HomeMy WebLinkAboutMinutes - February 5, 1947120 COU':CIL CHAUBr-RS CITY COU`JCIL CITY HALL - CITY OF LODI FEB.°UART 5, 1947 •This regular meeting of the City Council of. the City of Lodi met at 8:00 P.M. of Wednesday, February 5, 1947, Councilmen Haskell, Lytle, Riggs, Tolliver and Rinn present, none absent. Also attending City Attorney Uest, City Engineer Henning, Utilities Superintendent Kiilelea, Chief of Police Fore, Fire Chief Polenske and Street Superintendent Bruner and Recreation Director Pauly. Minutes of the last meeting of January 15, 1947 were read, approved as read and so endorsed by the Mayor. PUBLIC HEARINGS - Messrs George Hughes and Otto F. Beckman being present, the formal notice from the State Public Utilities Commission of a hearing to be had in the City Hall, Lodi in February 19, 1947 at 10:00 A.M. and a letter from 4. L. Melte, Gen- eral Manager Central California Traction Company relating to this hearing both pertaining to the proposed abandonment of Central California Traction Company's Sacramento Street railroad line were read and Messrs Beckman & Hughes addressed C.C.T.CO. the Council. Mayor Rina read an exerpt from the Council's ABANDONMENT minutes of September 4, 1946 stating the attitude of the SACTO ST City Council as advocating removal of this portion of the LINE Traction Company's line and also recommending that substitute facilities be provided in the event of such removal. Both Mr Beckman and Mr Hughes stated that it would be satisfactory if this would be a condition accompanying this track abandon- ment. City Attorney Glenn West advised both protestants that the Utilities Comdssion might not consider substitute facil- ities at this hearing and that their position would be much strenkhtened if they had applications filed for substitute track service from Southern Pacific Company. Mayor Rinn advised these gentlemen that the Council would act on Manager White's letter later in the meeting. Mr Freder*dk N. Spiekerman then addressed the Council in application for permission to encroach on the unused side- walk space along his property on the east side of South SPIEKERMAN Sacramento Street to permit loading of concrete pipe by SIDEWALK a gantry crane on trucks parked parallel to the property ENCROACHMT line partly in the street and partly on the sidewalk space. SACTO ST This would entail reconstruction of the curb and gutter structures for about 300 feet on the east side of the street which he agreed to do at his own expense, and under City specifications. On motion of Councilman Haskell, Riggs second, it was directed that an encroachment permit issue, such permit to be approved by resolution of the Council when prepared. H. E. Mahaffey representing several organizations interested in baseball asked that the present ball grounds in Lawrence Park be relocated and redesigned and that the present grand stand be replaced with a substantial structure to seat at BALL PARK least 600 people, estimating that the cost would be $20 000. IMPROVE10M Mr Mahaffey asked for action at an early date and stated that if the City feld unable financially to undertake this work, that he be so advised as locally interested persons or organizations would be willing to undertake financing of a modern ball park at this location. It was ordered that this matter be made subject of part of the adjourned Council meeting to be held February 12th. Mr Robert Wilson of Lodi Tennis Club solicited construction of two tennis courts at such location as the City might TEAS select stating that lack of courts limited enjoyment of this COURTS sport and prevented holding of inter -club tourneyments. Mr Pauly, whose list to be submitted later, included four of such courts, estimated the cost of two courts to be between $1 500 and $2 000. This application also laid over for consideration on February 12th. Mr A. 0. Pauly, City Director of Recreation , then submitted a list of facilities desired to house various recreation activities in the baths building if remodeled, a list of improvements desired at Lodi Lake Park and a statement of Lodi Outboard Motor Boat Club of its desires for additional T— r- 4 (minutes of Feb -5, 1947 continued) COU':CIL CHA"BERS CITY COUICIL CITY HALL - CITY OF LODI and relocated berthing docks at Lake Park. The latter applic- PAULY ation advocated moving the present docks to the north side of LAKE PARK the lake. These matters ordered returned to Mr Pauly for consultation with Superintendent of Parks Bruner and later report to the Council with recocmendations and estimates of costs. This being the day, place and hour to which the hearing on the application of C. B. Peireno for a varience to allow VARIENCE