Councilmen present: Bull, Haskell, Lytle, Tolliver and Riau (Mayor) None absent. i Minutes of the last meeting held December 15,1948 approved as written. REPORT OF CITY MANAGER H. D. 1W.0 R - Mr Weller explained the reasons for complaints received by him regarding the provisions made in Section 6 of Ordinance No. 375 relating to the $5.00 annual license fee imposed on "Home Occupations " Where gross proceeds are less than $500.00 and submitted a proposed ordinance amending this section so as to AbMIMMENT TO exempt this class from any license fee where the income from SEC 6,OR1) 375 such business is $1,000 or less per year. It was moved by INTRODUCED Councilmen Bull, Haskell second, that this section be further emended to exclude " physically handicapped persons" from any license tax on businesses carried on from their homes. Amendment accepted and ordinance introduced as " ORDINANCE NO. 382, Am=ING SECTION 6 OF ORDINANCE No. 375, ENTILTED ' LICENSING FOR THE PURPOSE OF REVENUE CERTAIN PROFESSIONS, BUSINESS, TRAlE9 AhM OCCUPATIONS IN TIM CITY OF LOTH'" . By this same motion, this ordinance rams ordered laid over for the statutory period of not less than five days. A statement setting Porth informal bids received by the City Engineer on the unlet portions of the " Employment Building AWARD ITIO Additions and Alterations " as directed December 15,1948 was C.E.F.G. ON then submitted, J. F. Watson for Items C, S. F and G $16,088.00, EMPLOIlI "r Wisner & Miller for the memo, $14,906.90, Ws E. Mattingly BUILDING UM offering to do this work: at actual cost with a maximun price BY R3S. 1448 of $179000. It was then moved by Councilman Tolliver, Lytle second, that award be made to Wisner and Miller as the lowest and best bidder. Award was so made by the adoption of Resolut- ion No. 1448 passed by the following vote: AIRS: Councilmen, Toll iver,Lytle, Bull,Easkell and Rinn NOES: Councilmen, None. ABSENT: None. The Mayor vas directed to execute a lease with the State of EMPLOMaVT California on the Employment Building effective March 1,1949 EU11MI IG . or on completion and acceptance of this building, by the LEASE A'JMV- adoption.of Resolution No. 1449 introduced by Councilman Bull, ED. RES 1449 Haskell second and carried without dissenting vote. An agreement with Wisner & Booker of Sacramento for making WISMM & a technical survey of the City's electrical facilities in BECMM two sections, $2,500 to be paid this firm on completion of AGRMOM Section 1 and a further payment of $2.500 on the completion A_--PROWBD. and acceptance of Section 2, (if undertaken), 'vas approved and ordered executed, motion Councilman Haskell, Tolliver second. Mr Weller reported that the Federal Government had exercised KINGSBMT its right to cancel the interim license for conduct of Kings- AIRN'DTT.D bury Auxiliary Airfield as of June 30, 1948 and that the Mayor LICENSE had signed acceptances of this cancellation. Officers of the CANCELLED City are now soliciting offers for the disposal of all City properties at the airport site. On the solicitation -of Street Superintendent W. L. Bruner as LODI AVE & submitted by the City Manager, applications for project state - CENTRAL AVE ments for the improvement of parts of West Lodi Avenue and of GAS TAX South Central Avenue as tentatively approved December 1591948 PRO7ECT3 were affirmed and applications ordered submitted to the Divis- AFFIPMM ion of Highways. A call for the neat meeting of the Central Valley Division of _ C.Y.D.-L.C.C. the League of California Cities to be held in Stockton on MEETING January 2091949 was read and it was directed that reservations CALLED for ten be made for this meeting. Mr Weller than reviewed the present status of the 1948-49 budget, the City's cashposition and the progress being made on several projects underway, recommending that the Council BUDGET be prepared to make several transfers both to and from the MATTERS Contingency Fund to and from funds where excess amounts had been located or where there had been an insufficient allooat- ion in the original annual budget. Claims against the Treasury in the amount of $439203.67 as CLAI165 submitted by the Department of Finance through the City Manager $43,203.67 were allowed and ordered paid. Bruner, Park Superintendent, bad been served with verified copies of summons NOTICE OF and complaint in an action in the Superior Court of San ACTICJ OF Joaquin County wherein Marie S. Cook and others seek damages COOK vs CITY for the death of Howard S. Cook on July 11, 1948 a+� Lodi I'm Park and that the City's insurance carrier, Hartford Accident and Indemutty Company were appearing for,the City through their attorneys. Chief of Police Fore reporting that he had been unable to find MARY WILLLAM3 anything against the applicant, Mary Williams was granted a BUSINESS license to conduct a fortune telling business at 7 North LICENSE School Street submitted December 15, 1948, provided that she GRANTED furnish the bond and make the payment required by Ordinance No. 277. Approval of the annexation of " Costa Addition "was constmated by the final passage of ORDINANCE NO. 379, ENTITLED " APPROVING OOSTA ADIV. NOES: Councilmen, None. ABSMT: None. Mayor Rinn'then signed Ordinance No. 379 in approval thereof. ORDINANCE NO 380, AN ORDINANCE APPROVING THE AXU=TION TO THE T & D ADW CITY OF LODI OF CERTAIN UNIMABr= TERRITORY IN TBE COUNTY ORDINANC3 380 OF SAN TOAQUIN, DESIGNATED " T & D ADDITION " AND MORE PARTIC- PASSED DEARLY DESCRIBED BEREn was then brought up for passage on motion of Councilman Tolliver, Lytle second, second reading omitted after reading by title and than passed, adopted and ordered to print by the following vote: AMS: Councilmen Tolliver, Lytle, Bull, Hasloell and Rion NOES: Councilmen, None. ABSENT: None. Mayor Rinn then signed Ordinance No. 380 in approval thereof. Councilman Haskell, Lytle second, then brought up Ordinance ALLEY No. 381, entitled ^ ORDER DIRECTING THE VACATION OF A PUBLIC VACATION ALLEY IN 9LOCK 6 BURRS ADDITION TO LODI, S'UMD=ION OF APPROVED LOT 2 "". Councilman Hull recowended that the regulatory provisions of CARD GAELS Ordinance No. 277 be redrafted, particularly those parts REGUTATTON relating to legal card games and that the permit fees be carefully considered as the present low rates might prove attractive to undersireable elements.
