HomeMy WebLinkAboutMinutes - March 3, 1948246 COUICIL CHAX3ERS CITY COUNCIL CITY HALL - CITY OF LODI NEDNESDAY, MARCH 3rd.,1948 This regular meeting of the City Council of the City of Lodi was called to order by the Mayor at 8:00 P.M. of Wednesday, March 3, 1948, Councilmen Haskell, Lytle and Rine present, Councilmen Riggs and Tolliver absent. Also attending, City Attorney West, Superintendent of Utilities Killelea, City Engineer Heckenlaible, Street Superintendent Bruner and Chief of Police - Fore. The minutes of the last meeting held February 25, 1948 were read, approved as read and so endorsed by the Mayor. PUBLIC HEARINGS - In the matter of the purchase of a crawler type diesel tractor and shovel for use at the refuse disposal site: Superintendent of Streets it. L. Bruner recommended the purchase of the equip- ment offered by Moore Equipment Company at $10 225.00 deliver - PURCHASE OF ed, stating that this bid included state sales tax and that TRACTOR AND Moore Equipment Company would hold this price firm for a SHOVEL FOP, period of thirty days. On motion of Councilman Lytle, Haskell, REFUSE SITE. second, award was made to Moore Equipment Company at -the above CONDITIONAL price, the City to have the option to cancel its order at any AAARD TO time within the next thirty days. This reservation was made MOORE EQT CO so that if legal difficulties prevented the City from using its land for refuse disposal, it would not be forced to purchase unneeded equipment. Informal hids on alterations and additions to the employment building, No 125 N. Kohler ................. 14 500.00 OFFICE At the suggestion of Mayor Rinn, concurred in by the other BUILDING members of the Council, no action was taken at this meeting pending an attempt to secure more favorable rental terms from the State of California. City Engineer Heekenlaible was instructed to negotiate a new lease with a rental of at least $150.00 per month from the State. At this time Mr Carl Dietz, father of Donald Dietz, orally requested favorable consideration of his claim for surgical CARL DIB"1Z attention to his son occasioned by reason of a collision of CLAIM FOR an automobile in which the boy was a passenger with a city INJURY TO truck driven by William Meyer. This accident occured on May DONALD DIEM 23, 1947 and the City Clerk reported that he had transmitted all claims arising out of this accident to the local agent of Fireman's Fund Indemnity Company, carrier of the city's automobile liability insurance. Matter referred to the City Attorney and City Clerk to ascertain the insurance company's reasons for denying responsibility. San Joaquin Safety Council by letter recommended that the intersection of California Street with Lockeford Street be protected by adding stop signs controlling Lockeford Street LOCKEFORD traffic in addition to those now stopping California Street. CALIFCRNIA Mrs Stanley 14hittaker of the Parent Teachers Association STREET spoke in favor of this four way stop as protecting school INTERSECTION children. On motion of Councilman Faskell, Lytle second, 4 ('LAY STOP Resolution No, 1399, A FMOLUTION =UIRING ALL VEHICULAR RES, 1399 TRAFFIC ON LOCKEFORD STR—_-ET To STOP BEFORE ENTF.RiNG THE INVEMB.CTION OF THIS STREET WITH CALIFORNIA STRUT It was introduced and then adopted by the following vote: AYES: Councilmen, Haskell, Lytle and Rinn NOES: Councilmen, None. ABSENT: Councilmen Riggs and Tolliver. The stopping of either West Tokay Street or South School TOKAY & Street at their common intersection was discussed. No SCHOOL action taken pending recommendations of the Street Superin- tendent and the Chief of Police. Allocation of gasoline tax moneys to the imprBlWileef Church Street from Lodi Avenue to Kettlenan Lane;- some of the property owners along this portion of the street was restricted to ordinary maintenence and minor repair pending the adoption of a comprehensive plan for permanent (minutes of March 3, 1948 - continued) 2-x'7 Lodi Athletic Club applied for use of Lodi Stadium on the even- ings of September 3rd and 10th and every Sunday through the months LODI ATHLETIC of September, October and November, except the Sunday already CLUB A.PPLICAT- assigned to Lodi Grape & Wine Festival, for the purpose of holding ION FOR STADIUMfootball games. Owing to the unknown effect of the power shortage in these months, and also, to some of the dates requested being uncertain, It was ordered that this application stand submitted, to be considered when these doubtful factors were eliminated. A petition requesting that parallel parking be required on Elm PARA PARKING Street between lain and Stockton Streets was received and read. E. ELM ST No action taken pending the time when parallel parking would be PPAPOSED enforced on all streets where practical. Messrs Ahgelo Dickoff and George Aberle objected to this change. Superintendent of Utilities Killelea applied by letter for the TRUCK AND authority to purchase a truck for the electrical department and GAS ENGINE a gasoline or deisel engine for use on No 4 pump/ Mr Killelea PURCHASES was instructed to obtain prices,on the desired equipment and submit them to the Council for consideration. Mayor Rinn then read a letter from Governor Earl Warren su;gest- means for cooperative effort in the saving of the use of electric WATER power, now critical on account of water shortage. Mayor urged the SHORTAGE conservation of power and water, stating that both must be restricted to essential uses, and, that if voluntary compliance with conservation rules should prove