TUESDAY, MARCH 16, 1948
This meeting held pursuant to the provisions of Section 9918 of the
Elections Code of this State beginning at 8:15 o'clock P.Y. of Tuesday,
the 16th day of March, 1948 (being the first Tuesday following the Spec—
ial Municipal Election held on Tuesday, March 9, 1948. Councilmen Haskell,
Lytle, Tolliver and Rinn present, Councilman Riggs absent.
The returns of election from the f6ur consolidated precincts establish—
ed for the holding of this election were presented by the City Clerk and
on a canvass of these returns, the findings and results of the Special
Municipal Election held March 9, 1948 were ascertained by the adoption of
Resolution No. 1406, introduced by Councilman Haskell, Lytle second and
passed by the following vote:
AYES: Councilmen, Haskell, Lytle, Tolliver and Finn (Mayor) 4
NOES: Councilmen, None 0
ABSENT: Councilman, Riggs. 1

RESOLUTION DECLARING THE RESULT OF A SPECIAL MUNICIPAL
ELECTION HEIR IN THE CITY OF LODI ON THE 9TH DAY OF
MARCH, 1948.
:7H:21EAS, a special municipal election was held and conducted in the
City of Lodi on Tuesday, the 9th day of March, 1948, for the purpose of
submitting to the voters of said City the following question:
" IN ORDER TO PROVIDE A SINGLE AND COMPLETE SCHEN FOR 4NE
REORGANIZATION OF THE GOVERNMENT OF THE CITY OF LODI, SHALL
THIS CITY ADOPT THE COUNCIL-MANAGER PLAN OF GOVER6MENT AND
SHALL THE CITY COUNCIL HEREAFTER APPOINT THE CITY CLERK AND
THE CITY TREASUEER OF THE CITY OF LCDI ? "
AND, WHEREAS, it appears from the report of the City Clerk and the
records on file in his office that notice of said election was duly and
regularly given; that voting precincts were properly established and the
polling places thereof designated; that election officers were appointed
and qualified; that election supplies, including official ballots were
furnished each of said precincts and that, in all respects, said election
was held and conducted and the votes cast thereat received and canvassed
and the returns thereof made, determined and declared in time, form and
manner as required by the election laws of this State providing for and
regulating municipal elections in sixth -class cities, and,

Council Chambers thereof on this Tuesday the 16th day of March, 1948 to
canvass the returns of this election and declare the resin;; thereof,
finds as a result of said canvass that the total number of votes cast,
the number cast in favor of the proposition and the number of votes
cast against the same to be as follows: VOTES CAST

RESOLVED THMFORE, that this City Council hereby finds, determines
and declares:
(1)'That said election was regularly held and conducted on the said
ninth day of !;arch, 1948.
(2) That the total number of votes cast thereat was One Thousand
Seven Hundred and One (1 701)

(3) That the total number of votes cast in favor of the proposition
submitted was One Thousand and Twenty Two (1 022);
(4) That the total number of votes cast against the proposition
submitted was Six Hundred Seventy Nine (679)
(5) From the foregoing, the proposition submitted was adopted, that
is, the City of Lodi by this election has adopted the Council Manager
form of government and, after the expiration of the terms of office of
the incumbent City Clerk and City Treasurer, the City Council shall
appoint the City Clerk and the City Treasurer.
Upon the adoption of this resolution, the City Clerk shall enter
a full copy thereof in the records of this City Council for the meeting
of Tuesday, March 16, 1948

Following the adoption of the foregoing. Resolution No. 1406, the
City Council continued in adjourned regular session as adjourned from
its meeting of March 10, 1948, Councilmen Haskell, Lytle, Tolliver and
Rinn present, Councilman Riggs absent.
The minutes of the adjourned regular meeting of March 10, 1948
were read, approved as read and so endorsed by the Mayor.
No persons appearing at this time, the order of Public Hearings
was passed.
COLSIUNICATIONS & REPORTS. -
Chief of Police Fore by letter advised the Council that
the 1929 Ford Pick-up operated 'ay Poundmaster Forrest E.
Cooper had outlived its usefulness and that repairs were
not adviseable. Mr Fore submitted prices on Chevrolet
POUNDMASTMS and Ford pick-ups and J Ton trucks acceptable as subst-
POUND CAR itutes for this car. At the suggestion of Superintendent
PURCHASE OF Killelea, the 1937 Chevrolet pick-up used in the electric
T4Y0 TRUCKS department was made available to Mr Cooper and the Super -
AUTHORIZED intendent of Utilities authorized to secure informal
proposals on a 1J ton and a J ton truck for his department.
The authorization to purchase a used 1947 1+J ton truck
given March 10th was then rescinded.
The City Planning Commission, having held one public

