Councilmen Bull, Haskell, Lytle, Tolliver and Rinn (•Mayor) present Minutes of preceeding meeting of September 1, 1948 approved as written and mailed to each Councilman and the City Manager. In the natter of the application of Manuel Ellison for a card ELLISCpl C:,RD and dice game license at 118 North Cherokee Lane: Mr Meller LICM:SE sdibmitted a further report of M. L. Fore, Chief of Police DEZZEED affirming his first reconendation that no license issue for these premises. Recommendation approved. At this time 1i '!eller submitted mimeographed copies of a proposed Salary & ,!age Schedule setting forth present and proposed pay ranges, having furnished copies of this schedule previously to each Councilman for study. Ur Weller emphasized that this schedule was not contemplated to raise salaries and wages but to readjust existing pay ranges and the intermediate steps. iie'proposed that when a probationary employee acquired permanent status, he automaticly be raised to the next step in SALARY & WAM his salary range but that succeeding promotions in pay be 3arSDIILF, based on merit as determined by the head of his department A?PROVM and confirmed by the City Manager. E_FIVECTIp' As regi -ds persons employed on an hourly base, that the wage SEPT 1,1948 be increased to $1.10 per hour and that they be employed for a forty hour week. Also, that no employee would gain permanent status in the classification listed as submitted by reason of his position being mentioned therein. On motion of Councilman Bull, Haskell second and carried without dissenting vote, the above recommendatiogs of the City i.:auager were accepted, the heads of the vart6us depart- ments to fix the position of his employees in the various salary ranges on consultation with the City Banager and changes in salaries and wages affected thereby to be effect- ive from and after September 1, 1948. The Council then decided that no applications for appointment as Director of Finance would be received after September 30th. At this time, Mayor Rinn permitted members of a committee from Lodi District Chamber of Co=erce to address the Council.. A?ATEMMT OF Lr Winfield S. Montgomery, spokesman for this group, requested STAD= TAX that the City Council waive collection of stadium Tax for the DEC 11,1948 football game sponsored by the Chamber of Cormeree December DE110M 11, 1948. Councilman Bull su,;gested that if the Chamber failed to pay the expenses of this game from admissions, that they then apply for abatement of the tax. Other Councilmen con- curring in this suggestion, it was moved by Councilman haskell, Bull second, that the application be denied as not consistent with the City's adopted policy. Notion carried and so ordered. '.`r Arrchie Boyd then submitted a petition signed by persons SCHOEOS-SCHALT,Rresiding in the neighborhood of " Salem School Grounds" P...I'dT_L protesting the Council's letting of a part of these grounds AG Zr.27 ' for transfer of grapes to highway trucks, alleging that this :MCINDED use would cause nuisance from odors and flies. mr Boyd spoke at some length urging that the wishes of these people be respected. LODI The Council then entered into a discussion of a proposed ORDnIAW07 business license ordinance, copies of which had been sub - NO. 375 mitted to each Councilman -several weeks ago. G. Stuckenbruck offered the use of San Joaquin County equipment to enlarge trenches at the HA=Z Lem Harney Lane Refuse Disposal Site in return for permission ( R aTUSr1L SITE to County residents outside the City of Lodi to dispose of TRENCHING waste materials at this site; suggesting that the County A: -PROVED might also be able to, -assist in constructing a road from the county highway to the disposal site. Proposal accepted details to be :corked out between the City tanager, Mr Stuck- enbruck and County Engineer Tulius :Bnthey. .mayor Rinn then read a letter from Northern San Toaquin County 1M.MWAI OF Chamber of Co=. erce, tenants of offices in the u-. per story of C4Al2R OF the City Hall for the past twenty years, thanking the City for Co'i .4CE its geherousity, and stating that the Chamber offices would be Or_IMS moved to 204 'nest Pine Street between October 1st and 15th so as to allow the City use of this much needed space. Business License Applications submitted September 1st were then submitted by City :.anger :Yeller with the recomendat- BUSiNESS ion that all be granted as approved by the Chief of Police. LICENSE So ordered. License applications received since September A'_-TLICATIONS ist to the present date were read and ordered referred to the Chief of Police in accordance with the provisions of Ordinance No. 277 CEN. AM. On application, General American Precooling was -granted PIRECCCLING permission to use space along the North line of Railroad P_vR_.IIT Avenue for car cooling during the present shipping season. Mitchell &. Koenig were granted permits to install four - LD T=L-i{OM7IGaccess driveways to their new garage and salesroom on the ! DRI EZZ;LYS Northwest corner of Hutchins and Lockeford Streets at the ( A^PP.OTM locations sheen on a sketch submitted by the City Manager, construction to be to the satisfaction of the Superintendent of Streets. iation Councilman Haskell, Bull second. '$ Weller submitted an opinion of City Attorney Glenn West SIDEltux that the City had the power to order repair of damaged Rr:PAIRS sidewalks and compel the abutting property owner to pay the costs thereof, requesting an expression of the City Council as to its future policy in this regard. No objection was made to accomplishing these repairs in this manner. At this time, the verified claim of Marie S. Cook et al, for damages to the amount of $50,700.00 arising out of the CIiUM OF death of Howard Cook at Lake Park on Tuly 11, 1,948 as WR1✓ S.COOK filed with the City Clerk September 3, 1948 was presented. REJ7CTED Annexed thereto was an opinion of the City Attorney stating that this claim was in proper form and had been filed at the time and in the manner required by law. It was then moved by Councilman Tolliver, Lytle second, that this claim be rejected as the City had no liability therein, and that kEthe same be referred to the City Attorney and to the Cityfs _ insurance carrier, Hartford Accident and indemnity Company. Motion carried, all Councilmen voting in favor thereof.