the construction of an accessory garage building at 17 South OF PEIRANO Washington Street at a less distance from the dwelling at GPANTED that location, due publication of notice was proven by affidavit and on a call for protests, none were forthcoming. It was then ordered that a building permit issue as applied for. CO! UNICATIONS - Lodi Motorcycle Club, Inc. applied for use of Lodi Stadium for Sunday, June 1, 1947 for staging its " Pacific Coast STADIUM Tourist Trophy Motorcycle Races ". Application granted n- SERVED and reservation of the Stadium for this purpose ordered JUN 1 147 on motion of Councilman Haskell, Lytle second, this permit M'CYCLE CLUB to be suvject to the existing charges and regulations. 121 Lodi Retail Merchants Bureau called the Council's attention STREET to the lack of street names on the curbing throughout the NAMES City. Letter referred to W. L. Bruner, Street Superintendent ON CURBS for appropriate action. REZONING ON A resolution of the City Council of Dos Palos relating to a DOS PALOS state levied and collected sales tax was tabled as not being SET FOR 3-5 practical at this time. A letter from W. S. Reese, contractor for hauling screenings 71.S.RZESE from the Sewage DisposalP;lant; relating to extension of the SCREENINGS discharging elevator was referred to the Public Utilities Superintendent for examination as to its merits and necessity. VARIENCES OF Penorts of the Chief of Police, the Poundmaster, the City HEINLE AND Clerk and the City Engineer for January were received and MONTHLY read. The Annual Report of the Building Inspector was REPORTS received and copies furnished each Councilman and the Press. ANNUAL AND Fire Chief Polenske reported activities of the Fire Depart - SEMI -ANNUAL ment for the half year ended December 31, 1946, also furnish - REPORTS ing copies to all Councilmen: 121 The City Planning Commission under date of January 20, 1947 reported its recommendation, made after one public hearing, that the " Zone District Map " adopted by Ordinance No. 238 HEARING ON be amended to rezone all properties located East of a line REZONING ON two hundred feet west of and parallel to Pinkerton Avenue, PINKMTON AVE sometimes called " Cluff Avenue " and sometimes " Floral SET FOR 3-5 Avenue " so that the same would be in the Industrial District Zone. A hearing on this recomendation was set to be held before the City Council, after published notice, on March 5, 1947 beginning at 8:00 PX. The City Planning Commission reported its findings and recom- mendation, after having held one public hearing thereon, that REZONING a lot, approximately 53 feet wide by " feet long, situated PARK & HUTCH. on the North line of Park Street and the East line of South HEARING Hutchins Street be rezoned to be in the Commercial District SET FOR 3-5 Zone to accomodate a neighborhood grocery store. March 5, 1947 at the hour of 8:00 P.M. was set for a hearing on this proposal and the City Clerk directed to publish notice thereof in the official newspaper of the City. A letter from Dr John J. Sippy, District Health Officer, advocating the adoption of an ordinance restricting sales of milk in Lodi to pasteurized milk was read. It appearing that all of the City's present milk supply is now pasteurized, it was moved by Councilman Riggs, Lytle second, that Ordinance PASTEURIZED No. 188 of this City be amended to effect this restriction, MILK by the introduction of ORDINANCE NO. 343, entitled, AN ORDIN- ORDINANCE 343 ANCE AMtSDING ORDINANCE NO. 188, BEING ' AN ORDINANCE TO INTRODUCED REGULATE THE SALE AND HANDLING OF MILK IN THE CITY OF LODI; PROVIDING A PENALTY FOR THE VIOLATION THEREOF AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREjaTH ' BY AMEENDING SECTIONS 1, 2, 5 AND 7 -THEREOF. This ordinance was then read at length by the City Clerk,�rdered introduced and laid over for the statutory period of not less than five days by unanimous consent. NEW BUSINESS - At this time an eligible list containing 14 names eligible for a-pointment as Probationary Patrolman was received from the Personnel Clerk and a letter from Chief of Police Fore asking A'POINTMENT that three men be appoined therefrom, one to take the place OF PATROLMEN of Theodore Bender, resigned and two new men. On motion of JUNGLING Councilman Lytle, Riggs second, this increase in the police PYLE force was approved and on oral recommendation of the Chief HlE of Police and on motion -of Councilman Lytle, Tolliver second, J. C. Jungling,.Chas. E. Pyle and Laurence F. Hemme from the list first mentioned, were appointed probationary patrolmen at the regular entrance salary of $210.00 per month, effective on their qualification and entering upon their