Ccuncilmen present: Bull, Haskell, Lytle and Mayor Finn (4) Councilmen absent : Tolliver (1) Copies of the last regular meeting held August 18th and of the irtervenirg adjousr_ed meeting held AuEust 25th having been previously furnished each Councilman, no errors or omissions were noted and the minutes ordered a.Lproved as written. P PORTS OF THE CITY M.-N.kGER — City Manager H. D. 4eller reported orally on a conference had between himself, Assistant Division Engineer Clarence Bovee and City Projects Engineer R. L. Potter of the District X office of the Division of Highways and Ur L. V. Campbell of Headquarters offices of the same bureau relat— ive to amending Project 21 of the Project Agreement for AME{QDb1Er.TS. TO 1945 fiscal year so as to conform with the Council's STATE HI77AY expression contained in F.esolution No. 1434 of august 18th. AGREE1eMTS The principal feature of this discussion was concerned with the drainage of Highways 4 and 24 for disposal of STORM DRAIN storm waters as well as on city streets in the area tributary to .these highways. The highway engineers had promised to consider participation by the State in a stork ACCEFTA.'VCZ drain line, probably along North Stockton Street or at OF A=E'D a more easterly location, that would have the sane effect PROJ. 21 BY as a drain along Highway 4 and would serve more major ADOPTICN OF streets with some possible savings in costs. RES. 1437 Yr -teller recomended that the City approve Project 21 with the provisions for traffic channelization omitted so that there would be no delays in the installation of the traffic signals on Project 15 of the same agreement. This approval was made by the adoption of Resolution No. 1437, introduced by Councilman Bull, Haskell second and passed by the following vote - AYES: Councilmen, Bull, Haskell, Lytle and Hi m NOES: Councilmen, None. ABS NT, Councilman Tolliver. At this time H. E. Mahaffey and "Walter Knolhoff, President and Secretary respectively of Lodi Grape & Wire Festival addressed the Council requesting that the City waive the WAIVER OF collection of admissions tax to the Festival's performances CGT._:_^CTICfi in the Stadium this year, stating that the officers of the ADMI33ICN TAX association had proceeded on the assumption that this charge GRAPE & ;'U.1 would be abated as in previous years. It Was then moved by FESTIVAL 1948 Councilman Bull, Lytle second and carried that no collection of admission tax to the Festival Association be made for this year only and that the minutes of august 18, 1948 be so amended, such charge to be fixed in succeeding years at the time when the Association notified the City Council of the dates of its Fall celebration. :'r Mahaffey- also requested the privilege of locating the carnival sponsored by the Grape & :"line Festival on the CARNIVAL IN Lawrence Park Ball Park. City Manager Weller stated that LAWRENCE the City had spent considerable :coney recently in placing FARK this park in playable condition and -that it was evident that BALL FIELD the presence of the carnival would do damage to the field. Mayor Finn appointed a coamaittee with full power to act in locating this carnival, consisting of Councilman Bull, Mr .feller and Park Superintendent Bruner. On motion of Councilman Bull, Haskell second, and on recomm— endation of the City Manager, Lodi Grape and :Pine Festival .OV^1G OF was permitted to move the fence at the Northwest corner of FENCE P: "% the Stadium so as to permit access to grounds ::orth of the STADIL',.'. Conklin, Director of Athletics L.L'.H.S. of Lodi Union High School was in full accord with the City's ST..DIUM TAX proposal to increase the present Stadium tax from 5¢ to 10¢ AMEa- 21T per head, such charge of 1014P to apply to all tickets for AZENDLENT High School performances in Lodi Stadium other than to holders CYL?RED. of Lodi Student Body Tickets, the charge on these last named admissions to be 5¢. dmendmert of the agreement of May 59 1940 to embody the above change ordered on motion of Councilman �zll, Haskell second. - Business License Afplications - Three new aplications read BUSI<ESS and ordered referred to the Chief of Police; applications LICENSE presented August 18th a_ proved except the application of A'PLICATICNS Manuel Ellison for a Card and Dice Game License at 113 :forth Cherokee Lane, which application was ordered laid over for further investigation. i "r Beller discussed with the City Council, ways and means to secure additional facilities at the Lawrence Park Baseball Field, particularly lighting and seating. He stated that baseball enthusiasts proposed securing $13,000, estimated LA;RZ-NCE cost of lighting fixtures, and taking over the field until PARK BASE reimbursed from receipts. Mayor Flinn objected, su�:gesting BALL PARI{ that these people put up the $13,000 and repay those r-1PROV71011TS advancing it from receipts, later, when funds are available, DISCUSSED the City would provide an approximate matching amount to provide other facilities. It was suggested that the local school districts and the County of San Joaquin should also be contributing parties as the field is used by outside players and the schools to a greater extent than by City residents. The proposed business license tax ordinance now in the hands of the Councilmen was laid over until Councilman Tolliver could be present. Transfers in amounts budgeted for two purposes were ordered; FUND TRANSFERS From Contingent Fund to General Feud $ 1,166.67 to pay the C£ IRED cost of compromising the damage suit of Jay Loveless; from Contingent Fund to General Fund $5,500.00 to pay for the a:'ditioral lands acquired from Coffelt for waste disposal. 's At this time City Manager 'Heller reported the appointment of Jal.lace A. Norvm as Assistant City Building inspector and .i. A. It was moved by Councilman. Haskell, Bull second, that the City enter into such an agreement subject to the aproval of the City Attorney. This agreement was consider- ed by the City Council as merely a matter of form as there is apparently no obligation for the State to continue after the existing contributions are exhausted. Suggestion accepted a -ad DELMERY permission granted provided that the City reserves the right to revoke this permission at any time and that the box owner hold the City harmless from: any damages that might accrue from his encroachment on a public street.
