rursuant to the adjournment taken from its regular meeting of January 21,1948,
the City Council of the City of Lodi met in adjourned regular session at 8:00 P.M.
of Wednesday, January 28, 1948, Councilmen Haskel, Tolliver and Rinn present,
Councilmen Lytle and Riggs absent.
The minutes of the regular meeting of January 21st were read, approved as read
and so endorsed by the Mayor.
."o persons appearing to be heard, the order of Public Hearings was passed and
the Council proceeded to take up matters not decided at its last meeting. Messrs
Alvin A. Bender and Orvil G. Pond, applicants for permission to lease a portion of
the former Salem School grounds for a skating rink, were informed by Mayor Rinn that
the Council had decided that it would be contrary to public policy to encumber any
part of this land with a term lease as such a lease might Lnterfere with its sale.
Formal permit for the disposal of garbage at the site purchased from
Fredrickson & Jatson Construction Company about one mile Southeast of
GARBAGE Live Oak School was received from the State Board of Health, this
DISPOSAL permit being granted subject to fourteen restrictive conditions, all
PEWIT of which were in keeping with the City's intentions as to operation.
ACCEPTED On motion of Councilman Tolliver, Haskell second, and at the suggestion
RFS. 1395 of City Attorney Glenn West, this permit was formally accepted, the
ADOPTED City agreeing to do and perform in the manner set forth in the restrictio
This acceptance was recorded by the adoption of Resolution No. 1395
passed by the assenting votes of Councilmen Tolliver, Haskell and Rina.
In connection with the use of this land under the above mentioned permit,

The schedule of Lodi Transit System for operation of its lines in Lodi
LCDI TRANSIT and its proposed re-routing of busses as presented January 14th were
BUS RCUTING ordered returned to H, E. Mahaffey for clarification, it being uncertain
RE-REFE—RJMD from the maps submitted which portions of the present routing would be
abandened.
The petition signed by automobile dealers in Lodi promised by
USED AUTO Attorney Lindsay Marshall January 14th when he presented a draft of an
ORDINANCE ordinance governing the dealing in used cars, was read. There having
TO CITY been but one week for the consideration of the proposed ordinance, it
ATTORNEY was directed that it be laid over until an early subsequent meeting,
the City Attorney to study the same and report his findings as to its
legality.
In accordance with the direction given at the regular meeting of
January 14th, 1948, the City Clerk and the City Attorney presented
SPECIAL a draft of a resolution ordering and calling a special election to
ELECTION be held on Tuesday, March 9, 1948 for the purpose of submitting to

MAR 9,1948 ment and to make the City Clerk and the City Treasurer appointees of the
RES. 1393 City Council. After the reading of this resolution, it was given the
ADOPTED number No. 1393, introduced by Councilman Haskell, Tolliver second and
then adopted by the following vote:
AYES: Councilmen, Haskell, Tolliver and Rim
NOES: Councilmen, None. ABSENT, Councilmen Lytle & Riggs.
At the request of City Attorney West and on notion of Councilman
RES. 1396 Tolliver, Haskell second, Resolution No. 1396 was introduced and read
AUTHORIZING by Mr West. This resolution directs the City Attorney to institute
CONDEMNATION suits to condemn rights of way from the City's n Roma Pump " located
RIGHTS OF 71AY near the Central California Traction Company's crossing of the Mokelumne
FROM ROMA river, to the city limits. Fesolution No. 1396 then adopted by the
PLW SITE. assenting votes of all Councilmen present. In connection with the
contemplated construction of this connecting water line, the Acting
EAST SIDE City Engineer was directed to ascertain if East Side 41inery was still
interested in obtaining stand-by and fire protective services from the
City through this line.
A petition for annexation of Lots 21, 232 24 and 30 of Gerard Tract,
N.CROSS ST including the Reiman Subdivision, purporting to be signed by the
ANNEXATION owners of more than one fourth of the area and representing in excess
PEETITICN of one fourth of the assessed valueof these lots, as uninhabited
PF.ESENTED territory was presented and read. A re:. ort including the findings of

the City Planning Commission and recommending this addition for
annexation was then received and read. Such annexation being
FES. 1394 in accordance with other previous acts of the City Council,
ADCPTED it was moved by Councilman Haskell, Tolliver second, that
"N.CP.OSS ST Resolution No. 1394, a resolution approving the annexation
ADDITION" of " North Cross Street Addition " to the City of Lodi be
adopted and on a vote being had, all Councilmen present
approved the passage of this resolution and it was so ordered.
Ordinance No. 362, entitled " AN ORDINANCE RELATING TO THE
NATER, ELECTRICAL, GARBAC, COLLECTION AND 3EWAGE DISPOSAL
ORDINANCE 362 SERVICES OF THE CITY OF LODI AND REPEALING CERTAIN ORDINANCES
INTRODUCED AND PARTS OF ORDINANCES IN CONFLICT HZMVITH IN SO FAR AS
SUCH CONFLICT MAY EXIST " was introducedon motion of Council-
man Haskell, Tolliver second, read at length by the Clerk and
by the same motion ordered laid over for the statutory period
of not less than five days.
Councilman Tolliver, representing the City Council on the City
RECokq. I. iDATIONPla:ming Cocmzission, presented recommendations of the Lodi
TO FILL Realty Board for appointment of one of its members to the
VACANCY CN vacancy created by the death of Mrs Loretta Zwinge. The Realty
P"WING Board suggested that a choice be made from the following:

ing preparation of a suitable resolution.
At 10:30 P.M. the City Council adjourned on motion of Council-
man Haskell.
