This adjourned regale= meeting of the City Council of the City of Lodi was held beginning at 9:00 o'clock P. U. of Wednesday, June 23, 1948, council- men Bull, Lytle, and Rinn present at roll -call. Councilman Tolliver appeared at 8:15 P. M. and took his seat in the Council. Councilman Haskell absent. The minutes of the regular meeting of Tune 16, 1948, were read, approved as read, and so endorsed by the Mayor. No persons desireing to be heard at this time, the order of public hearings was passed for the time being and the Council proceeded to hear commrnications. CO=UN CATIONS: Letters from the Business and Professional Women's Club and from the Soroptimist Club of Lodi inquiring in for the reasons for specifying candidates for the position of "clerk -cashier" as limited to men only. The clerk :as directed to reply to these inquiries stating that there were special circumstances connected with this position such as the weights of moneys handled from parking -meters and the proposal that this appointee would do the field work under the new sales tax ordinance. This latter part of the work would entail visiting bar -rooms and 'other places in which the Council felt it would not be right to ask a woman clerk. USE PERMIT S.J.L. CONTRACT OCT. 30, 1948 The action of the City Planning Commission in granting a use permit to San Toaquin Local Health District for per- mission to erect an office and health center at 300 W. Oak Street was approved on motion of Councilman Bull, Lytle second. The application of G]adTidings Temple for a varience to permit the erection of a new church building at 221 E. Walnut Street 3 feet south of the established building line in this block, but on line with the existing church building was set for hearing before the City Council Zu3.3L 7, 1948, at 8:00 o'clock P. M.. This action was taken after receipt of a letter from the City Planning Commission stating that this commission had held one public hearing on the application at which no objections were received. Superintendent of Streets Bruner asked affirmation of a policy of his office denying side -:Talk Permits to applicants where no curbs and gutters are in place. The Council agreed with Mr. Bruner's contention, stating that it would be the policy of the Council not to allow side -walks unless curbs and gutters were first installed or were put in simultaneously, with the side -walks. On inquiry fromMayor Rinn, Superintendent of Streets Bruner outlined his proposal cutting.down driveway entrances to the standard Oil Service Station on the Northwest corner of School and Pine Streets. Peat, l.arwick, Mitchell and Co. inquired as to the possibility of their firm submitting a proposal for the annual audit of the City's accounts. Pro action taken, pending a reco nendation free the City Manger. The Athletic Department of the College of Pacific requested a contract with the City for 'its use of the Stadium October 30, 1948. PURCHA..e'. had notified him that their wiling and postage - PITNEY -BONES metering machine prices would advance dorm seventy - =11L ',sACHI`W dollars furs 28. The City Clark requested authority to place an order for one of these machines in order to make a saving over purchase later in the year, as he had intended, and wroul3 include the cost of this machine in his office budget. Permission to place this order granted. City Engineer Heckenlaible requested that the city purchase sane adequate means of transportation CITY EIMMIEER for the City Engineering Field Depart.-aent, recon - PURCHASE Cr: mending a Carry -all -Suburban -Vehicle to cost :P1,850.00. AUTCLiOBILE Heekenlaible stated that the present 1938 model Ford used for transportation for men and equipment In the field department had been driven over 100,000 miles and was in a -very bad state of repair. Also, the employees of his deoart--ent objected to hauling survey eeuipnent in their private cars. L`.r. Fecken- laible was directed to prepare specifications for advertisement for a car suitable for this purpose. The application of Alvin A. Bender, 735 E. Pine Street for permission to rent or lease a part of the ALVIN BEMER eighty foot strip owned by the City in Lot 14, Live Oak RENTAL OF 80' Colony No. 1 was referred Superintendent of Streets. STRIP The Clerk has also directed to ascertain if the present owners of the 4 acres tract of land abutting on the north and of this strip were interested in renting the same, and if so, what rental could be obtained therefore. The Clerk asked information necessary to SPEvIFICATIONS draw up complete specifications for concession services L FOR CONCESSIONS at the two ball par's and the Lodi Stadium, particularly as to whether this should be included in one letting or whether this Council would receive separate bids on the ball park concessions from those in the Stadium: ?e vms directed to advertise for bids for all three concessions. The City Treasurer wwas authorized to pay GLERK-CA,SHIEF for an entrance salary of 225 dollars ($225.00) per SALARY month to the successful! condidate for "clerk -cashier" providing this qualification warranted the payment of such an amount. At this time, air. Reuben P. Rott, representing WATER CONSERVATION San Joaquin Water Conservation District addressed DISTRICT R1ZUaST the City Council in aapUmtLm for a contribution toward FOR $1,625.00 the organization costs of this district. Mr. Rott APPROVED stated that the proposed district would be bounded on the south by the Stockton -East San Joaquin hater Conservation District, on the east by the Tully and Elliott roads, on the no.—.h by a line 2 mile north of the Elliott road, and on the west by a line 2 mile west of the Lozer Sacra-ento Road, including about 55 thousand acres and the City of Lodi. Lor. Rott stated that the State Division of mate, resources had esti:wted the costs of a survey for the district be twenty -rive thousand dollars. Thirteen thousand dollars would be paid in the first year, and twelve thousand in the second. After the district is organized, they will then bar -able to levy a tax not to exceed 25¢ per acre for organization costs. The people in the rural portion of the proposed district would then contribute a sum equal to that requested from the city. Da.. june 3C,19Jj It was then moved by Councilman Buil that the City appropriate the sum of $1,625.00 as its contribution to the cost of organization expenses of a water con- servation district, contingent, ho:aever, on the ap- pr6priation of the sum of y3,250.00 by San Toaquin County. ;lotion seconded and carried. At this time, City Attorney "'est explained several proposed amendments to the sales tax ordinance, (Ordinance Il -o. 373) proposed at the Tune 16 meeting. Several businessmen interested in the sales tax and the method of its collection participated with the ORDINANCE Council in a discussion of the ordinance and these 110. 373 proposed amendments. ?irst,the change from Treasurer - FORMALLY Collector to Treasurer wherever it appeared in the IhTR.ODUCED ordinance utas approved. Second, Section (C) of the AS AMMMED original ordinance =s stricken out and the following substituted in lieu thereof: "Section (C) --the sales tax does not apply to sales to purchasers solely for use or consumption in the conduct of their business outside the City Limits of the City of Lodi." Third, coccutation of the sales tax due from certain vendors where it is extremely difficult to ascertain the amount of taxable sales on a fixed percentage ascertained after an analysis of six month *s sales sms authorized by the insertion of paragraph (D) in Section 4. The second paragraph under parenthesis, that part (C) of Section 5 stating a rule o: the State Hoard o: Equali- zation adopted by the original ordinance but not set forth in hill therein was made by the addition of a second paragraph sho ing that sales of a business would be taxed on the show -cases, bars, f.ttures, equipment, office machines, trucks, and automobiles used in the conduct of the business. On motion of Councilman Bull, Lytle second, all amendments were approvsd and the amended ordinance no. 373 ordered introfteedand laid over for a period of not less than 5 day a .
