HomeMy WebLinkAboutMinutes - April 20, 1949352 COU`tCIL CHAMBERS CITY COUNCIL CITY HALL - CITY OF LODI AFRIZ 20, 1949 This regular meeting of the City Council of the City of Lodi was called to order by the Mayor at S-00 o'clock P.M. of Wednesday, April 20, 1949, Councilmen Bull, Haskell, Lytle, Tolliver and Ginn (Mayor) present, none absent. The minutes of the last meeting held April 61 1949 were approved as written, copies having been mailed each Councilman. PUBLIC HEARnm:S - Mr Kenneth L. Lobaugh, speaking for Mr Reuben P. Rott, as respresenting Fast Side Winery, Rama Wine Company, Mine Grow- ers Guild and Community Grape Corporation requested that OUTSIDE FI2M the City enter into a mutual assistance pact whereby city PROTECTION fire fighting apparatus would be available to these companies RKUMTM to augment the protection now furnished by Mok elumne and Woodbridge Rural Fire Districts. This application referred to the City Manager for conference with Fire Chief Polensin and the preparation of tentative agreements, the latter to be submitted to the City Council for consideration. Attorney Robert H. Mallen for his clients Dr Moore and Theo- dare Enzi presented a proposal as to street improvements in " Morenz Tract " lying between the General Mills property and Loma Drive, stating that the tract owners would grade and surface Mills Avenue and Tames Street to the City's present ACCEPTANCE specifications but asking, that as Allen Way in this tract OF STREETS is only a temporary street, that the City Council accept this IN "hMEM PL street when graded and provided with an oil penetration TRACT" surface. Mr 2ftLUen's statement as to Allen Way being eonfina- ed by persons having knowledge of the actions taken by the San Toaquin County Planning Commission and the Board of Supervisors of this County, it was moved by Councilman Bull, Beg 2.1 second, and carried, that the City accept the streets in Morenz Tract, provided that the tract owners surfaced Mills Avenue and Temes Street with at least two inches of oiled mix and that Allen Way was improved with au oiled earth surface as proposed. The application of Tams Geske to operate the " Noble Hotel TAS GEM HE: corner of Sacramento and Elm Streets as a roaming house ROOMING in accordance with the provisions of Ordinance No. 277, having HOUSE LICENSE been approved by the Chief of Police, was approved and a APPROVED. license ordered issued, no Councilman objecting. The City Manager then presented plans and specifications as P & S. FOR prepared by the City Engineer for the installation of add- ST DIM itional seating in Lodi stadium. These were reviewed and SEATING approved by the adoption of Resolution No. 1467, introduced APPR04.D by Councilman Haskell,Lytle second after instructing the City Engineer to call for alternate bids on wood or concrete supports for the seats. (minutes of Apr 20,1949 -continued) COUNCIL CHAMBERS CITY COUNCIL CITY HALL - CITY OF LODI LOMFORD - On the favorable report of the City Manager, the contract for OAK STOIK the Storm Drains in Loclmford Street and in Oak Street, bids DRAIN CONTRACT opened April 6th, was awarded to Karl. C. He ling at his 3;3 MMED offered price of $3,559.74, by the adoption of Resolution of Aae@d No. 1466, introduced by Counci]"en Haskell, Lytle second and carried. Henry Nelson applied, through the City Manager's office for additional driveway space on -the Washington Street side of H.NELSON the lot on the Northeast corner of Pine and Washington Streets. DRI4E'7PAYS It was suggested that Mr Nelson replace the curb for 15 feat NASHINGTON ST. on the South end of the present driveway and be allowed a space of 20 feeton the North. All expense to be bourne by applicant. In accordance with the order of the City Council and on proof of the proper publication of notice thereof, a public hearing was than held on the proposed rezoning of Lot 8 and the Nest R Z01MG LATS 30 feet of Lot 7, Block 409 Mokelumne (HE corner Washington IN BLOCK 40 and Pine Streets. This ordinance was then ordered to stand introduced, the adoption thereof to be had at the neat meeting held five or more days from this date. Sealed informal proposals for the leasing of the boat rental concession at Lodi Lake Park were then opened; A 8hures of BIDS ON BOAT 323 East