Councilmen present: Bull, Haskell, Lytle, Tolliver and Rinn. None absent. Minutes of last meeting held January 18, 1950 approved as written and mailed. REPORT OF THE CITY ZNAGER - City Manager H. D. Weller reported receipt of formal notice from the State Board of Equalization that Betty Tune Kuhlman and Le Roy E. Kuhlman had applied for the transfer of the on sale liquor license now held by Esther and Pete Vinciare111 at 440-442 South Main Street to 13 East F.ettleman Lane and that he had received several oral protests against this transfer. LIQUOR LICENSE Pyr Weller stated that he had advised these protestants that they 13 KETTLF.LL;N should make their objections in writing to the State Board of Equalization and to the City Council. tic written protests addressed to the City Council have been received up to the date of this meeting. Councilmen Tolliver recommended, that if this transfer was approved by the State Board of Equalization, that the licensee be required to furnish space for "off-street" parking so as to prevent parking along Kettleman Lane, which lane is State Highway No. 12 which will eventually be one of the main connecting links between the bay area, the Redwood Empire and the Central Valley region.. The City Manager was directed to notify the State Board of Equalization of the pending protests which would be formally presented to the Board if sufficient time was granted in which to secure signatures. tm Weller read a letter from Robert H. Millen, Attorney for the Yugazi interests, requesting action in the improvement of Orange Avemie, Oak Street to Pine Street, dead presented at the January 18th meeting. Mr Weller read a letter signed jointly bJr Dino Barengo and Jerry Salomon stating their ORANGE AVENUE unwillingness to share in the cost of paving the east half of OPENING FRCM this street and offering to install concrete curbing and gutters OAK TO PINE along their several properties. Mr Barengo being present, restated the opinions voiced in the above letter and contending that the paving should be an obligation of the properties on the west side of this part of Orange Avenue. The Council requested that the parties at interest attempt to reach an amicable settlement and report its results at the February 15th meeting. Cn motion of Councilman Bull, Tolliver second, penalties LIPELT im?osed by Section 10 of Ordinance PIo. 375 against Werner T. FENALTY Lipelt, were ordered abated in the amount of $36.00 in that ABATE) there was no deliberate attempt to avoid payment of this license, licensee being ignorant of the fact that in addition to his master plumbers' license, he would have to be licensed under the business license tax ordinance. Councilmen wolliver requested that a thorough check be made of all business places to see that they were properly licensed. MONTHLY REPORT The monthly report of the Chief of Police, including a tabulat- POLICE DVT. ion of offenses by classes was received and copies furnished each Councilman. chis report covers the month of Tanuary 1950. SECOND-HAND Councilman Tolliver inquired as to the efforts of the Police DEALERS Department to enforce the provisions of the ordinance relating to dealers in second hand goods. Mr Weller premised to enquire into the enforcement of this ordinance. Claims in the amount of $43,424.94 as submitted by the Finance CLAIMS Department and approved by the City Manager were allowed and ordered paid on motion of Councilmen Haskell, Bull second. Ur Weller reported that he has received an application for use ;SET AUTO of Lodi Stadium for midget auto races for the months from April PACE„ to September 1950. He was instructed to have the application submitted in writing showing the financial responsibility end experience of the promotors. 410 (minutes of February 1,1950 -continued) COU'!CI:. '711A73FERS CITY COIJ'ICIL CITY HALL - CITY Or LODI The City Manager was instructed to comply with the request GALT - PCUND of the City of Galt, under such terms as might be mutually agreeable, allowing that City to use the facilities of the Lodi City Pound for disposition Of impounded animals. A final map, filed under the " Subdivision Map Act ", entit- led " Westwood Hees " in Lot 9, Gerard Tract, was approved on the certificate of the City Engineer that this map is FINAL NAP in substantial compliance with the tentative map approved WESTWOOD by the City Planning Coc=ission on January 23, 1950. Biotion HOES of Councilman Ba bell, Hull second, acceptance of the public ,LmPR07ED streets in this tract to be predicated on their improvement to city standards and requirements. Mayor Rinn endorsed the City Council's approval on this map. The use permit granted by the City Planning Commission on January 23, 1950 was limited to thirty days before becoming USE PERMIT final in order to allow neighboring property owners an FRIENDLY opportunity to protest against the use of the premises at NEIGHBORHOOD 210 East Elm Street as a church by Friendly Neighborhood CEORCH Church, to wham the Planning Ccmmission had granted this permit. A letter from the City Planning Commission calling the City Council's attention to conditions obtaining at the " War JOHNS & POEM Surplus Depot " operated by Johns and Pohle at 1130 South COAGUINY VS. Cherokee Lane, described as industrial, being used es a wrecking and junk yard was referred to the City Manager. Mr Weller stated that be had been infonwd that the present lease expired June 30th of this year and would not be renewed. The petition of Ben L. Horton for annexation of a 150 foot PETITION by 735 foot strip along Cherokee Lane, North of Krieger AINEXATION Addition, was denied action for two weeks to allow a canvas HORTON of property owners to the north of this strip in order to ascertain if they would join with Horton in seeking annexation. Tokay Oil Company, 1000 South Cherokee Lane, notified the City Council by letter that it contemplated operating it's SELF -SERVE service station at this address as a " serve your -self " SERVICE station. There being no ordinances regulating, prohibiting STATION or permitting such means of operation, any action on this TOKAY OIL. notice was put over to the February 15th meeting so that evidence, either for or against self service stations could be presented, to be used as a basis for regulatory ordinances, if any were found to be required. ORDINANCE NO. 406 - APPRO'VMG THE A13n= ICF OF " FAIRMONT PARS ADDITIaN " TO THE CITY OF LORI, CALIFOENTA, having been ORD. 406 regularly introduced on January 18, 1950 was brought up for FAIRMQQT PARK passage on motion of Councilman Hull, Tolliver second, second ATNATICN reading omitted, after reading by title. by unanimous consent, PASSED and then passed, adopted and ordered to print by the follow- ing vote: AYM: Councilmen, Bull, Tolliver, Haskell, Lytle and Rion NOES: Councilmen, None. ABSENT: None. Mayor Rinn then signed Ordinance No. 406 in approval thereof ORDINANCE NO. 407 - REPEALING FINANCE NO. 324 ADOPT1M AIS A'PROVED MAY 15,1946, GRANTING A FRANCHISE TO H. E. MAHAFM ORD. 407 FOR lrr OP13EiATION OF INTRA-hOINICIPAL MOTOR BUS LINES, having RESCINDING been regularly introduced on January 18, 1950, was brought up MAHAFFEY for passage on motion of Councilman Haskell, Bull second, BUS FRANCHISE second reading omitted, after reading by title, and then pass - ADOPTED ed, adopted end ordered to print by the following vote: AYES: Councilmen, F.askell, Bull, Lytle, Tolliver and Rina. NOES: Councilmen, None. ABSENT: None. Mayor Rina then signed Ordinance No. 407 in approval thereof. Various suggestions for appointment to the proposed " Citizens Advisory Ccmittee " were furnished the City Manager by members of the City Council with a view of distributing apointments aeographically. Mr Meller took notice IMIRMENT of several changes suggested by City Attorney Glenn West, princip- 1 PLAN TO ally relating to the definations of " Employee " and " member "; I, EFLOY-M also, as relating to part time employees. It was unanimously determined by the City Council, that this suggested ordinance be referred to the City Imployees for study as to its details and approval or disapproval, such action to determine further proceedings before the Council.
