Councilmen Bull, Haskell, Lytle, Tolliver and mayor Rinn present. Councilmen abseLt, none. Approval of the minutes of the meeting of Larch 1st deferred to next meeting, copies not being available to Councilmen previous to the day of this meeting. REPORT OF THE CITY r "ANAGF.R - U.C. BUSINESS LI CISE RES. 1516 ADOPTEP ANNEXATION "RALMAR TR." REAMING ON arTC=ATION "HORTON ADDN" ORDINANCE NO. 409 INTRODUCED. City L'amager H. D. Weller mentioned that representatives of the Engineering Department of the University of California were now conducting experiments at this City's sewage disp- osal plant, having chosen it in preference to Turlock as a pilot plant for investigation of sewage problems. No objections were raised to the granting of a wholesale alcoholic beverage license to H..M.Company at 705 North Sacramento Street or to the transfers of retail licenses at 114 and at 115 North Sacramento Street as contained in notices from the State Board of Equalization. Ee Meller reviewed a tentative draft of a co-operative agreement between the Department of Public Works, Division of Highways for the. installation of storm drains serving portions of city major streets and state highways in or bordering on the'City. This agreement, if -entered into, would allow the expenditure of in excess of $27,000 now credited to the City from former " Gas Tax for State Highways " for these drainage structures. Ordered referred to the City Manager and the City Engineer for preparation in final form and then submitted to the City Council for approval and execution. In connection to the letting of an intra -city motor bus line franchise, bids to be received April 3rd and considered April 5th, Mr Weller stated that Nehererand Son of Ellensburg, Washington were interested in bidding on this franchise. A letter from Bixby and Company of Buffalo, N.Y. stating the qualifications of a client for the position of City Manager was read and referred to the City Manager for reply. The informal application of F. 7. Harkness, doing business in Lodi as United Packing Company, for abatement of penalty for delinquent payment of 1949 business license, was deferred on account of insufficient evidence as to mitigating circums- tances justifying such abatement. On receipt of the approval of the City Planning Commission, Resolution of Intention No. 1516 was adopted by unanimous vote as introduced by Councilman Haskell, Lytle second, in which resolution, the intention of the City Council was declared to annex as " Reimer Addition ", a tract of three and one half acres on the Northeast corner of Cross Street and Lockeford Avenue in. Gerard Tract, proceedings to be had under the " Annexation of Uninhabited Territory Act of 1939 and the public hearing thereon to be on April 5, 1950. In accordance with the notice contained in Resolution of Intention No. 1509, adopted February 15, 1950, a public hearing was then held for the reception of objections to the annexation of " HCRTCN ADDITION " to the City of Lodi under provisions of the " Annexation of Uninhabited Territory Act of 1939 ". No objections, written or oral were presented, after production of evidence of due publication of notice. It was then moved by Councllmen Bull, Tolliver second, that ORDINANCE NO. 409 - APPROVING TBE ANNEXATION OF " HORTO N t ADDITION " TO '_E CCITY OF LODI, CALIFORNIA " be introduced; motion carried without dissent and this ordieerce ordered laid over to the date of the next Council meeting. Ordinance ordered intro- duced on this motion and laid over to the date of the next regular meeting of the City Council. The City Council concurred with the recammendations of the City Planning Cormission in each of the following a?plicat- ions from the strict application of the provisions of Ordinance No. 238 relating to required side yards: VARZ'310ES GP.ANTED (1) Lloyd Dawson, as to Lots 5, 7, 9 and 11, Block 2 of DA:gSON, LOCRr, Sanguinetti Addition in the 500 block of North School SA?0, L..ERZA Street, south side yard three feet, north side yard to be increased to five feet to compensate. (2) Charles Moore and hike Sabo, owners of Lots 42 and 41 of Cainard Subdivision, ofsetting variances as to distances from the coomon boundary line of these lots in correction of an error made by Uoore in the location of a garage. (3) Sohn Lerza and wife. Reversing corner lots on the Southeast corner of Oak Street and Crescent Avenue to fact Oak Street instead of Crescent Avenue where- by the dwelling to be erected on the street corner lot would came within four feet of the dwelling to be erected on the east or alley end of these lots. Claims in the amount of $31,630.53 as approved by the City M -412M Maiager were allowed and ordered paid on motion of Councilman Lytle, Bull second. In the matter of the opening of North Orange Avenue from Pine to Oak Street, previously continued to this meeting: MT Weller read a letter from h!r Robert H. hi len, representing Louis and Catherine Fugazi, stating that he had been unable to reach a satisfactory settlement with Bernardino Barengo and Jerry Salomon as to the division of the costs of improving this portion of street and requesting that the Council throw the problem in dispute into a special assessment district as a means of settlement. Discussion between Councilmen, Mr ttAlen and Mr Barengo lasted for over one hour, when it was moved by Councilman Bull that this matter be laid over to the next meeting in order to ascertain if the City could particip- ate in the costs, (to arrive at a settlement), without jeapordizing its former policy requiring that subdividers pay for all improvements in their subdivisions. Councilman Haskell seconded this motion, suggesting that the intervening time be devoted to the acquiring information required for making special assessments whether the work is paid for by such proeeedure or not. Barbour, subdivider of a six acre tract in the Attest: . F. No. 3 " submitted the final map of this tract for Council approval. BAgBCUR- Cbz the certificate of the City Engineer that this final map was HEEMMN substantially in accord with the tentative map approved by the i TRACT NO 3 City Planning Commission, it was moved by Councilman Lytle, APPROVED Tolliver second, that the map be approved. Motion carried and Mayor Rinn signed the map, the City Clerk attesting and affixing the seal of the City. - nL Yeller reported that he had held a conference with the Adjutant General of the California National Guard and Verne W. Hoffman, the ART;iOBY Assemblyman from this district on March 14th in regard to the SALE TO purchase, by the State, of Lodi Armory. A tentative agreed price STATE of $60,000 had been determined but that the method of payment ryas yet to be settled.