insufficient, means must be had to make compliance enforceable through adeggte penalties. Elmer 7kimer, Engineering Aid, applied for an allowance of 10¢ per mile instead of the 8¢ allowed, for use of his private E. A request of radio station KXOB, Stockton for a transcript of K30B City Council proceedings was denied as the City had no one at this time available to take care of such information.. TR.ASURBR'S Treasurer -Collector Vincent C. Webb's report of collections during REPORT FOR the month of February amounting to $52 894.44 was read and the FEBRUARY City Clerk instructed to make pay -in orders accordingly. In the matter of the annexation of approximately fourteer acres of uninhabited territory in the Southeast corner of Section 11, Tomn- ship 3 North, Range 6 East as petitioned by Jacob Knoll and others, COU'I'LL CHAi43ER1. CITY F.I.°L - O improvement of this thoroughfare and the Superintendent of Streets instructed to modify the applications to the Division of Highways to this effect, This being the time and place set for the hearing of objections to the City Councils intention to grant variences to each of Lots VARIENCES IN 35,36,37,38,39,40,41 and 42 of Cainard Subdivision, proper proof 6`AINARD SUB. of publication was produced and on a call for objections, none ORDERED were offered. It was then ordered that the set back line from GRANTED Orange Avenue appertaining to each of these lots be fixed at fifteen feet, motion Councilman Haskell, Lytle second. A public hearing was then conducted on the application of Gustav REZONING OF Maas for Commercial Zoning of the 67 foot by 140 foot lot on the PORTION OF Southwest corner of Tokay Street and Central Avenue. A previous IAT 30 LODI hearing having been conducted by the City Planning Commission BARNHART TR and this hearing bringing forth no objections, it was then ORDERED. found that, by reasons of these non -protested hearings, the City- ityCouncil Councilhad acquired jurisdiction to order rezoning of this lot. The Clerk was directed to prepare an ofdinance amending the zone map of this City to this effect and present the same for intro- duction at the next meeting of the City Council. The City Council than decided to initiate action -on its own motion for the annexation of all of the Knoll Subdiv- ision and all of that part of the said Section ll lying Southerly thereto by the adoption of its Resolution.No. 1398 introduced by Councilman Haskell, Lytle second and carried by the following vote: AYES: Councilmen, Haskell, Lytle and Rinn NOES: Councilmen, None. ABSENT: Riggs and Tolliver. In the matter of certain claims against Warren A. Webster as COMPROMISE contractor for damages to property occasioned by his operations W.A.WEBSTER in the construction of Pipe Line 1, a compromise was effected CLAIMS whereby the City would pay one-fourth of the claims filed and Webster the remainder, all as set forth in Resolution No. 1402 adopted by the votes of a12 Councilmen present. ORDINANCE NO. 365, entitled " AN ORDINANCE AMENDING THE TONE DIST- RICT MAP OF THE CITY OF LODI BY ADDING THERETO WOODLAKE TRACT, SPERRY ADDITION, KRIEGER ADDITION, TURNAGE ADDITION, WALNUT ORCHARD ORDINANCE 365 ADDITION, MEMORIAL HOSPITAL ADDITION, MORENZ ADDITION, AND LAKE ADOPTED STREET ADDITION, CLASSIFYING AND ZONING THE PROPERTIES THEREIN AND ALSO ZONING RUMINSON TRACT (LOT 52 OF THE LODI BARNHART TRACT). having been regularly, introduced February 25, 1948 was brought up for passage on motion of 'Councilman Lytle, Haskell second, second reading omitted after reading by title by unanimous consent, and then passed, adopted and ordered to print by the following vote: AYES: Councilmen, Lytle, Haskell and Rinn. NOES: Councilmen, None. ABSENT: Riggs and Tolliver Mayor Rinn then signed Ordinance No365 in approval thereof. Agreements with the Division of Highways for the maintenance of STATE those parts of State Highways 4 and 24 lying within the City HIGHWAYS limits were approved. The period to be cohered being from January MAINTENANCE 1st to June 30th, 1948. Work to be done by the City and paid for AGREM ENTS by the State. Approval had by the adoption of Resolution No. 3.400 passed by the assenting votes of Councilmen Haskell, Lytle and Rini. Business license applications of February 18th were approved and LICENSES licenses ordered granted. The only application received since that date was referred to the Chief of Police. Mayor Rian read a letter from Everett M. Glenn, City Attorney of TELEPHONE Sacramento stating that the cost of contesting the telephone rate RATE CASE case had exceeded contributions and requesting that Lodi contribute an additional $200.00 for this purpose. Request taken under advisement. At 11:20 P.M. the Council was resolved into Committee of the Whole so remaining until 11:50 P.M. when open meeting was resumed. City Attorney Gle:mi West presented an easement deed from J.Louis J.LOUIS PERRIN Perrin and wife for main line sewer right of way across the Perrin EASEMENT lands in Lodi Airport. Deed ordered accepted and payment of $690 ACCEPTED• to grantors authorized by the adoption of Resolution No. 1401 introduced by Councilman Haskell, Lytle second. In the matter of certain claims against Warren A. Webster as COMPROMISE contractor for damages to property occasioned by his operations W.A.WEBSTER in the construction of Pipe Line 1, a compromise was effected CLAIMS whereby the City would pay one-fourth of the claims filed and Webster the remainder, all as set forth in Resolution No. 1402 adopted by the votes of a12 Councilmen present.