City Engineer Heckenlaible presented a report of twenty -

Mr Heckenlaible also directed the Council's attention
to the waste of water caused by defective or illadjusted

plumbing fixtures and suggested that an inspection

program be instituter; at once in view of the fact that

waste of water is also a waste of electrical power. It

appearing that there is ample power to enforce regulations
against water waste in existing ordinances, Mr Heckenlaible
was directed. to proceed in the best manner he deemed
possible to secure compliance with the regulations against
the wasting of water.

would approve an. amendment to the lease to. allow a rental
of at least $225.00 per month, was approved and ordered
mailed.
In the matter of the application of Evangelist Irene B.
Vlagner for permission to rent a part of the old Salem
School grounds; the clerk read a letter from Dr H.H.
Patten of Patten College and Seminary endorsing her as
a person of good character. The Council still being in
some doubt as to the adviseability of renting this lot,

without some further investigation, directed that the local
Ministerial Association be advised of the application and
asked to express their views.
ORDINANCE NO. 366 - " AN ORDINANCE AMENDING THE ZONE DISTRICT
MAP OF THE CITY OF LODI BY RECLASSIFYING AND REZONING THE
ORDINANCE 366 NORTHERLY 67 FEET OF THE EASTERLY 140 FEET OF LOW 30, OF THE
i ADOPTED and LODI BARNHART TRACT " having been regularly introduced an
APPROVED March 10, 1948 was brought up for passage on motion of Council-
man Haskell, Lytle second, second reading omitted after read -
by title, by unanimous consent, and this ordinance finally
passed, adopted and ordered to print by the following vote:
AYES: Councilmen, Haskell, Lytle, Tolliver and Rim
NOES. None. ABSENT: Councilman Riggs.
Mayor Rine then signed 8rdinance No. 366 in approval thereof.
City Treasurer Vincent C. Webb's financial statement and report
TREASURER for the month of February, 1948 was received and read. Transfer
REPORT of accounts, other than General Fund to Farmers & Merchants
FEBRUARY Bank of Lodi was approved.
CHEROKEE LANE The City Clerk was directed to ascertain from the Division of
SIGNALS ? Highways if any progress was being had in the installation
of traffic signals on Cherokee Lane (State Highway 4).
LICENSES Business license applications as filed with the City Clerk
were ordered referred to the Chief of Police for investigation.
CLAIMS Claims (miscellaneous) in the amount of $41,540.91 as cert -
&a 540.91 ified by the City Clerk, were allowed and ordered paid.
City Engineer Heckenlaible stated that he had conferred with
AMERICAN Attorney Reuben P. Rott of the proposed.Northern San Joaquin
RIVER WATER Water Conservation District and with W. B. Hogan, City Manager
FILING of the City of Stockton relative to this City's filing on
AUTHORIZED unappropriated waters of the American River. Mr Heckenlaible
was authorized to so file on behalf of the City of Lodi after
conferring with the Division of Water Resources of this State.
At this time, City Attorney Glenn West presented ORDINANCE
N0. 367 - " AN ORDINANCE CREATING THE OFFICE OF CITY MANAGER
ORDINANCE 367 OF THE CITY OF LODI, DEFINING HIS POYMS AND DUTIES AND PRClV-
INTRODUCED MING HIS COMPENSATION " and the same was read section by
DEFINING section by the City Clerk. On motion of Councilman Tolliver,
POWERS & Haskell second, Section 6 of the proposed ordinance was

CITY MANAGER " Section b. No claim or demand shall be audited or allowed
which is not approved by the City Manager "
Councilman Tolliver then moved the introduction of Ordinance
No. 367, this motion seconded by Councilman Haskell, and by
the same motion, this ordinance was ordered laid over for
not less than five days. Motion carried and ordinance declared
to stand introduced.
Mayor Rinn then stated that the City Council desired to express
its appreciation to the representatives of the newspapers
APPLICATIONS who had so fully supported the Council's proposal that Lodi

the Council. On motion of Councilman Tolliver, Lytle second,
the Clerk was directed to insert an advertisement in " Western
City " inviting applications for this position.
At 10:10 P.M. the City Council retuned into executive session
for conference with the City Engineer, the City Attorney and
the Superintendent of Puhlic Utilities, returning to open
meeting at 11:00 P.M.

Mayor Rinn presented an assignment of the filings made by

Wednesday, March 24, 19LL8, directing the City Clerk to
