COUNCIL CHAMBERS, CITY HALL
DECEMBER 17, 1952
This regular meeting of the City Council of the City of
Lodi held beginning at 5:05 o'clock p.m. on Wednesday, Decem-
ber 17, 1952; Councilmen Preszler, Richey, Rinn, Robinson and
Haskell (Mayor) present; none absent.
The minutes of the previous meeting, December 3, 1952,
were approved after authorizing the following corrections:
(a) The last sentence of the first paragraph under
Public Hearings relating to the Day Care Center to be
corrected to read, "The Council agreed that this would
be the position of the City in the matter and that the
City Manager and the City Attorney be authorized to pre-
pare a lease containing a provision for cancellation
after a 3C -day notice."
(b) The next to last sentence of the third para-
graph under City Planning Commission relating to the
tentative map of the Lawrence Ranch Subdivision be cor-
rected to read, "It was then agreed that the subdivider
should be informed that the City Council favored the
following changes to the map before submitted as a
final map:
(1) Parcel 'A' to be dedicated as a street;
(2) Each of parcels 'B' and 'C' to be dedi-
cated as a 'public way' with no otliga-
tion on the part of the subdivider to
improve said parcels."

FOR
DISTRICT COURT
Letter from Robert A. Bainbridge, Judge -Elect
of the Lodi Judicial District, requesting four
additional parking spaces be reserved in front
of the Justice Court on Sacramento Street for
use by City vehicles after the new Lodi Judicial
District Court goes into effect January 5, 1953.
The 'ity Manager was authorized to locate four
yellow narking zones in suitable places.

It was reported that Mrs. Althea Groves had
agreed to accept appointment to the Recreation
Commission should the appointment be extended
to her. On the motion of councilman Richey,
Robinson second, Mr. C. A. Van Buskirk was re-
appointed to a new term and Mrs. Groves was
appointed to fill the position vacated by Mrs.
Stella Higginbotham. The City Clerk was instructed
to prepare a letter to Mrs. Higginbotham convey-
ing the appreciation of the Council for the long
and faithful service as a member of the Recrea-
tion Commission from its inception to the present
time.
Mr. 'Weller reported the tabulation of bids for
the construction of sewers in Kettleman Lane and
South School Street. The M.J.B. Construction
Company of Stockton was the low bidder with a
total bid of x7702.50. The second lowest bid
of •072i.25 was by William Burkhardt of Lodi.
i•:r. Weller stated that his recommendation that
the award be made to the M.J.B. Construction
Company was based on the legal limitation of the
State law which requires that the awsrd be made
to the lowest responsible bidder. In answer

to inquiries of the Council the City Attorney
stated that it would be necessary to first estab-
lisn that the low bidder was not responsible
before the bid could be rejected in favor of the
local bidder. Resolution No. 17i6, awarding the
contract for sewer construction to the :.J.B.
Construction Company was adopted on the motion
of Councilman Rinn, Richey second.

The City Manager reported the tabulation of bids
for gasoline for the calendar year 1953. Of the
RES. NC -1715 six firms submitting bids, Tokay Oil Company of
AWARDING Lodi was low with a bid of 17z' cents a gallon for
GASOLINE regular gasoline and1921 cents a gallon for ethyl
CONTRACT gasoline. On the motion of Councilman Richey,
Rinn second, Resolution No. 1715, awarding the
contract to the Tokay Oil Company, was adopted by
a unanimous vote.
Specifications for a pump to be installed in the
storm sewer line at the corner of Lockeford Street
and Sacramento Street for the purpose of pumping
storm water from the industrial waste line into
the storm sewer line were submitted for approval.
Mr. Weller explained that there was a possibility
that the pump specified may not be available for
delivery in sufficient tirme to meet the City's
needs; in which case the specifications would
STOR:SEISER require modification to a slight degree in order
PU1•:P SPECS. to receive immediate delivery. The specifications
were approved on the motion of Councilman Robin-
son, Richey second, with the provision that the
specifications could be modified, as the City
Engineer deemed necessary, prior to advertisement.
Councilman Robinson then stated that he had talked
to the City Engineer regarding the possibility of
installing booster pumps in the storm drains in
the downtown area as a means of speeding the flow
of storm water. Mr. Weller replied that this may
be a better answerto the problem than installation
of larger pipes; howeve, it does have the dis-
advantage of being mechanical and subject to
mechanic breakdowns.
ORDINANCE NO. 472, "AN ORDINANCE EXTENDING THE
BUILDING SET -BACK LINE ON KETTLEriAN LANE (STATE
HIGH -WAY 53) TO THE PROPERTIES WEST OS SOUTH HUTCH -
INS STREET", having been introduced after public
hearing on December 3, 1952, was brought up for
passage on the motion of Councilman Robinson, Rinn
second, second reading omitted by unanimous consent,
ORD. NO. 472 after reading by title, and then passed, adopted
ADOPTED and ordered to print by the following vote:
AYES: Councilmen, Preszler, Richen, Rinn, Robin-
son and Haskell
NOES: Councilmen, None ASSENT: Councilmen, None
Mayor Haskell then signed Ordinance No. 472 in
approval thereof.
At the hour of 8:45 o'clock the meeting was ad-
journed to 7:30 o'clock p.m. of •ionday, December
22,-1952. on the motion of Councilman. Rinn.