SSlm Street and Lester C. Randolph, 1102 Turner Road CONCESSION submitted sealed bids; Gordon T. Handel having previously REACTED made a written offer to the City Manager. which be considered to be a firm offer. On notion of Councilman Bull, Lytle second, all bids were rejected and the City Vansgar directed to attempt to negotiate a satisfactory agreement with a satisfactory *bidder. Mr Valler then invited all those inter- ested in securing this concession to meet with him Thursday for this purpose. On report of the City Planning Ccwisaion, a public hearing REARM OMER- before the City Council to be bold May 4, 1949 at 8:00 P.M. SD ON REDON- was ordered to be held on the recommendation that West Lodi 1NG REST LODI Avenue, on the South side, from School Street to Hutchins A48. Street be rezoned for Commercial use and that a set back line for future buildings be established at a distance of forty-four feet, or at such other adequate distance, from the street center line, as might be found necessary for future widening. Central Avenue, Vine to Poplar Street; Mission Street, from APPROVED Central Avenue to Washington Street and Watson Street from RES. 1468 Central Avenue to Stockton Street, ware,then offered for ADOPTED Council inspection. On motion of Councilman Bull, Haskell second, these plana were approved by the adoption of Resolut- ion No. 1468 passed by the assenting votes of all members of the City Council. STAR -BY The City Manager was directed to prepare an agreement with WINE GUILD Wine Growers Guild, similar to that now in force with Shewan- '' PROTECT. TOWN covering stand-by water for fire protection. Lodi Outboard Motorboat Owners Association, through the City Manager, requested, that, if the City leased the motor- MOTORBOAT boat concession at Lake Park, that this Association be OWNSB.S continued the evening use of the lake as in previous years. REgMTS Also, the Association requested the reservation of Sunday, July 10th for its annual aquatic races. This latter request nae given tentative approval but no action taken on the Association•a proposal to charge admission to the park on the date of these races. A proposal from the same body to lease the docks at the Northwest corner of the lake property was referred to the City Manager for investigation. OPERATION OF' Superintendent of Streets W. L. Proper publication of Resolution No. 1461 adopted April 6, 1949 being proven (1) by the affidavit of D. B. Riniret, principal clerk of the publisoers of the Lodi News -Sentinel, in which daily paper this resolution was printed on April EZ&�ITIG OF 11, 1949, (2) by the affidavit of T. F. Blakely, who person- PROPOSED ally posed copies of the resolution on the property affect- SALE OF -fTm ed on April 9, 1949, no persons appeared in response to the BARN" IAT notice of hearing contained in said Resolution No. 1461. It therefore appears that by reason of these publications and from the wide publicity given to the sale of the property described in Resolution No. 1461 prior to the adoption thereof, that the action taken by the adoption of Resolution No. 1464 authorizing the execution of*a deed to this pouparby is properly authorized and such sale confirmed as complying fully with the pTovialms of Section 862(e) of the Municipal Corporations Act. A delayed invitation from the City of Merced to attend the C.Y.D.-L.C.C. quarterly meeting of the Central Valley Division of the MERC&D League of California Cities to be held in that City on the APR 21,1949 evening of Thursday, April 21, 1949 was read. Five Council— and officers of the City indicated their intention to attend and such attendance was authorized without formal motion. Claims in the amount of $29,047.98 as presented by the City CLA.nm Manager ware approved and ordered paid; motion Councilmen Lytle, Haskell second. The application of Lodi Plumbing & Beating Company for a GRA-M-FIONA reduced rate on water taps and sewer connections in Graffigna TRACT - WATER Tract, (Nomens1#1 project) was considered. The Superinten- & SEM TAPS dent of Utilities was instructed to bill at City*s cost. Burr's Sub- - division of Lot 2 abutting on Lots 1,2,3 and 4 of that Block and the North j of vacated Palm Avenue abutting on the above Lot 1. Motion Councilmen Bull, Haskell second.
