesdays, No poultry or eggs on Thursday, Save a slice of bread every day and that restaurants serve bread and butter only on request, bIayor Rinn urged that everyone comply with this program and that the Press give the - program full publicity but deferred appointment of a Citizen's Food Committee until its necessity should be demonstrated. City Engineer Henning called attention of the City Council to the problem of disposing of screenings from the Activated CLINTON Sludge Sewage Disposal Plant now tieing hauled by contractor H.NNING ;l. S. Reese to the City's 305 acre waste disposal lands and re OPERATION suggested that a comminuter be installed on the plant influent 3V -AGE DISP- line to grind solids so that they might be treated with the OSAL PLANT. sewage and disposed of in sludge. Mr Henning stated that Mr Yoder in charge of this plant was conversant with its inst- allation and operation. Mr Hennitig stated that the present activated sludge plant, since industrial wastes had been re- moved, would serve a population of 25 000 but urged that efforts to separate storm waters from sewage be continued so that the overload on the input pumps during storms would be removed. He also stated that automatic operation of this plant was planned at a considerable saving in labor costs. At this time, Mr Wesley McClure and Glen Asbury of Public Administration Service, now conduction an administrative survey of all city departments sat down with the Council and P.A.S. discussed progress of the work. Mr McClure promised an early report and tentatively appointed October 29th as the date for imparting information of a similar nature.
