This regular meeting of the City Council of the City of Lodi held beginning
at 8:00 P.M. (P.S.T,) of Wednesday, February 16, 1949, Councilmen Bull, Haskell,
Lytle, Tolliver and Rinn (Wayor) present, none absent.
The minutes of, the last meeting of February 2, 1949 were approved as written
and mailed to each Councilman prior to this meeting.
CITY hAN G"ER'S REPORT -
Mr H. D. Weller submitted the offer of Northern San Joaquin
County Mosquito Abatement District to purchase the lot on the
Southwest corner of Pleasant Avenue and Lockeford Street, common-
ly called " The Tin Bern Property " for the sum of $4,500.00.
Mayor Rinn stated that, since public axnouncement of the receipt
PROPOSED of this offer, he had heard that others desired to make offers
SALE OF for this lot. Arthur Lind, 830 South Church Street, being present,
"TIN BA1" orally, offered $5,000, depositing a check for $500.00 as earnest
PROPERTY money on his offer. Mr Earnest Campbell of N.S.T.C.M.A.D. conten-
CONTINUED ded that the offer of this District had really been accepted and
that the District and the City had reached an agreement as to
the fair value of the lot. Mr Lind was asked as to his intentions
for use of the lot if acquired by him but made no statement. He
was informed of the present zoning of the lot and of the conditions
under which it was now used. It appearing that no conclusion
could be reached at this time, it was agreed that the Council Would
most at 11:30 A.M. of Monday, February 21, 1949 and then attempt
to make its determination.
I& Weller reported that Street Superintendent Bruner had investig-
CITY CAB CO. ated the present status of cab stands of City Cab Company and
CAB STOW that the stand near Greyhound Bus Depot on West Locust Street
was the only one approved either under the provisions of Ordin-
ance No. 268 or Ordinabce No 360. Mr H. E. Mahaffey had been
apprised of this condition and had agreed to make formal applic=
ations for other stands in accordance with Ordinance No. 360.
On recommendation of the City Manager, Hotel Lodi was permitted
HOTEL LODI to replace its sign on Fast Pine Street, west of Cherokee Lane
SION APPROVED in accordance with the application submitted February 2nd, such
replacement to be had subject to any restrictions of the State
Division of Highways, if any, requiring non -conflict with traffic
signals at the intersection of Pine Street and Cherokee Lane.
CAMON CONTRACTA revised contract with Howard L. Cannon for removal of salvage
APPROVED materials from the Harney Lena Disposal Area for the calendar
yee- 1949 was read and approved for execution by the City.
24'r Weller reported that at least twelve of the twenty-six applic-
ations for the position of Recreation Director were worthy of

Y= AS HEC- Districts and the City Council be held at an early date to
MT10N, DIR. consider applications filed and set a data for closing the
receipt of further applications. A tentative date for such a
meeting was determined as either February 28th or March 1st.
The Student Body of Lodi Union High School having submitted
a list of dates for use of Lodi Stadium in accordance with
its contract of May 5, 1940, Ur Weller submitted this list and

SANTA CLARA a contract for consideration with Santa Clara College covering

CONTRACT October 9th. Contract approved and the Mayor authorized to
execute the same, motion Councilmen Bull, Lytle second.
Councilman Bull suggested that -future contracts have a mini=mnn
guarantee to cover cost of preparing for tire contemplated use
and post -use cleanup.
An application of the Cancer Prevention Society for a permit to
solicit funds arms left with the City Manager for investigation.

The request of school authorities for a protected zone in front
3MR=1 of Emerson School was granted by the adoption of Resolution No.
SCHOOL 1456 limiting parking of automobiles in front of a portion of
?-*U=G ZONE Emerson School grounds and directing the Street Superintendent
to mark the protected area with red paint.
Mr 'Weller submitted an application from the proprietor of Service
SERVICE Laundry for a loading zone opposite his place of business at
IAUNDRY 505 N. Sacramento Street, explaining that through a misunderstand -
LOADING ing, the street painting crew had already marlo3d this area. It
ZONE was decided to leasee this marking as made without formal proceed-
ings to establish this zone.
GRIT^FIN & A lease to Griffin and Miller Lumber Company covering the West
MILLER MAO eighty feet of Lot 14, Live Oak Colony, Map No. 1 for three years
APPROVED at $350.00 per year was entered into on motion of Council-aan
Lytle, Bull second.
kir Weller read a letter from. " New Car Dealers Association "
requesting an amendment to Section 4 of Ordinance No. 364 so
OFMINANCE 384 that the period of the bond required by this section would be
USED CAR for the initial year following issuance of a permit. A proposed
DEALERS BOND amendment was read and a representative of the Dealers Association
IN MIYUCED being present, acquiesced in the amendment as mead. This amendment
as OP.DIWCE N0. 384 " AMKNDING SECTION 4 OF ORDINANCE NO. 364 "
was then introduced by Councilman Bull, Haskell second and
ordered to take the course prescribed by law fof-city ordinances.
Proper publication of " Notice to Bidders " being proven by
affidavit, bids were then opened for the purchase by the City
of a two tam truck for use of the Street Department, as follows:

