CITY HALL - CITY OF LODI
*MONDAY, FEBRUARY 21,1949
Pursuant to the adjourffient taken from its regular meeting of February
169 1949, the Cit? Council of the City of Lodi met at 11:30 P.M. of Monday,
February 21, 1949, Councilmen Bull, Haskell, Lytle, Tolliver and Rinn present;
City Manager Taller, City Attorney West and City Clerk Blakely together with
representatives of Northers San Joaquin County Mosquito Abatement District
and several interested citizens also attending.
Mayor Rinn outlined the proceedings motivating the City Council's present
action to sell the lot and building on the southwest corner of Pleasant Avenue
and Locleford Street and also informing prospective purchasers of the use
limitations e3.sting at this time; the property being occupied and used as a
° non-confoxming use " under Ordi#ance No. 238.
Mr Winfield S. Montgomery of the Mosquito Abatement District and Mr
Ernest Campbell of the same, urged that sale of this property to the District
be treated as a negotiated contract at an agreed price.. Mr Robert H. Mullen,
Attorney for this District addressed the Council, stating that the District's
use of the property was the only known use, none of the other prospective
purchasers having definitely stated the use to which the property would be
put in the event he was the successful buyer.
Lester Lind then said that he contemplated using the lot as a warehouse,
later modifying this statement to the effect that he would use it as the
City Council might specify, perhaps as an apartment house or sqm_e commercial
peinItted use.
Mayor Rinn then stated that, if the property was not sold to the Mosquitp
Abatement District, it should be regoned and offered for sale by public bids.
Hazen Weil advocated sale to the District but said that he would be a
bidder if the property was not so sold and would use it as s sales and service
location for automobiles.
Councilmen Bull and Tolliver spoke in regard to the proper use of the
lot if sold. Councilman Lytle recamn<ended that sale be made to the best
bidder.
- Mr Campbell then withdraw the offer of the Mosquito Abatement. District
and air Tolliver moved, Bull second, that the classification of this lot be
referred to the City Planaing Commission for recommendation to the Council
after public hearings had pursuant to law and ordinance, the deposit of
Arthur Lind made February lfith to be returned.
At 12:27 P.M. the City Council adjourned.
