Pursuant to the adjournment taken fron the regular meeting of Feb-
ruary 5, 1947, the City Council of the City of Lodi met in adjourned
regular session at 6:00 o'clock P.M. of lednesday, February 12, 1947
Councilmen Haskell, Lytle and Rim present, Councilmen Riggs and Tolliver
absent. also attending City Attorney West, City Engineer Henning, Utilities -.
Superintendent Y.illelea and Recreation Director Pauly. i
Minutes of the last meeting held February 5, 1947 were read, approved
except for the correction of a clerical error on Page 122 relating to the
date on which bids would*be received and opened on Units 2 & 3 of Pipe Line
1, changing March as written to February as ordered and advertised, and so
endorsed by the Mayor.
Mayor Rion read a letter from Retail Liquor Dealers Association of Cal-
ifornia soliciting support of the City Council in the passage of A.B.1015
now pending in the• Legislature relating to the hours during which retail
package liquor stores would be open for business and requiring that they
be closed on Sundays. The City Clerk was directed to write Senator Critt-
enden and Assemblyman Thorp that the City Council favored this bill as
being a reasonable limitation and one tending to encourage moderation in
the use of alcoholic beverages particularly during night hours.
Messrs James E. Conklin, Robert `Nilson, Gerald Kundert, 4C.Hoeger-
man and others interested in recreational programs being present, the
recommended list of improvements prepared by the City Engineer and the
Superintendent of Parks with cost estimates were then considered under the
head of Public Hearings.
Mr Henning also reported orally on contemplated improvements in the
baseball park in Lawrence Park, stating that a meeting of interested
persons it had been decided to'postpone erection of a grand stand this year.
That the seating be augmented by using bleachers from. the High School and
that the playing field be relocated and improved at a cost of about $2000.
Mr Conklin requested that the present surface be left undisturbed until
Fall as the High School base ball program would be under way in March.
Cn motion of Councilman Haskell, Lytle second, it was decided to clean up
the present grounds, rearrange the seating and add the High School bleachers j
and relocate the diamond after the playing season was over so that the
High School players would not be disaccomodated. Motion- carried.
As to Lake Park, the Council considered improvement of the beach
area to be of first importance. On motion of Councilman Lytle, Haskell
second, the Park Superintendent was directed to obtain and place new sand
on the beach after preparing the banks to receive it. Installation of
lavatories in the Sea Scout Hut was authorized, Mr Pauly to arrange with
Mr G. A. Burrell as to replacing this but in a new location.
Councilman Haskell suggested that swimming charges at the Lake be
increased, 5¢ for the "free swims" hold the 10¢ charge for school children
and charge 25¢ for high school students and adults. Mr Pauly was directed
to take this matter to the Recreation Commission and obtain its recommendation.
Councilman Haskell moved, Lytle second, that the check room be re-
placed with a larger building at approximately the same location as at
present at an estimated cost of $3 150.00
At this time, Mr Robert H. Mullen, Attorney for H. E. Mahaffey was
given privi.lidge of the floor and stated that his client, proprietor of
the local bus line service, intended applying to -the State Public Util-
ities Commission for a certificate of Public Convenience and Necessity
which would enable him to operate bus lines to Woodbridge, Acampo and Victor
on regular schedules. Mr Mullen informed the Council that, in his opinion,
the issuance of this certificate would take array all local control of
the intra -city lines frc¢ tg City Council. He was asked if his client
would consider operating" a lines as an entirely separate project from
his city bus lines. He said that he would take this matter up with Mahaffey
and the Public Utilities Comission if necessary. 6:r Mullen was requested
to obtain such information from the Public Utilities Commission as was
available relating to this loosing of control of present bus lines by the
City and confer with City attorney Glenn West.
Conversations on recreational improvements was then resumed and it
was decided that the low spot between the two bridges south of the river
be filled to provide parking space.
Provisions were then made for the building of two lighted tennis
courts in the NE corner of Hale Park, estimated cost $5 760.00. `
,Y. C. Hoegerman stated the ideas of Lodi Motor Boat Owners Association
for removal of the present docks from the south side of the lake to the
northern bank, emphasizing that safety woyl.d be one of the principal
benefits obtained. relocation or replacement of these docks to such an
extent as feasible was then approved, imported or lake bottom fill to be
placed as much as possible before the waters were turned in to the lake,

On motion of Councilman Lytle, Haskell second, the City Engineer and the
Superintendent of Parks -."re instructed to do as much of this work as possible
this season, considering these projects in the following order of priority:
(1) Beach Improvement (2) Boat Docks and Fill (3) Filling in Parking Area.
Eddie Freshogr, laborer in the Park Department since January 1, 1947
applied for an increase in wages to $235.00. Application tabled.
' A resolution of the City Council of the City of Salinas relative•.to
the proposals of the League of California Cities for improvement of assessment
practices was briefly commented upon by Mayor Rim.
ORDINANCE NO. 343 entitled " AN ORDINANCE AMM;DING ORDINANCE NO. 188 BEING
AN OPOINANCE TO REGULATE THE SALE AND HANDLING OF MILK IN THE CITY OF LODI;
PROVIDING A PENALTY FOR THE VIOLATION THEREOF; AND REPEALING ALL ORDINANCES AND
FARTS OF ORDINANCES IN CONFLICT THERE11TH ', BY AM&MING SECTIONS 1, 2, 5 AND
7 THEREOF It having been regularly introduced and read at the regular meeting
of the City Council held February 5, 1947 was brought up for passage on motion
of Cop-Lcilman Lytle, Haskell second, second repLding omitted by unanimous consent
and this ordinance finally passed, adopted and ordered to print by the following
vote:
AYES: COUNCIDIEN, LYTLE, HASKELL AND RINK
NOES: COUNCIIAM, NONE.
ABSENT: COUNCILMEN, RIGGS AND TOLLIVER.
Mayor Rinn then signed Ordinance No 343 in approval thereof.
On motion of Councilman Haskell, Lytle second, the execution of a permit
to Spiekerman Concrete Pipe Company as prepared by Street SuperiFrtendent Bruner
to allow encroachment on the sidewalk space of South Sacramento Street opposite
the Spiekerman properties was approved.
On recormendation of Superintendent of Utilities Killelea and on his
statement that Flexible Sewer Rod Company was the only purveyor of sewer
equipment for cleaning servers and drains that would be acceptable to him,
it was directed that Mr Killelea purchase equipment or so much thereof as
was i-mtediately necessary at a top price of $3 698.08 F.O.B.Los Angeles,
subject however to demonstration in Lodi and acceptance of the equipment by
Mr Killelea and City Engineer Henning.
The pump unit bids mentioned in the minutes of February 5th were then
considered with the tabulation of efficiencies and prices submitted by
City Engineer Henning. It being known that two attempts to secure sealed
proposals for pumping units by advertisement had failed to procure any
proposals, Mr Henning was authorized to purchase two 100 HP pumping units
from Hull J. Clancy at $3 565.62 installed by the adoption of Resolution No.
1301, introduced by Councilman Lytle, Haskell second and passed by the following
vote:
AYES, Councilmen, Lytle, Haskell and Rine
NMS, Councilmen, None
ABSENT, Councilmen, Riggs and Tolliver
Claims of John E. Schauer for hauling sewer pipe in the amount of $233.47
and for reimbursement of the City Clerk's Revolving Fund $ 706.66 were allowed
on motion of Councilman Haskell, Lytle second.
Superintendent Killelea reported that the installation of a water heater
at the Airport would cost about $225.00. He was instructed to go ahead with
the purchase and installation of the same.
