This regular meeting of the City Council of the City of Lodi called
to order by the bhycr at 8:10 oteloek P.M. of Wednesday, October 18,1950.
Councilmen 3u11, Haskell, Prezzler, Finn and Tolliver (Ehyor) pres-
ent, none absent.
The minutes of the previous meeting held'Ootober 4, 1950 were appro-
ved as written, copies having been mailed each Councilman prior to this
meeting.
IWORT OF TEE CITY IUTAGER -
The sale of Block 36, Ltokelumne, having been eoasummated,
Mr Weller brought up the problem of the removal of the
Child Day Care Center building, fence and wading pool now
located in the Southeast corner of this property. An
CHILD DAY excerpt from the Council's minutes of April 7, 1948 was
CARE CI=E read, showing an implied committment by the City Council
PaUCPAL to provide space for this building in sere other location
on City owned property. I.Ir Weller stated that Mrs Barron
of the Center contended that the City was obligated to not
only provide a site but also move the building and appurt-
enances. No Councilman, the City Attorney or the City
Clerk could recall any statement that the City would move
this building, its only obligation being to furnish a site.
Finally determined that the City Linger prepare• a list of
available locations and invite representatives of the Day
Care Center to meet with the City Council irmediately prior
to the nest meeting to be held November 1, 1950.
On application of the contractor, approved by the City
A first supplimental agreement affecting projects Nos. 150
SIIPPLIiMM4.L 19, 20, 21 and 22 of the Agreement for Expenditure of Gas
GAS TAX Tax Moneys upon State Highways dated Tanuary 28, 1948 vas
AGREH INT approved by the adoption of Resolution No. 1570 introduced
APPROVED by Councilman Rinn, Bull second, all Councilmen voting in
RPS. 1570 favor thereof. This suppliment contains the amount of
$27,392.27 for storm sewers in State Highway 4 accrued
under Section 203 of the Streets and HiSbusys Code.
The following recommendations of the Pension Board created
by Ordinance No. 416 adopted Icy 17,1950 were read by the
City )manager and action in each instance taken as hereafter
mentioned:
(1) For Prior Service Credit: Permanent employment
PENSION BOLRD shall be considered as effective six months
RECO_11�Ti mz after the date the employee was first employed.
This regulation is necessary because records
prior to the adoption of the ordinance creating
the Personnel System on December 3, 1941 and as
maintained in war times are incomplete and makes
definite determination of pemanent employment
dates difficult. Recamnendation approved on
motion of Councilman Bull, Haskell second.
(2) Full credit for military service rendered prior
to Tuly 1, 1950 will be allowed where the employee
returned to City service immediately on discharge
from the awned services of the United States, it
being definitely understood that this credit does
not apply to any subsequent military service to
the above date, which is the effective date of
the City retirement and pension system.

(3) That the money appropriated in the 1950-51 budget ($5000)
as the City's share of the cost of prior service. commit-
ments be irm diately transferred to the Pension und. W
'Yeller said that he deemed this recommendation unnecessary
PENSION BOARD as this money would eventually be appropriated to the

CONTINUED. objection to this proposal, it was moved by Councilman
Bull, Preszler second, that this transfer be made as
recommended; motion carried and so ordered.
( At 9:05 o'clock P.U. Councilman Preszler was excused from
attendance and left this meeting. )
Pacific Telephone and Telegraph Company having filed an application
with the State Public Utilities Commission for an increase in rates,
Mr Weller read a letter from Bill L. Dozier, City Attorney of the
City of Stockton, stating that his City vas introducing evidence
P.T. & T. CO. to combat this application and soliciting a contribution of $200.00
R1TE INCREASE toward the cost of preparing its case. This letter was addressed
$200.00 to City Attorney GLenn West, alio approved such a contribution.
APPROPRIATED Mr Weller offered no objection to this payment provided that the
money was used to ascertain if the raise in rates is justified,
not merely for objections unsupported by competent evidence.
The Council approved Mr Weller's contention and Councilman Bull
moved that this contribution or so much thereof as might be found
necessary be made. Councilman Haskell seconded this motion and
it was carried by assenting votes Cf the four Councilmen then
present.
A revision of the resolution establishing the Toint Recreation
Commission was presented by Mr Weller, copies having been
furnished each Councilman prior to this meeting. Councilman

terns. This resolution, as above amended was then given the
nmmber 1571, introduced by Councilman Bull., Haskell second, and
then passed without dissenting vote.
At this time, Theodore Nickel, subdivider of " Inkeside Park "
subdivision, asked that the City Council consider the recommen-

therein, Councilmen Haskell moved, j3ull second, that this zoning
be set for public hearing November 1, 1950 after publication
of the legally required notice. •
On report of the City Sagineer that but one bid, that of I&Guire
and Hester of Oakland, Calif. bad been received October 16th, in

ORDERZO. Haskell, Bull second; plans and specifications to be the same as
RFS. 1569. adopted by_ Resolution No. 1560 adopted September 20, 1950; bids
to be received up to 11:00 A.M. of Monday, October 30,1950.

On oral report of the City Engineer made to the City Munger, `
SARGENT RD. a contract for the construction of Sanitary Sewer in Sargent �
CO_RINTH AVE Road and Corinth Avenue was awarded Wm. Burkbardt as lowest
SEWER bidder in the amount of $3,170.00 by adopting Resolution No.1568
AWARDED introduced by Councilman Rinn, Bull second and carried by the
RBS. 1568 vote of all four Councilmen present.

Mr Weller read a letter expressing appreciation of Lodi
LODI DIST. District Chamber of Commerce for the allotment of $1500.00