duties. City Engineer Clinton Henning then presented Plans, Specif- pecieications, ications,recommended Mage Scales, form of Notice to Cont- ractors and Form of Contract for the construction of Units RESOLUTION 2 & 3 of Pipe Line 1 of the Main Line Seger Outfall covering NO. 1300 the part of this sewer between the Woodbridge Canal to the ADOPTED ilestern Pacific Railroad. These documents were approved APPROVING and the wage scale adopted by the adoption of Resolution 1300 P & S FOR introduced by Councilman Haskell, Riggs second and the City PIPE LINE Clerk instructed thereby to advertise for contract proposals to be opened and canvassedlt ami' 19, 1947 before the Council in regular meeting. The two applications for business licenses read January 15th BUSINESS were approved for granting and issuance. License applications LICENSES received since that date, were referred to the Chief of Police for investigation and report. F & W Necessity for renewal of the waste disposal contract with CONTRACT Foster & Wood Canning Company was referred to the City Engineer for report at the next Council meeting John H. Smith, Rt 2, Box 92 applied for domestic water service to two dwellings on Kettleman Lane. Referred to Mr Killelea. Councilman Lytle reported on progress toward obtaining a road GARBAGE to the Vaccarezza lands north of the river and east of the ROAD Central California Traction Company line, stating that it IMPASSE seems impossible to go in from Cherokee Lane leaving the only feasible route to be from Dougherty Road. City Engineer Henning reported two proposals for pumping units PUMP UNITS had been received but that he had not had time to review them PROPOSALS with Superintendent Killelea. Ordered laid over to Febraary 12th for recommendation if possible. Claims in the amount of $65;804.03 as approved by the Finance CLAIMS- Committee were approved and ordered paid on motion of Council- man Haskell, Riggs second. City Attorney West and City Engineer Henning reported success in obtaining a right of way agreement with Woodbridge Irriga*i.on District for the main line sewer under the district's canal (Minutes of Feb. 5, 1947, continued) CG'VCIL C.iA'd3ZR3 CITY COUNCIL CITY HALL - CITY OF LCDI TNOODBRIDGE at a point about 90 feet South of the center line of State CANAL Highway No 53 as now existing. The only restriction running C20SSING with this easement, outside of the usual conditions made in OBTAINED similar cases, was that the City maintain the canal banks from the Highway to the south line of its easement. r- Mr v'!_st also reported that he, Mr Henning and Mayor Rinn had also procured the long sought permission to cross Kingsbury KIN^,SBURY Auxiliary Air Field with the outfall sewer line and that AIR Fern Mayor Rinn had executed an agreement with 37ar Assets Admin - CROSSING istration to that effect in order to gain immediate access to OBTAINED this property. On motion of Councilman Haskell, Riggs second, the action of the Mayor in this matter was ratified and con- firmed as the action of the City Council. As the permit granted by War Assets Corporation for crossing Kingsbury Field was subject to the rights of the fee title J.L.PERRIN owners, in this case, J. Councilman Haskell stated that Northern San Joaquin Mosquito Abatement District had requested excitusive use of the metal TIN BARN clad building owned by the City at 300 Nest Lockeford Street, PROPERTY or such part of the building as could be spared. This request referred to Supt. Killelea to work out a plan for lease if there was room not needed by the City. _ Superintendent of Utilities Killelea was authorized to hire NEW an accredited lineman at $270.00 per month, he having received LIN31AN an application from a man claiming to be competent for this job. At 11:35 P.M. the Council retired into executive session, returning to open meeting at 12:10 P.M. The hearing on the application of Central California Traction Company for abandonment of its tracks on Sacramento Street and of the letter from that Company"s General Manager was then C.C.T.CO discussed. All members of the City Council agreeing, the TRAGIC City Engineer was directed to appear at this hearing on Feb- ABANDOME NT ruary 19th, 1947 instructed (a) That the City Cpuncil favored the removal of Central California Traction Company's tracks and all equipment used in connection therewith. (b) That, if and when these tracks are removed, substitute facilities be furnished by Southern Pacific Company in lieu thereof. At 12:16 A.M. of Thursday, February 6, 1947, the City Council adjourned on motion of Councilman Riggs, such adjournment to be to and until 8:00 P.M. of Wednesday, February 12, 1947. Attest, J F.
