This regular meeting of the City Council of the City of Lodi held beginning
at 8:00 o'clock P.M. of Wednesday, November 16, 1949.
Councilmen present: Bull, Haskell, Lytle, Tolliver and Rinn (Mayor) -
Councilmen absent: None.
The minutes of the last regular meeting held November 2nd and of the meeting
adjourned therefrom held November 9th,1949 were approved as written, copies of
such minutes having been mailed each Councilman prior to this meeting.

City Manager Weller reported on the application of Howard Foster,
Hotel Lodi, for a card and dice license, presented to the Council
October 5th and ordered laid over for investigation, stating:

manner in a room in the hotel basement. This room is is to be
for patrons of the hotel and as a means of discouraging card
playing in private roem:s. Games would be conducted by two men
for the hotel owner. The Council, finding that this use was not
the save as that stated in the application, directed, on motion
re.ularly made and seconded, that the license be denied.
Proof of due notice to the public and to affected parties being
proven by affidavits, a public hearing was then held on the
application of Edwin E. Dancer, Jess M. La Roe and James Parkerson
for a permit to operate a taxi -cab business in the City of Lodi.
Mayor Rinn read the application and pertinent sections of Ordin-
ance No. 268 and then declared the meeting open to the reception
of evidence either for or against the granting of this permit.
Jess 11. La Roe, spokesman for applicants, stated that these

men are former employees of City Cab Company, holder of the only

taxi -cab permit in the city; that they had been discharged and

were endeavoring to make jobs for themselves and also to furnish

better cab service that that now furnished by City Cab Company.

A letter was read by the City Clerk signed by Elmer Robinson,
proprietor of " Club Del Monte ", 121 N. Cherokee Lane, denying
that permission had been granted by him for use of Eis premises
by these applicents for a cab stand.
Councilmen questioned 227 Le Roy as to his opinion of the
adequacy of present cab service and also as to the ratio of cabs
to population in neighboring cities. No positive answers given.
The Ityor called for statements from disinterested persons
and none were forthcoming. He then stated that it was the sole
province of the City Council in this matter, to determine if the
public interest and necessity required further cab service than
that now furnished; further, that public interest demanded that
continued service be had. At 8:15 ?L" Le Roy resumed his seat
in the Council aiddienee and W Harry E. Mahaffey, proprietor
of City Cab Company spoke against the granting of this permit,
saying that presebt cabs were taking in but $12.00 to $14.00
per day and offering to rent his entire bus and cab business to
the applicants for X500.00 per month. Mr Mahaffey contended
that his present zone system of fares is more just than comp-
uting fares by taxi -meter. In response to a direct question
from Councilman Haskell, Mr Mahaffey stated that he would not
re-employ any of the applicants.
Mayor Rinn then asked the Councilmen if they were ready to
make their findings as to the necessity for additional cab service
or if they were willing to defer action to a later date.
Councilman Bull said that he believed that present service
is adequate under normal conditions and was ready to make a
determination at this tile. Councilmen Tolliver stated that
no evidence had been submitted pertinent to the hearing by the
applicants and on motion of Councilman Haskell, Lytle second,
issuance of a permit was denied on the grounds that no showing
had been made as to inadequacy of present service and as to the
necessity of another cab company in Lodi. Motion carried and
at 8:52 P.M. applicants and hir Meha fey left the Council Chambers.

,'.s Weller asked Council approval of his general outline of pro-
ceedure for the a?pointment of a Citizen's Advisory Committee
CITIMS and his statement o£ the aims and objects of such a committee
ADVISORY and of its organization as submitted by letters to each Coancil-
COM111 .�,F. man. This letter was reviewed by Mr 'Keller with some elaboration
OBGAINZ ATIM of minor details. On motion of Councilman Haskell, Bull second,
ApPR04:D. the City y9mager was directed to proceed with the organization
of this Committee with Council approval of the general purposes
and limitations as contained in Pur Wellers statement.
Reporting on off-street parking facilities, present and subject
to consideration for the future, Mr Weiler submitted a map of
the doom -•town area shooing spaces with no improvements of with
minor structures, also lots now operated privately for parking
of automobiles. After briefly viewing this map and considering
immediately available sites, Councilman Bull moved, Lytle second,
that Southern Pacific Company be requested to clean up its station
0_TF-S=_FT grounds facing Sacramento Street between Pine and Ells Streets and
?,*KING make this space available for vehicular parking. This sane action
LOTS, also included a reauest that -the Southern Pacific Company replace
S.P. STATION its dilapidated and outmoded passenger station with a new building.
& 116 W.OAK. City Manager Weller stated that Salomon Brothers had offered to
lease Lot 2, Block 8, Mokelumne,(116 West Oak Street), to the City
at a monthly rental cf $100.00 per month and recommended that this
offer be accepted, rentals to be paid from perking meter income.
On notion of Councilman Bull, Haskell second, moved that the City
lease this lot and that the City Manager enter into a lease which
would provide that the City be reimbursed for its cost in prepar-
ing it for public use if the owners desired to cancel the lease
after the first six months, rental to be at $100.00 per month.
Lr Weller reported progress in the obtaining of a site for a
corporation yard, stating that tVe Max -ray -Hallinan owners of land

from the north side of the stadium property to the Yokelumne River
was also discussed, with two alternate plans for collecting and
disposing of storm seaters accumulating in the Northeast -Dart of
the City.
A report of the City Planning Commission reporting adversely on

of Councilman Bull, Haskell second, the City Council expressed
its concurrence with the Commissions report and denied the permit.

laid over for consideration of ways and means to accomplish this
purpose.
Cn motion of Councill-an Bull, Tolliver second, the City Attorney
was directed to accept a note secured by a second deed of trust

Claims in the amount of $119,559.27, including purchase of V%,000

current expenses, were allowed and ordered paid, motion Counci]ran

AT $75.00 operations at the City Activated Sludge Disposal Plant, Mw

This arrangement to take effect on December 1, 1949 and to
continue at the Council's pleasure.

Councilman Tolliver.