R. P. BARBOUR, proposing to subdivide a 71 acre tract of land
South of Tokay Street extended and lying between Pleasant Ave.
and S. Hutchins Street orally requested a statement of the City
Council as to its requirements for curbs and gutters along
R.P.BARB6UR S. Hutchins Street, a county road. Ur Barbour was 1pformed
SUBDIVISION that curbs and gutters would be required along this street
PT.,ANS and that the matter of set back to provide for future widening
DEBATED. of Hutchins Street would be a matter for the City Planaing
Commission's determination. Mr Barbour also requested inform-
ation as to the improvement of Nest Tokay Street, part of which
would be acquired by hi= but the northerly portion would be
along the property of Sturla. He was directed to ascertain if
he could work out an agreement with the other owner either for
present or future payment for Improvement of this street.
1r Charles S. Louden of the local chapter of the Brotherhood of
Carpenters and Joiners, Local 18, requested a statement from the
PROTEST VS City Council as to the continuance of its policy with regard to
CONSTRUCTIO,i the doing of construction work by contract and not ft City
T=Rx BY CITY maintenance crews. He referred particularly to a job at Lodi
=W5. Stadium done by a city force. Mayor Rinn assured Mr Louden that
the City, except in unusual instances, pursued a policy to do
new work by contract and directed that he take the matter up
with the City Manager, laying any evidences of complaint before
him.

INTRODUCED. TENERFAF AND = MANNER OF COLLECTING SM F= " was intro-
duced on motion of Councilman Haskell, Lytle second, read and
explained by the City Manager and then ordered laid over for
the statutory period of not less than five days before passage
by unanimous consent of all Councilman.
Following the introduction of the above Ordinance, Mr Weller
NEW CONTRACT submitted and read a proposed new contract with Sanitary City
SWITARY Scavenger Company to become effective April 1, 1949 on the
CITY SCAQAN- expiration of the present contract with the same company. On
GER COSY motion of Councilmen Haskell, Lytle second, it was directed that
PROPOSED. this contract be submitted to the Stavanger Company and if
accepted by it, that it be returned to the City Council for
final approval and execution.
ORDINANCE NO. 382 " AMENDING SECTION 23 OF ORDINANCE NO. 373
EN TT ' LICENSING FOR THE PURPOSES OF Mr -NM, CERTAIN
PROFESSIONS, BUSINESSES, TRADES AND OCCUPATIOVS IN TEM CITY
ORDINANCE OF LODI ' " , having been regularly introduced on February 2,1949
NO. 382 was brought up for passage oa motion of Councilman Haskell. Bull
ADOPTED second, second reading emitted by unanimous consent, and then
passed, adopted and ordered to print By the following vote:
A)MS: Councilmen, Haskell, Bull, Lytle, Tolliver and Rine
1+0ES: Councilmen, None. ABSENT: Councilmen, None.
Maytr Rinn then signed ordinance No. 362 in approval thereof.
Claims, as approved by the City Manager and submitted by the
CLAW Finance Director in the amount of $29,279.52 were allowed and
ordered paid on motion of Councilman Tolliver, Haskell second.
Lodi Sportsman's Club offered to remove the present building
SPORTSb=13 over the Municipal Baths Pools at no cost to the City should
CLUB OFFER the City decide that it would be to the City's best interest
to tear down this building.
Answering a query by Councilman Bull as to the extension of the
use permit granted Chris Keazler for permission to extend his
TMG7.TZr USE building on the SW corner of Pleasant and Lodi Avenues, Mr Weller
PEMaT S.W. reported that he had viewed the work now under way but as he
PLEASANT & had ascertained that Nieszler intended to use this extension for
IADI AVENUE : a'barber-shop i.A -not as an extension of the dental clinic
LIBZTED. building sutrject to the original use permit, Nleszler had been
advised that this use- Is impossible in this district.
The neat half hour was devoted to discussion of requests of Lodi
Grape and Mine Festival for deviations from rules applying to
the use of Lodi Stadium and adjacent land during the days of
this years emmal grape and wine festival.
ADJOURNMENT At 11:30 P.H. the City Council adjourned to 11;30 A.M. of
Monday, February 21, 1949 on motion of Councilman Tolliver.
